<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idacd83593-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902"><num value="9902">§ 9902.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd83594-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/1"><num value="1" class="bold">(1)</num><heading class="bold"> Eligible entity; family literacy services</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacd83595-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Eligible entity</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “eligible entity” means an entity—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idacd83596-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/1/A/i"><num value="i">(i)</num><content> that is an eligible entity described in paragraph (1) (as in effect on the day before <date date="1998-10-27">October 27, 1998</date>) as of the day before <date date="1998-10-27">October 27, 1998</date>, or is designated by the process described in <ref href="/us/usc/t42/s9909">section 9909 of this title</ref> (including an organization serving migrant or seasonal farmworkers that is so described or designated); and</content>

<clause style="-uslm-lc:I14" class="indent3" id="idacd83597-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/1/A/ii"><num value="ii">(ii)</num><content> that has a tripartite board or other mechanism described in subsection (a) or (b), as appropriate, of <ref href="/us/usc/t42/s9910">section 9910 of this title</ref>.</content>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacd83598-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Family literacy services</heading><content><p style="-uslm-lc:I13" class="indent2">The term “family literacy services” has the meaning given the term in <ref href="/us/usc/t42/s9832">section 9832 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd83599-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/2"><num value="2" class="bold">(2)</num><heading class="bold"> Poverty line</heading><content><p style="-uslm-lc:I12" class="indent1">The term “poverty line” means the official poverty line defined by the Office of Management and Budget based on the most recent data available from the Bureau of the Census. The Secretary shall revise annually (or at any shorter interval the Secretary determines to be feasible and desirable) the poverty line, which shall be used as a criterion of eligibility in the community services block grant program established under this chapter. The required revision shall be accomplished by multiplying the official poverty line by the percentage change in the Consumer Price Index for All Urban Consumers during the annual or other interval immediately preceding the time at which the revision is made. Whenever a State determines that it serves the objectives of the block grant program established under this chapter, the State may revise the poverty line to not to exceed 125 percent of the official poverty line otherwise applicable under this paragraph.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd85caa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/3"><num value="3" class="bold">(3)</num><heading class="bold"> Private, nonprofit organization</heading><content><p style="-uslm-lc:I12" class="indent1">The term “private, nonprofit organization” includes a religious organization, to which the provisions of <ref href="/us/usc/t42/s9920">section 9920 of this title</ref> shall apply.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd85cab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/4"><num value="4" class="bold">(4)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Health and Human Services.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacd85cac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9902/5"><num value="5" class="bold">(5)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the United States Virgin Islands, American Samoa, and the Commonwealth of the Northern Mariana Islands.</p>
