L. 114–95, title IX, § 9215(p)(1), Dec. 10, 2015, 129 Stat. 2170.)","seq_in_title":5960,"parent_identifier":"/us/usc/t42/ch105/schII–B","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch105","level":"chapter","num":"CHAPTER 105—","heading":"COMMUNITY SERVICES PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch105/schII–B","level":"subchapter","num":"SUBCHAPTER II–B—","heading":"CHILD CARE AND DEVELOPMENT BLOCK GRANT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idd87311aa-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c\"><num value=\"9858c\">§ 9858c.</num><heading> Application and plan</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd87311ab-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Application</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To be eligible to receive assistance under this subchapter, a State shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary shall by rule require, including—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd87311ac-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/a/1\"><num value=\"1\">(1)</num><content> an assurance that the State will comply with the requirements of this subchapter; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd87311ad-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/a/2\"><num value=\"2\">(2)</num><content> a State plan that meets the requirements of subsection (c).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd87311ae-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Period covered by plan</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The State plan contained in the application under subsection (a) shall be designed to be implemented during a 3-year period.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd87311af-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Requirements of a plan</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd87311b0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Lead agency</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The State plan shall identify the lead agency designated or established under <ref href=\"/us/usc/t42/s9858b\">section 9858b of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd87311b1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Policies and procedures</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The State plan shall: <ref class=\"footnoteRef\" idref=\"fn003822\">1</ref><note type=\"footnote\" id=\"fn003822\"><num>1</num> So in original. Subpars. (D) and following do not continue from introductory provisions.</note></chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311b2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Parental choice of providers</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Provide assurances that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311b3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/A/i\"><num value=\"i\">(i)</num><chapeau> the parent or parents of each eligible child within the State who receives or is offered child care services for which financial assistance is provided under this subchapter are given the option either—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311b4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/A/i/I\"><num value=\"I\">(I)</num><content> to enroll such child with a child care provider that has a grant or contract for the provision of such services; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311b5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/A/i/II\"><num value=\"II\">(II)</num><content> to receive a child care certificate as defined in <ref href=\"/us/usc/t42/s9858n/2\">section 9858n(2) of this title</ref>;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311b6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/A/ii\"><num value=\"ii\">(ii)</num><content> in cases in which the parent selects the option described in clause (i)(I), the child will be enrolled with the eligible provider selected by the parent to the maximum extent practicable; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311b7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/A/iii\"><num value=\"iii\">(iii)</num><content> child care certificates offered to parents selecting the option described in clause (i)(II) shall be of a value commensurate with the subsidy value of child care services provided under the option described in clause (i)(I);</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">and provide a detailed description of the procedures the State will implement to carry out the requirements of this subparagraph.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311b8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Unlimited parental access</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Certify that procedures are in effect within the State to ensure that child care providers who provide services for which assistance is made available under this subchapter afford parents unlimited access to their children and to the providers caring for their children, during the normal hours of operation of such providers and whenever such children are in the care of such providers, and provide a detailed description of such procedures.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311b9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Parental complaints</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Certify that the State maintains a record of substantiated parental complaints and makes information regarding such parental complaints available to the public on request and provide a detailed description of how such record is maintained and is made available.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311ba-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Monitoring and inspection reports</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include a certification that the State, not later than 1 year after the State has in effect the policies and practices described in subparagraph (K)(i), will make public by electronic means, in a consumer-friendly and easily accessible format, organized by provider, the results of monitoring and inspection reports, including those due to major substantiated complaints about failure to comply with this subchapter and State child care policies, as well as the number of deaths, serious injuries, and instances of substantiated child abuse that occurred in child care settings each year, for eligible child care providers within the State. The results shall also include information on the date of such an inspection, and, where applicable, information on corrective action taken.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311bb-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Consumer and provider education information</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include a certification that the State will collect and disseminate (which dissemination may be done, except as otherwise specified in this subparagraph, through resource and referral organizations or other means as determined by the State) to parents of eligible children, the general public, and, where applicable, providers—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311bc-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i\"><num value=\"i\">(i)</num><chapeau> information about the availability of the full diversity of child care services that will promote informed child care choices and that concerns—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311bd-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/I\"><num value=\"I\">(I)</num><content> the availability of child care services provided through programs authorized by this subchapter and, if feasible, other child care services and other programs provided in the State for which the family may be eligible, as well as the availability of financial assistance to obtain child care services in the State;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311be-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/II\"><num value=\"II\">(II)</num><content> if available, information about the quality of providers, as determined by the State, that can be provided through a Quality Rating and Improvement System;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311bf-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/III\"><num value=\"III\">(III)</num><content> information, made available through a State Web site, describing the State process for licensing child care providers, the State processes for conducting background checks, and monitoring and inspections, of child care providers, and the offenses that prevent individuals and entities from serving as child care providers in the State;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311c0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/IV\"><num value=\"IV\">(IV)</num><content> other programs for which families that receive child care services for which financial assistance is provided under this subchapter may be eligible, including the program of block grants to States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<ref href=\"/us/usc/t42/s601\">42 U.S.C. 601</ref> et seq.), Head Start and Early Head Start programs carried out under the Head Start Act (<ref href=\"/us/usc/t42/s9831\">42 U.S.C. 9831</ref> et seq.), the program carried out under the Low-Income Home Energy Assistance Act of 1981 (<ref href=\"/us/usc/t42/s8621\">42 U.S.C. 8621</ref> et seq.), the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<ref href=\"/us/usc/t7/s2011\">7 U.S.C. 2011</ref> et seq.), the special supplemental nutrition program for women, infants, and children established under <ref href=\"/us/usc/t42/s1786\">section 1786 of this title</ref>, the child and adult care food program established under <ref href=\"/us/usc/t42/s1766\">section 1766 of this title</ref>, and the Medicaid and State children’s health insurance programs under titles XIX and XXI of the Social Security Act (<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq., 1397aa et seq.);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311c1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/V\"><num value=\"V\">(V)</num><content> programs carried out under section 619 and part C of the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311c2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/VI\"><num value=\"VI\">(VI)</num><content> research and best practices concerning children’s development, including social and emotional development, early childhood development, and meaningful parent and family engagement, and physical health and development (particularly healthy eating and physical activity); and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311c3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/i/VII\"><num value=\"VII\">(VII)</num><content> the State policies regarding the social-emotional behavioral health of young children, which may include positive behavioral intervention and support models, and policies on expulsion of preschool-aged children, in early childhood programs receiving assistance under this subchapter; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311c4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/ii\"><num value=\"ii\">(ii)</num><chapeau> information on developmental screenings, including—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311c5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/ii/I\"><num value=\"I\">(I)</num><content> information on existing (as of the date of submission of the application containing the plan) resources and services the State can deploy, including the coordinated use of the Early and Periodic Screening, Diagnosis, and Treatment program under the Medicaid program carried out under title XIX of the Social Security Act (<ref href=\"/us/usc/t42/s1396\">42 U.S.C. 1396</ref> et seq.) and developmental screening services available under section 619 and part C of the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.), in conducting developmental screenings and providing referrals to services, when appropriate, for children who receive assistance under this subchapter; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311c6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/E/ii/II\"><num value=\"II\">(II)</num><content> a description of how a family or eligible child care provider may utilize the resources and services described in subclause (I) to obtain developmental screenings for children who receive assistance under this subchapter who may be at risk for cognitive or other developmental delays, which may include social, emotional, physical, or linguistic delays.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311c7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Compliance with State licensing requirements</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311c8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/F/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall include a certification that the State involved has in effect licensing requirements applicable to child care services provided within the State, and provide a detailed description of such requirements and of how such requirements are effectively enforced.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311c9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/F/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> License exemption</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the State uses funds received under this subchapter to support a child care provider that is exempt from the corresponding licensing requirements described in clause (i), the plan shall include a description stating why such licensing exemption does not endanger the health, safety, or development of children who receive services from child care providers who are exempt from such requirements.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311ca-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G\"><num value=\"G\" class=\"bold\">(G)</num><heading class=\"bold\"> Training and professional development requirements</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311cb-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall describe the training and professional development requirements that are in effect within the State designed to enable child care providers to promote the social, emotional, physical, and cognitive development of children and to improve the knowledge and skills of the child care workforce. Such requirements shall be applicable to child care providers that provide services for which assistance is provided in accordance with this subchapter.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311cc-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall provide an assurance that such training and professional development—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311cd-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/I\"><num value=\"I\">(I)</num><content> shall be conducted on an ongoing basis, provide for a progression of professional development (which may include encouraging the pursuit of postsecondary education), reflect current research and best practices relating to the skills necessary for the child care workforce to meet the developmental needs of participating children, and improve the quality of, and stability within, the child care workforce;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311ce-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/II\"><num value=\"II\">(II)</num><content> shall be developed in consultation with the State Advisory Council on Early Childhood Education and Care (designated or established pursuant to section 642B(b)(1)(A)(i) of the Head Start Act (<ref href=\"/us/usc/t42/s9837b/b/1/A/i\">42 U.S.C. 9837b(b)(1)(A)(i)</ref>)), and may engage training providers in aligning training opportunities with the State’s training framework;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311cf-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/III\"><num value=\"III\">(III)</num><content> incorporates <ref class=\"footnoteRef\" idref=\"fn003823\">2</ref><note type=\"footnote\" id=\"fn003823\"><num>2</num> So in original. Probably should be “incorporate”.</note> knowledge and application of the State’s early learning and developmental guidelines (where applicable), the State’s health and safety standards, and incorporates social-emotional behavior intervention models, which may include positive behavior intervention and support models;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311d0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/IV\"><num value=\"IV\">(IV)</num><content> shall be accessible to providers supported through Indian tribes or tribal organizations that receive assistance under this subchapter; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311d1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/V\"><num value=\"V\">(V)</num><chapeau> to the extent practicable, are appropriate for a population of children that includes—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd87311d2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/V/aa\"><num value=\"aa\">(aa)</num><content> different age groups;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd87311d3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/V/bb\"><num value=\"bb\">(bb)</num><content> English learners;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd87311d4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/V/cc\"><num value=\"cc\">(cc)</num><content> children with disabilities; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd87311d5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/ii/V/dd\"><num value=\"dd\">(dd)</num><content> Native Americans, including Indians, as the term is defined in <ref href=\"/us/usc/t25/s5304\">section 5304 of title 25</ref> (including Alaska Natives within the meaning of that term), and Native Hawaiians (as defined in <ref href=\"/us/usc/t20/s7517\">section 7517 of title 20</ref>).</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311d6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Information</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall include the number of hours of training required for eligible providers and caregivers to engage in annually, as determined by the State.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311d7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/G/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall not require an individual or entity that provides child care services for which assistance is provided in accordance with this subchapter to acquire a credential to provide such services. Nothing in this section shall be construed to prohibit a State from requiring a credential.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311d8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/H\"><num value=\"H\" class=\"bold\">(H)</num><heading class=\"bold\"> Child-to-provider ratio standards</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311d9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/H/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Standards</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall describe child care standards for child care services for which assistance is made available in accordance with this subchapter, appropriate to the type of child care setting involved, to provide for the safety and developmental needs of the children served, that address—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311da-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/H/i/I\"><num value=\"I\">(I)</num><content> group size limits for specific age populations, as determined by the State;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311db-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/H/i/II\"><num value=\"II\">(II)</num><content> the appropriate ratio between the number of children and the number of providers, in terms of the age of the children in child care, as determined by the State; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311dc-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/H/i/III\"><num value=\"III\">(III)</num><content> required qualifications for such providers, as determined by the State.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311dd-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/H/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary may offer guidance to States on child-to-provider ratios described in clause (i) according to setting and age group, but shall not require that the State maintain specific group size limits for specific age populations or child-to-provider ratios for providers who receive assistance in accordance with subchapter.<ref class=\"footnoteRef\" idref=\"fn003824\">3</ref><note type=\"footnote\" id=\"fn003824\"><num>3</num> So in original. Probably should be “with this subchapter.”</note></p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311de-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> Health and safety requirements</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include a certification that there are in effect within the State, under State or local law, requirements designed to protect the health and safety of children that are applicable to child care providers that provide services for which assistance is made available in accordance with this subchapter. Such requirements—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311df-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i\"><num value=\"i\">(i)</num><chapeau> shall relate to matters including health and safety topics consisting of—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/I\"><num value=\"I\">(I)</num><content> the prevention and control of infectious diseases (including immunization) and the establishment of a grace period that allows homeless children and children in foster care to receive services under this subchapter while their families (including foster families) are taking any necessary action to comply with immunization and other health and safety requirements;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/II\"><num value=\"II\">(II)</num><content> prevention of sudden infant death syndrome and use of safe sleeping practices;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/III\"><num value=\"III\">(III)</num><content> the administration of medication, consistent with standards for parental consent;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/IV\"><num value=\"IV\">(IV)</num><content> the prevention of and response to emergencies due to food and allergic reactions;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/V\"><num value=\"V\">(V)</num><content> building and physical premises safety, including identification of and protection from hazards that can cause bodily injury such as electrical hazards, bodies of water, and vehicular traffic;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/VI\"><num value=\"VI\">(VI)</num><content> prevention of shaken baby syndrome and abusive head trauma;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/VII\"><num value=\"VII\">(VII)</num><content> emergency preparedness and response planning for emergencies resulting from a natural disaster, or a man-caused event (such as violence at a child care facility), within the meaning of those terms under <ref href=\"/us/usc/t42/s5195a/a/1\">section 5195a(a)(1) of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/VIII\"><num value=\"VIII\">(VIII)</num><content> the handling and storage of hazardous materials and the appropriate disposal of biocontaminants;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/IX\"><num value=\"IX\">(IX)</num><content> for providers that offer transportation, if applicable, appropriate precautions in transporting children;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311e9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/X\"><num value=\"X\">(X)</num><content> first aid and cardiopulmonary resuscitation; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311ea-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/i/XI\"><num value=\"XI\">(XI)</num><content> minimum health and safety training, to be completed pre-service or during an orientation period in addition to ongoing training, appropriate to the provider setting involved that addresses each of the requirements relating to matters described in subclauses (I) through (X); and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311eb-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/I/ii\"><num value=\"ii\">(ii)</num><content> may include requirements relating to nutrition, access to physical activity, or any other subject area determined by the State to be necessary to promote child development or to protect children’s health and safety.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311ec-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/J\"><num value=\"J\" class=\"bold\">(J)</num><heading class=\"bold\"> Compliance with state and local health and safety requirements</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include a certification that procedures are in effect to ensure that child care providers within the State, that provide services for which assistance is made available in accordance with this subchapter, comply with all applicable State and local health and safety requirements as described in subparagraph (I).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311ed-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K\"><num value=\"K\" class=\"bold\">(K)</num><heading class=\"bold\"> Enforcement of licensing and other regulatory requirements</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311ee-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Certification</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall include a certification that the State, not later than 2 years after <date date=\"2014-11-19\">November 19, 2014</date>, shall have in effect policies and practices, applicable to licensing or regulating child care providers that provide services for which assistance is made available in accordance with this subchapter and the facilities of those providers, that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311ef-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i/I\"><num value=\"I\">(I)</num><content> ensure that individuals who are hired as licensing inspectors in the State are qualified to inspect those child care providers and facilities and have received training in related health and safety requirements, and are trained in all aspects of the State’s licensure requirements;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311f0-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i/II\"><num value=\"II\">(II)</num><chapeau> require licensing inspectors (or qualified inspectors designated by the lead agency) of those child care providers and facilities to perform inspections, with—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd87311f1-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i/II/aa\"><num value=\"aa\">(aa)</num><content> not less than 1 prelicensure inspection, for compliance with health, safety, and fire standards, of each such child care provider and facility in the State; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd87311f2-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i/II/bb\"><num value=\"bb\">(bb)</num><content> not less than annually, an inspection (which shall be unannounced) of each such child care provider and facility in the State for compliance with all child care licensing standards, which shall include an inspection for compliance with health, safety, and fire standards (inspectors may inspect for compliance with all 3 standards at the same time);</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311f3-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i/III\"><num value=\"III\">(III)</num><content> require the ratio of licensing inspectors to such child care providers and facilities in the State to be maintained at a level sufficient to enable the State to conduct inspections of such child care providers and facilities on a timely basis in accordance with Federal, State, and local law; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd87311f4-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/i/IV\"><num value=\"IV\">(IV)</num><content> require licensing inspectors (or qualified inspectors designated by the lead agency) of child care providers and facilities to perform an annual inspection of each license-exempt provider in the State receiving funds under this subchapter (unless the provider is an eligible child care provider as described in <ref href=\"/us/usc/t42/s9858n/6/B\">section 9858n(6)(B) of this title</ref>) for compliance with health, safety, and fire standards, at a time to be determined by the State.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311f5-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/K/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary may offer guidance to a State, if requested by the State, on a research-based minimum standard regarding ratios described in clause (i)(III) and provide technical assistance to the State on meeting the minimum standard within a reasonable time period, but shall not prescribe a particular ratio.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311f6-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/L\"><num value=\"L\" class=\"bold\">(L)</num><heading class=\"bold\"> Compliance with child abuse reporting requirements</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include a certification that child care providers within the State will comply with the child abuse reporting requirements of <ref href=\"/us/usc/t42/s5106a/b/2/B/i\">section 5106a(b)(2)(B)(i) of this title</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311f7-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/M\"><num value=\"M\" class=\"bold\">(M)</num><heading class=\"bold\"> Meeting the needs of certain populations</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall describe how the State will develop and implement strategies (which may include alternative reimbursement rates to child care providers, the provision of direct contracts or grants to community-based organizations, offering child care certificates to parents, or other means determined by the State) to increase the supply and improve the quality of child care services for—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311f8-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/M/i\"><num value=\"i\">(i)</num><content> children in underserved areas;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311f9-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/M/ii\"><num value=\"ii\">(ii)</num><content> infants and toddlers;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311fa-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/M/iii\"><num value=\"iii\">(iii)</num><content> children with disabilities, as defined by the State; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd87311fb-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/M/iv\"><num value=\"iv\">(iv)</num><content> children who receive care during nontraditional hours.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd87311fc-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N\"><num value=\"N\" class=\"bold\">(N)</num><heading class=\"bold\"> Protection for working parents</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd87311fd-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Minimum period</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd87311fe-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N/i/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> 12-month period</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The plan shall demonstrate that each child who receives assistance under this subchapter in the State will be considered to meet all eligibility requirements for such assistance and will receive such assistance, for not less than 12 months before the State or designated local entity redetermines the eligibility of the child under this subchapter, regardless of a temporary change in the ongoing status of the child’s parent as working or attending a job training or educational program or a change in family income for the child’s family, if that family income does not exceed 85 percent of the State median income for a family of the same size.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd87311ff-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N/i/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Fluctuations in earnings</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The plan shall demonstrate how the State’s or designated local entity’s processes for initial determination and redetermination of such eligibility take into account irregular fluctuations in earnings.</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731200-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Redetermination process</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall describe the procedures and policies that are in place to ensure that working parents (especially parents in families receiving assistance under the program of block grants to States for temporary assistance for needy families under part A of title IV of the Social Security Act (<ref href=\"/us/usc/t42/s601\">42 U.S.C. 601</ref> et seq.)) are not required to unduly disrupt their employment in order to comply with the State’s or designated local entity’s requirements for redetermination of eligibility for assistance provided in accordance with this subchapter.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731201-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Period before termination</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">At the option of the State, the plan shall demonstrate that the State will not terminate assistance provided to carry out this subchapter based on a factor consisting of a parent’s loss of work or cessation of attendance at a job training or educational program for which the family was receiving the assistance, without continuing the assistance for a reasonable period of time, of not less than 3 months, after such loss or cessation in order for the parent to engage in a job search and resume work, or resume attendance at a job training or educational program, as soon as possible.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731202-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/N/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Graduated phaseout of care</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall describe the policies and procedures that are in place to allow for provision of continued assistance to carry out this subchapter, at the beginning of a new eligibility period under clause (i)(I), for children of parents who are working or attending a job training or educational program and whose family income exceeds the State’s income limit to initially qualify for such assistance, if the family income for the family involved does not exceed 85 percent of the State median income for a family of the same size.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8731203-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/O\"><num value=\"O\" class=\"bold\">(O)</num><heading class=\"bold\"> Coordination with other programs</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731204-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/O/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall describe how the State, in order to expand accessibility and continuity of care, and assist children enrolled in early childhood programs to receive full-day services, will efficiently, and to the extent practicable, coordinate the services supported to carry out this subchapter with programs operating at the Federal, State, and local levels for children in preschool programs, tribal early childhood programs, and other early childhood programs, including those serving infants and toddlers with disabilities, homeless children, and children in foster care.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731205-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/O/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Optional use of combined funds</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the State elects to combine funding for the services supported to carry out this subchapter with funding for any program described in clause (i), the plan shall describe how the State will combine the multiple sets of funding and use the combined funding.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731206-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/O/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in clause (i) shall be construed to affect the priority of children described in clause (i) to receive full-day prekindergarten or Head Start program services.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8731207-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/P\"><num value=\"P\" class=\"bold\">(P)</num><heading class=\"bold\"> Public-private partnerships</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall demonstrate how the State encourages partnerships among State agencies, other public agencies, Indian tribes and tribal organizations, and private entities, including faith-based and community-based organizations, to leverage existing service delivery systems (as of the date of the submission of the application containing the plan) for child care and development services and to increase the supply and quality of child care services for children who are less than 13 years of age, such as by implementing voluntary shared services alliance models.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8731208-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/Q\"><num value=\"Q\" class=\"bold\">(Q)</num><heading class=\"bold\"> Priority for low-income populations</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall describe the process the State proposes to use, with respect to investments made to increase access to programs providing high-quality child care and development services, to give priority for those investments to children of families in areas that have significant concentrations of poverty and unemployment and that do not have such programs.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8731209-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/R\"><num value=\"R\" class=\"bold\">(R)</num><heading class=\"bold\"> Consultation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include a certification that the State has developed the plan in consultation with the State Advisory Council on Early Childhood Education and Care designated or established pursuant to section 642B(b)(1)(A)(i) of the Head Start Act (<ref href=\"/us/usc/t42/s9837b/b/1/A/i\">42 U.S.C. 9837b(b)(1)(A)(i)</ref>).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd873120a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/S\"><num value=\"S\" class=\"bold\">(S)</num><heading class=\"bold\"> Payment practices</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd873120b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/S/i\"><num value=\"i\">(i)</num><content> a certification that the payment practices of child care providers in the State that serve children who receive assistance under this subchapter reflect generally accepted payment practices of child care providers in the State that serve children who do not receive assistance under this subchapter, so as to provide stability of funding and encourage more child care providers to serve children who receive assistance under this subchapter; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd873120c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/S/ii\"><num value=\"ii\">(ii)</num><content> an assurance that the State will, to the extent practicable, implement enrollment and eligibility policies that support the fixed costs of providing child care services by delinking provider reimbursement rates from an eligible child’s occasional absences due to holidays or unforseen <ref class=\"footnoteRef\" idref=\"fn003825\">4</ref><note type=\"footnote\" id=\"fn003825\"><num>4</num> So in original. Probably should be “unforeseen”.</note> circumstances such as illness.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd873120d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T\"><num value=\"T\" class=\"bold\">(T)</num><heading class=\"bold\"> Early learning and developmental guidelines</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd873120e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall include an assurance that the State will maintain or implement early learning and developmental guidelines (or develop such guidelines if the State does not have such guidelines as of <date date=\"2014-11-19\">November 19, 2014</date>) that are appropriate for children from birth to kindergarten entry, describing what such children should know and be able to do, and covering the essential domains of early childhood development for use statewide by child care providers. Such guidelines shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd873120f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/i/I\"><num value=\"I\">(I)</num><content> be research-based, developmentally appropriate, and aligned with entry to kindergarten;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731210-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/i/II\"><num value=\"II\">(II)</num><content> be implemented in consultation with the state <ref class=\"footnoteRef\" idref=\"fn003826\">5</ref><note type=\"footnote\" id=\"fn003826\"><num>5</num> So in original. class=\"indent5 firstIndent-2\" id=\"idd8731212-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Prohibition on use of funds</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall include an assurance that funds received by the State to carry out this subchapter will not be used to develop or implement an assessment for children that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731213-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/ii/I\"><num value=\"I\">(I)</num><content> will be the sole basis for a child care provider being determined to be ineligible to participate in the program carried out under this subchapter;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731214-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/ii/II\"><num value=\"II\">(II)</num><content> will be used as the primary or sole basis to provide a reward or sanction for an individual provider;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731215-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/ii/III\"><num value=\"III\">(III)</num><content> will be used as the primary or sole method for assessing program effectiveness; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731216-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/ii/IV\"><num value=\"IV\">(IV)</num><content> will be used to deny children eligibility to participate in the program carried out under this subchapter.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731217-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Exceptions</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in this subchapter shall preclude the State from using a single assessment as determined by the State for children for—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731218-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iii/I\"><num value=\"I\">(I)</num><content> supporting learning or improving a classroom environment;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731219-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iii/II\"><num value=\"II\">(II)</num><content> targeting professional development to a provider;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd873121a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iii/III\"><num value=\"III\">(III)</num><content> determining the need for health, mental health, disability, developmental delay, or family support services;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd873121b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iii/IV\"><num value=\"IV\">(IV)</num><content> obtaining information for the quality improvement process at the State level; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd873121c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iii/V\"><num value=\"V\">(V)</num><content> conducting a program evaluation for the purposes of providing program improvement and parent information.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd873121d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> No Federal control</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in this section shall be construed to authorize an officer or employee of the Federal Government to—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd873121e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iv/I\"><num value=\"I\">(I)</num><content> mandate, direct, control, or place conditions (outside of what is required by this subchapter) around adopting a State’s early learning and developmental guidelines developed in accordance with this section;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd873121f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iv/II\"><num value=\"II\">(II)</num><content> establish any criterion that specifies, defines, prescribes, or places conditions (outside of what is required by this subchapter) on a State adopting standards or measures that a State uses to establish, implement, or improve such guidelines, related accountability systems, or alignment of such guidelines with education standards; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731220-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/T/iv/III\"><num value=\"III\">(III)</num><content> require a State to submit such guidelines for review.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8731221-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U\"><num value=\"U\" class=\"bold\">(U)</num><heading class=\"bold\"> Disaster preparedness</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731222-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The plan shall demonstrate the manner in which the State will address the needs of children in child care services provided through programs authorized under this subchapter, including the need for safe child care, for the period before, during, and after a state of emergency declared by the Governor or a major disaster or emergency (as such terms are defined in <ref href=\"/us/usc/t42/s5122\">section 5122 of this title</ref>).</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731223-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Statewide child care disaster plan</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Such plan shall include a statewide child care disaster plan for coordination of activities and collaboration, in the event of an emergency or disaster described in clause (i), among the State agency with jurisdiction over human services, the agency with jurisdiction over State emergency planning, the State lead agency, the State agency with jurisdiction over licensing of child care providers, the local resource and referral organizations, the State resource and referral system, and the State Advisory Council on Early Childhood Education and Care as provided for under section 642B(b) of the Head Start Act (<ref href=\"/us/usc/t42/s9837b/b\">42 U.S.C. 9837b(b)</ref>).</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731224-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Disaster plan components</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The components of the disaster plan, for such an emergency or disaster, shall include—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731225-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U/iii/I\"><num value=\"I\">(I)</num><content> evacuation, relocation, shelter-in-place, and lock-down procedures, and procedures for communication and reunification with families, continuity of operations, and accommodation of infants and toddlers, children with disabilities, and children with chronic medical conditions;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731226-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U/iii/II\"><num value=\"II\">(II)</num><content> guidelines for the continuation of child care services in the period following the emergency or disaster, which may include the provision of emergency and temporary child care services, and temporary operating standards for child care providers during that period; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8731227-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/U/iii/III\"><num value=\"III\">(III)</num><content> procedures for staff and volunteer emergency preparedness training and practice drills.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8731228-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/2/V\"><num value=\"V\" class=\"bold\">(V)</num><heading class=\"bold\"> Business technical assistance</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The plan shall describe how the State will develop and implement strategies to strengthen the business practices of child care providers to expand the supply, and improve the quality of, child care services.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8731229-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Use of block grant funds</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd873122a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> General requirement</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The State plan shall provide that the State will use the amounts provided to the State for each fiscal year under this subchapter in accordance with subparagraphs (B) through (D).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd873122b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Child care services and related activities</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd873122c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The State shall use amounts provided to the State for each fiscal year under this subchapter for child care services on a sliding fee scale basis, activities that improve the quality or availability of such services, activities that improve access to child care services, including the use of procedures to permit enrollment (after an initial eligibility determination) of homeless children while required documentation is obtained, training and technical assistance on identifying and serving homeless children and their families, and specific outreach to homeless families, and any other activity that the State determines to be appropriate to meet the purposes of this subchapter (which may include an activity described in clause (ii)), with priority being given for services provided to children of families with very low family incomes (taking into consideration family size) and to children with special needs.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd873122d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Report by the Assistant Secretary for Children and Families</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd873122e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Not later than September 30 of the first full fiscal year after <date date=\"2014-11-19\">November 19, 2014</date>, and September 30 of each fiscal year thereafter, the Secretary (acting through the Assistant Secretary for Children and Families of the Department of Health and Human Services) shall prepare a report that contains a determination about whether each State uses amounts provided to such State for the fiscal year involved under this subchapter in accordance with the priority for services described in clause (i).</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd873122f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Penalty for noncompliance</heading><chapeau style=\"-uslm-lc:I16\" class=\"indent4\">For any fiscal year that the report of the Secretary described in subclause (I) indicates that a State has failed to give priority for services in accordance with clause (i), the Secretary shall—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd8731230-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii/II/aa\"><num value=\"aa\">(aa)</num><content> inform the State that the State has until the date that is 6 months after the Secretary has issued such report to fully comply with clause (i);</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd8731231-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii/II/bb\"><num value=\"bb\">(bb)</num><content> provide the State an opportunity to modify the State plan of such State, to make the plan consistent with the requirements of clause (i), and resubmit such State plan to the Secretary not later than the date described in item (aa); and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd8731232-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii/II/cc\"><num value=\"cc\">(cc)</num><content> if the State does not fully comply with clause (i) and item (bb), by the date described in item (aa), withhold 5 percent of the funds that would otherwise be allocated to that State in accordance with this subchapter for the first full fiscal year after that date.</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd8731233-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/ii/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Waiver for extraordinary circumstances</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Notwithstanding subclause (II) the Secretary may grant a waiver to a State for one year to the penalty applied in subclause (II) if the Secretary determines there are extraordinary circumstances, such as a natural disaster, that prevent the State from complying with clause (i). If the Secretary does grant a waiver to a State under this section, the Secretary shall, within 30 days of granting such waiver, submit a report to the appropriate congressional committees on the circumstances of the waiver including the stated reason from the State on the need for a waiver, the expected impact of the waiver on children served under this program, and any such other relevant information the Secretary deems necessary.</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd8731234-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Child care resource and referral system</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd8731235-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">A State may use amounts described in clause (i) to establish or support a system of local or regional child care resource and referral organizations that is coordinated, to the extent determined appropriate by the State, by a statewide public or private nonprofit, community-based or regionally based, lead child care resource and referral organization.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"idd8731236-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Local or regional organizations</heading><chapeau style=\"-uslm-lc:I16\" class=\"indent4\">The local or regional child care resource and referral organizations supported as described in subclause (I) shall—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd8731237-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II/aa\"><num value=\"aa\">(aa)</num><content> provide parents in the State with consumer education information referred to in paragraph (2)(E) (except as otherwise provided in that paragraph), concerning the full range of child care options (including faith-based and community-based child care providers), analyzed by provider, including child care provided during nontraditional hours and through emergency child care centers, in their political subdivisions or regions;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd8731238-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II/bb\"><num value=\"bb\">(bb)</num><content> to the extent practicable, work directly with families who receive assistance under this subchapter to offer the families support and assistance, using information described in item (aa), to make an informed decision about which child care providers they will use, in an effort to ensure that the families are enrolling their children in the most appropriate child care setting to suit their needs and one that is of high quality (as determined by the State);</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd8731239-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II/cc\"><num value=\"cc\">(cc)</num><content> collect data and provide information on the coordination of services and supports, including services under section 619 and part C of the Individuals with Disabilities Education Act [<ref href=\"/us/usc/t20/s1419\">20 U.S.C. 1419</ref>, 1431 et seq.], for children with disabilities (as defined in section 602 of such Act (<ref href=\"/us/usc/t20/s1401\">20 U.S.C. 1401</ref>));</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd873123a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II/dd\"><num value=\"dd\">(dd)</num><content> collect data and provide information on the supply of and demand for child care services in political subdivisions or regions within the State and submit such information to the State;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd873123b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II/ee\"><num value=\"ee\">(ee)</num><content> work to establish partnerships with public agencies and private entities, including faith-based and community-based child care providers, to increase the supply and quality of child care services in the State; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"idd873123c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/B/iii/II/ff\"><num value=\"ff\">(ff)</num><content> as appropriate, coordinate their activities with the activities of the State lead agency and local agencies that administer funds made available in accordance with this subchapter.</content>\n</item>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd873123d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Limitation on administrative costs</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Not more than 5 percent of the aggregate amount of funds available to the State to carry out this subchapter by a State in each fiscal year may be expended for administrative costs incurred by such State to carry out all of its functions and duties under this subchapter. As used in the preceding sentence, the term “administrative costs” shall not include the costs of providing direct services.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd875823e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Assistance for certain families</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A State shall ensure that a substantial portion of the amounts available (after the State has complied with the requirement of section 418(b)(2) of the Social Security Act [<ref href=\"/us/usc/t42/s618/b/2\">42 U.S.C. 618(b)(2)</ref>] with respect to each of the fiscal years 2015 through 2020 <ref class=\"footnoteRef\" idref=\"fn003829\">8</ref><note type=\"footnote\" id=\"fn003829\"><num>8</num> So in original. A closing parenthesis probably should appear.</note> to the State to carry out activities under this subchapter in each fiscal year is used to provide assistance to low-income working families including or in addition to families with children described in clause (i), (ii), (iii), or (iv) of paragraph (2)(M).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd875823f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Direct services</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">From amounts provided to a State for a fiscal year to carry out this subchapter, the State shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8758240-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/E/i\"><num value=\"i\">(i)</num><content> reserve the minimum amount required to be reserved under <ref href=\"/us/usc/t42/s9858e\">section 9858e of this title</ref>, and the funds for costs described in subparagraph (C); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8758241-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/3/E/ii\"><num value=\"ii\">(ii)</num><content> from the remainder, use not less than 70 percent to fund direct services (provided by the State) in accordance with paragraph (2)(A).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8758242-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Payment rates</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8758243-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The State plan shall certify that payment rates for the provision of child care services for which assistance is provided in accordance with this subchapter are sufficient to ensure equal access for eligible children to child care services that are comparable to child care services in the State or substate area involved that are provided to children whose parents are not eligible to receive assistance under this subchapter or to receive child care assistance under any other Federal or State program, and shall provide a summary of the facts relied on by the State to determine that such rates are sufficient to ensure such access.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd8758244-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Survey</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The State plan shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8758245-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/i\"><num value=\"i\">(i)</num><content> demonstrate that the State has, after consulting with the State Advisory Council on Early Childhood Education and Care designated or established in section 642B(b)(1)(A)(i) of the Head Start Act (<ref href=\"/us/usc/t42/s9837b/b/1/A/i\">42 U.S.C. 9837b(b)(1)(A)(i)</ref>), local child care program administrators, local child care resource and referral agencies, and other appropriate entities, developed and conducted (not earlier than 2 years before the date of the submission of the application containing the State plan) a statistically valid and reliable survey of the market rates for child care services in the State (that reflects variations in the cost of child care services by geographic area, type of provider, and age of child) or an alternative methodology, such as a cost estimation model, that has been developed by the State lead agency;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8758246-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/ii\"><num value=\"ii\">(ii)</num><content> demonstrate that the State prepared a detailed report containing the results of the State market rates survey or alternative methodology conducted pursuant to clause (i), and made the results of the survey or alternative methodology widely available (not later than 30 days after the completion of such survey or alternative methodology) through periodic means, including posting the results on the Internet;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd8758247-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/iii\"><num value=\"iii\">(iii)</num><chapeau> describe how the State will set payment rates for child care services, for which assistance is provided in accordance with this subchapter—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8758248-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/iii/I\"><num value=\"I\">(I)</num><content> in accordance with the results of the market rates survey or alternative methodology conducted pursuant to clause (i);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8758249-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/iii/II\"><num value=\"II\">(II)</num><content> taking into consideration the cost of providing higher quality child care services than were provided under this subchapter before <date date=\"2014-11-19\">November 19, 2014</date>; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd875824a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/iii/III\"><num value=\"III\">(III)</num><content> without, to the extent practicable, reducing the number of families in the State receiving such assistance to carry out this subchapter, relative to the number of such families on <date date=\"2014-11-19\">November 19, 2014</date>; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idd875824b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/B/iv\"><num value=\"iv\">(iv)</num><content> describe how the State will provide for timely payment for child care services provided under this subchapter.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idd875824c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Construction</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd875824d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> No private right of action</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in this paragraph shall be construed to create a private right of action if the State acted in accordance with this paragraph.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"idd875824e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> No prohibition of certain different rates</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Nothing in this subchapter shall be construed to prevent a State from differentiating the payment rates described in subparagraph (B)(iii) on the basis of such factors as—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd875824f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C/ii/I\"><num value=\"I\">(I)</num><content> geographic location of child care providers (such as location in an urban or rural area);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8758250-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C/ii/II\"><num value=\"II\">(II)</num><content> the age or particular needs of children (such as the needs of children with disabilities and children served by child protective services);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8758251-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C/ii/III\"><num value=\"III\">(III)</num><content> whether the providers provide child care services during weekend and other nontraditional hours; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"idd8758252-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/4/C/ii/IV\"><num value=\"IV\">(IV)</num><content> the State’s determination that such differentiated payment rates may enable a parent to choose high-quality child care that best fits the parent’s needs.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd8758253-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Sliding fee scale</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The State plan shall provide that the State will establish and periodically revise, by rule, a sliding fee scale that provides for cost sharing (that is not a barrier to families receiving assistance under this subchapter) by the families that receive child care services for which assistance is provided under this subchapter.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd8758254-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s9858c/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Approval of application</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall approve an application that satisfies the requirements of this section.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idd8758255-406b-11eb-bd25-fd7436c081d8\">(<ref href=\"/us/pl/97/35/tVI/s658E\">Pub.
