<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idacdb6a4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922"><num value="9922">§ 9922.</num><heading> Community food and nutrition programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb6a4f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may, through grants to public and private, nonprofit agencies, provide for community-based, local, statewide, and national programs—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idacdb6a50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/a/1"><num value="1">(1)</num><content> to coordinate private and public food assistance resources, wherever the grant recipient involved determines such coordination to be inadequate, to better serve low-income populations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacdb6a51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/a/2"><num value="2">(2)</num><content> to assist low-income communities to identify potential sponsors of child nutrition programs and to initiate such programs in underserved or unserved areas; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacdb6a52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/a/3"><num value="3">(3)</num><content> to develop innovative approaches at the State and local level to meet the nutrition needs of low-income individuals.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb6a53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b"><num value="b" class="bold">(b)</num><heading class="bold"> Allotments and distribution of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb6a54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Not to exceed $6,000,000 in appropriations</heading><chapeau style="-uslm-lc:I12" class="indent1">Of the amount appropriated for a fiscal year to carry out this section (but not to exceed $6,000,000), the Secretary shall distribute funds for grants under subsection (a) as follows:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb6a55-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Allotments</heading><content><p style="-uslm-lc:I13" class="indent2">From a portion equal to 60 percent of such amount (but not to exceed $3,600,000), the Secretary shall allot for grants to eligible agencies for statewide programs in each State the amount that bears the same ratio to such portion as the low-income and unemployed population of such State bears to the low-income and unemployed population of all the States.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb6a56-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Competitive grants</heading><content><p style="-uslm-lc:I13" class="indent2">From a portion equal to 40 percent of such amount (but not to exceed $2,400,000), the Secretary shall make grants on a competitive basis to eligible agencies for local and statewide programs.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb6a57-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Greater available appropriations</heading><chapeau style="-uslm-lc:I12" class="indent1">Any amounts appropriated for a fiscal year to carry out this section in excess of $6,000,000 shall be allotted as follows:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb6a58-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Allotments</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall use 40 percent of such excess to allot for grants under subsection (a) to eligible agencies for statewide programs in each State an amount that bears the same ratio to 40 percent of such excess as the low-income and unemployed population of such State bears to the low-income and unemployed population of all the States.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb6a59-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Competitive grants for local and statewide programs</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall use 40 percent of such excess to make grants under subsection (a) on a competitive basis to eligible agencies for local and statewide programs.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb6a5a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Competitive grants for nationwide programs</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall use the remaining 20 percent of such excess to make grants under subsection (a) on a competitive basis to eligible agencies for nationwide programs, including programs benefiting Indians, as defined in <ref href="/us/usc/t42/s9911">section 9911 of this title</ref>, and migrant or seasonal farmworkers.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb6a5b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Eligibility for allotments for statewide programs</heading><content><p style="-uslm-lc:I12" class="indent1">To be eligible to receive an allotment under paragraph (1)(A) or (2)(A), an eligible agency shall demonstrate that the proposed program is statewide in scope and represents a comprehensive and coordinated effort to alleviate hunger within the State.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb6a5c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Minimum allotments for statewide programs</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb6a5d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">From the amounts allotted under paragraphs (1)(A) and (2)(A), the minimum total allotment for each State for each fiscal year shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idacdb916e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/4/A/i"><num value="i">(i)</num><content> $15,000 if the total amount appropriated to carry out this section is not less than $7,000,000 but less than $10,000,000;</content>

<clause style="-uslm-lc:I14" class="indent3" id="idacdb916f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/4/A/ii"><num value="ii">(ii)</num><content> $20,000 if the total amount appropriated to carry out this section is not less than $10,000,000 but less than $15,000,000; or</content>

<clause style="-uslm-lc:I14" class="indent3" id="idacdb9170-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/4/A/iii"><num value="iii">(iii)</num><content> $30,000 if the total amount appropriated to carry out this section is not less than $15,000,000.</content>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idacdb9171-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “State” does not include Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idacdb9172-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Maximum grants</heading><content><p style="-uslm-lc:I12" class="indent1">From funds made available under paragraphs (1)(B) and (2)(B) for any fiscal year, the Secretary may not make grants under subsection (a) to an eligible agency in an aggregate amount exceeding $50,000. From funds made available under paragraph (2)(C) for any fiscal year, the Secretary may not make grants under subsection (a) to an eligible agency in an aggregate amount exceeding $300,000.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb9173-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/c"><num value="c" class="bold">(c)</num><heading class="bold"> Report</heading><chapeau style="-uslm-lc:I11" class="indent0">For each fiscal year, the Secretary shall prepare and submit, to the Committee on Education and the Workforce of the House of Representatives and the Committee on Labor and Human Resources of the Senate, a report concerning the grants made under this section. Such report shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idacdb9174-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/c/1"><num value="1">(1)</num><content> a list of grant recipients;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacdb9175-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/c/2"><num value="2">(2)</num><content> information on the amount of funding awarded to each grant recipient; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idacdb9176-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/c/3"><num value="3">(3)</num><content> a summary of the activities performed by the grant recipients with funding awarded under this section and a description of the manner in which such activities meet the objectives described in subsection (a).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idacdb9177-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s9922/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 1999 through 2003.</p>
