<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0afc8798-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877"><num value="9877">§ 9877.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0afc8799-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/1"><num value="1">(1)</num><content> the term “community center” means facilities operated by nonprofit community-based organizations for the provision of recreational, social, or educational services to the general public;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc879a-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/2"><num value="2">(2)</num><chapeau> the term “dependent” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0afc879b-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/2/A"><num value="A">(A)</num><content> an individual who has not attained the age of 17 years;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0afc879c-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/2/B"><num value="B">(B)</num><content> an individual who has attained the age of 55 years; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0afc879d-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/2/C"><num value="C">(C)</num><content> an individual with a developmental disability;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc879e-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/3"><num value="3">(3)</num><content> the term “developmental disability” has the same meaning as in <ref href="/us/usc/t42/s15002">section 15002 of this title</ref>;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc879f-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/4"><num value="4">(4)</num><content> the term “equipment” has the same meaning given that term by section 198(a)(8) of the Elementary and Secondary Education Act of 1965; <ref class="footnoteRef" idref="fn003841">1</ref><note type="footnote" id="fn003841"><num>1</num> See References in Text note below.</note></content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a0-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/5"><num value="5">(5)</num><content> the term “institution of higher education” has the same meaning given that term under <ref href="/us/usc/t20/s1001">section 1001 of title 20</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a1-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/6"><num value="6">(6)</num><content> the term “local educational agency” has the same meaning given that term under <ref href="/us/usc/t20/s7801">section 7801 of title 20</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a2-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/7"><num value="7">(7)</num><content> the term “school-age children” means children aged five through thirteen, except that in any State in which by State law children at an earlier age are provided free public education, the age provided in State law shall be substituted for age five;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a3-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/8"><num value="8">(8)</num><content> the term “school facilities” means classrooms and related facilities used for the provision of education;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a4-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/9"><num value="9">(9)</num><content> the term “Secretary” means the Secretary of Health and Human Services;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a5-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/10"><num value="10">(10)</num><content> the term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, Palau, and the Commonwealth of the Northern Mariana Islands; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id0afc87a6-80bc-11ea-808b-a3be13bc391b" identifier="/us/usc/t42/s9877/11"><num value="11">(11)</num><content> the term “State educational agency” has the meaning given that term under section 7801 <sup>1</sup> of title 20.</content>
