<chapeau style="-uslm-lc:I11" class="indent0">As used in this subchapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccad-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/1"><num value="1" class="bold">(1)</num><heading class="bold"> Caregiver</heading><content><p style="-uslm-lc:I12" class="indent1">The term “caregiver” means an individual who provides a service directly to an eligible child on a person-to-person basis.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccae-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/2"><num value="2" class="bold">(2)</num><heading class="bold"> Child care certificate</heading><content><p style="-uslm-lc:I12" class="indent1">The term “child care certificate” means a certificate (that may be a check or other disbursement) that is issued by a State or local government under this subchapter directly to a parent who may use such certificate only as payment for child care services or as a deposit for child care services if such a deposit is required of other children being cared for by the provider. Nothing in this subchapter shall preclude the use of such certificates for sectarian child care services if freely chosen by the parent. For purposes of this subchapter, child care certificates shall not be considered to be grants or contracts.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccaf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/3"><num value="3" class="bold">(3)</num><heading class="bold"> Child with a disability</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “child with a disability” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/3/A"><num value="A">(A)</num><content> a child with a disability, as defined in section 602 of the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1401">20 U.S.C. 1401</ref>);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/3/B"><num value="B">(B)</num><content> a child who is eligible for early intervention services under part C of the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1431">20 U.S.C. 1431</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/3/C"><num value="C">(C)</num><content> a child who is less than 13 years of age and who is eligible for services under <ref href="/us/usc/t29/s794">section 794 of title 29</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/3/D"><num value="D">(D)</num><content> a child with a disability, as defined by the State involved.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccb4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/4"><num value="4" class="bold">(4)</num><heading class="bold"> Eligible child</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “eligible child” means an individual—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/4/A"><num value="A">(A)</num><content> who is less than 13 years of age;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/4/B"><num value="B">(B)</num><content> whose family income does not exceed 85 percent of the State median income for a family of the same size, and whose family assets do not exceed $1,000,000 (as certified by a member of such family); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccb7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/4/C"><num value="C">(C)</num><chapeau> who—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd877ccb8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/4/C/i"><num value="i">(i)</num><content> resides with a parent or parents who are working or attending a job training or educational program; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd877ccb9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/4/C/ii"><num value="ii">(ii)</num><content> is receiving, or needs to receive, protective services and resides with a parent or parents not described in clause (i).</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccba-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/5"><num value="5" class="bold">(5)</num><heading class="bold"> English learner</heading><content><p style="-uslm-lc:I12" class="indent1">The term “English learner” means an individual who is an English learner, as defined in <ref href="/us/usc/t20/s7801">section 7801 of title 20</ref>, or who is limited English proficient, as defined in <ref href="/us/usc/t42/s9832">section 9832 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccbb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/6"><num value="6" class="bold">(6)</num><heading class="bold"> Eligible child care provider</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “eligible child care provider” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccbc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/6/A"><num value="A">(A)</num><chapeau> a center-based child care provider, a group home child care provider, a family child care provider, or other provider of child care services for compensation that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd877ccbd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/6/A/i"><num value="i">(i)</num><content> is licensed, regulated, or registered under State law as described in <ref href="/us/usc/t42/s9858c/c/2/F">section 9858c(c)(2)(F) of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd877ccbe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/6/A/ii"><num value="ii">(ii)</num><content> satisfies the State and local requirements, including those referred to in <ref href="/us/usc/t42/s9858c/c/2/I">section 9858c(c)(2)(I) of this title</ref>;</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">applicable to the child care services it provides; or</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd877ccbf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/6/B"><num value="B">(B)</num><content> a child care provider that is 18 years of age or older who provides child care services only to eligible children who are, by affinity or consanguinity, or by court decree, the grandchild, great grandchild, sibling (if such provider lives in a separate residence), niece, or nephew of such provider, if such provider complies with any applicable requirements that govern child care provided by the relative involved.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccc0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/7"><num value="7" class="bold">(7)</num><heading class="bold"> Family child care provider</heading><content><p style="-uslm-lc:I12" class="indent1">The term “family child care provider” means one individual who provides child care services for fewer than 24 hours per day, as the sole caregiver, and in a private residence.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccc1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/8"><num value="8" class="bold">(8)</num><heading class="bold"> Indian tribe</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Indian tribe” has the meaning given it in <ref href="/us/usc/t25/s5304/e">section 5304(e) of title 25</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccc4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/11"><num value="11" class="bold">(11)</num><heading class="bold"> Scientifically valid research</heading><content><p style="-uslm-lc:I12" class="indent1">The term “scientifically valid research” includes applied research, basic research, and field-initiated research, for which the rationale, design, and interpretation are soundly developed in accordance with principles of scientific research.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd877ccc5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s9858n/12"><num value="12" class="bold">(12)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Health and Human Services unless the context specifies otherwise.</p>
