<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8f198b81-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s9858h"><num value="9858h">§ 9858h.</num><heading> Payments</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8f198b82-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s9858h/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Subject to the availability of appropriations, a State that has an application approved by the Secretary under <ref href="/us/usc/t42/s9858c/d">section 9858c(d) of this title</ref> shall be entitled to a payment under this section for each fiscal year in an amount equal to its allotment under <ref href="/us/usc/t42/s9858m">section 9858m of this title</ref> for such fiscal year.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8f198b83-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s9858h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Method of payment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8f198b84-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s9858h/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), the Secretary may make payments to a State in installments, and in advance or by way of reimbursement, with necessary adjustments on account of overpayments or underpayments, as the Secretary may determine.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8f198b85-86fb-11e9-b915-8b3e54686b9f" identifier="/us/usc/t42/s9858h/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may not make such payments in a manner that prevents the State from complying with the requirement specified in <ref href="/us/usc/t42/s9858c/c/3">section 9858c(c)(3) of this title</ref>.</p>
