<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idacdaf4fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920"><num value="9920">§ 9920.</num><heading> Operational rule</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdaf4fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/a"><num value="a" class="bold">(a)</num><heading class="bold"> Religious organizations included as nongovernmental providers</heading><content><p style="-uslm-lc:I11" class="indent0">For any program carried out by the Federal Government, or by a State or local government under this chapter, the government shall consider, on the same basis as other nongovernmental organizations, religious organizations to provide the assistance under the program, so long as the program is implemented in a manner consistent with the Establishment Clause of the first amendment to the Constitution. Neither the Federal Government nor a State or local government receiving funds under this chapter shall discriminate against an organization that provides assistance under, or applies to provide assistance under, this chapter, on the basis that the organization has a religious character.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdaf4fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/b"><num value="b" class="bold">(b)</num><heading class="bold"> Religious character and independence</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdaf4fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A religious organization that provides assistance under a program described in subsection (a) shall retain its religious character and control over the definition, development, practice, and expression of its religious beliefs.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdaf4fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Additional safeguards</heading><chapeau style="-uslm-lc:I12" class="indent1">Neither the Federal Government nor a State or local government shall require a religious organization—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idacdaf4ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/b/2/A"><num value="A">(A)</num><content> to alter its form of internal governance, except (for purposes of administration of the community services block grant program) as provided in <ref href="/us/usc/t42/s9910">section 9910 of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idacdb1c10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/b/2/B"><num value="B">(B)</num><content> to remove religious art, icons, scripture, or other symbols;</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">in order to be eligible to provide assistance under a program described in subsection (a).</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb1c11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Employment practices</heading><content><p style="-uslm-lc:I12" class="indent1">A religious organization’s exemption provided under <ref href="/us/usc/t42/s2000e–1">section 2000e–1 of this title</ref> regarding employment practices shall not be affected by its participation in, or receipt of funds from, programs described in subsection (a).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb1c12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limitations on use of funds for certain purposes</heading><content><p style="-uslm-lc:I11" class="indent0">No funds provided directly to a religious organization to provide assistance under any program described in subsection (a) shall be expended for sectarian worship, instruction, or proselytization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb1c13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/d"><num value="d" class="bold">(d)</num><heading class="bold"> Fiscal accountability</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb1c14-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), any religious organization providing assistance under any program described in subsection (a) shall be subject to the same regulations as other nongovernmental organizations to account in accord with generally accepted accounting principles for the use of such funds provided under such program.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb1c15-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limited audit</heading><content><p style="-uslm-lc:I12" class="indent1">Such organization shall segregate government funds provided under such program into a separate account. Only the government funds shall be subject to audit by the government.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb1c16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9920/e"><num value="e" class="bold">(e)</num><heading class="bold"> Treatment of eligible entities and other intermediate organizations</heading><content><p style="-uslm-lc:I11" class="indent0">If an eligible entity or other organization (referred to in this subsection as an “intermediate organization”), acting under a contract, or grant or other agreement, with the Federal Government or a State or local government, is given the authority under the contract or agreement to select nongovernmental organizations to provide assistance under the programs described in subsection (a), the intermediate organization shall have the same duties under this section as the government.</p>
