<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6186ea6-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455"><num value="1455">§ 1455.</num><heading> Wireless facilities deployment</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6186ea7-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a"><num value="a" class="bold">(a)</num><heading class="bold"> Facility modifications</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6186ea8-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding section 704 of the Telecommunications Act of 1996 (<ref href="/us/pl/104/104">Public Law 104–104</ref>) or any other provision of law, a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfa9-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Eligible facilities request</heading><chapeau>For purposes of this subsection, the term “eligible facilities request” means any request for modification of an existing wireless tower or base station that involves—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida61adfaa-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a/2/A"><num value="A">(A)</num><content> collocation of new transmission equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida61adfab-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a/2/B"><num value="B">(B)</num><content> removal of transmission equipment; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida61adfac-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a/2/C"><num value="C">(C)</num><content> replacement of transmission equipment.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfad-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Applicability of environmental laws</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in paragraph (1) shall be construed to relieve the Commission from the requirements of the National Historic Preservation Act or the National Environmental Policy Act of 1969.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida61adfae-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b"><num value="b" class="bold">(b)</num><heading class="bold"> Federal easements and rights-of-way</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfaf-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Grant</heading><content><p style="-uslm-lc:I12" class="indent1">If an executive agency, a State, a political subdivision or agency of a State, or a person, firm, or organization applies for the grant of an easement or right-of-way to, in, over, or on a building or other property owned by the Federal Government for the right to install, construct, and maintain wireless service antenna structures and equipment and backhaul transmission equipment, the executive agency having control of the building or other property may grant to the applicant, on behalf of the Federal Government, an easement or right-of-way to perform such installation, construction, and maintenance.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfb0-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator of General Services shall develop a common form for applications for easements and rights-of-way under paragraph (1) for all executive agencies that shall be used by applicants with respect to the buildings or other property of each such agency.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfb1-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Fee</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida61adfb2-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding any other provision of law, the Administrator of General Services shall establish a fee for the grant of an easement or right-of-way pursuant to paragraph (1) that is based on direct cost recovery.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida61adfb3-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exceptions</heading><chapeau>The Administrator of General Services may establish exceptions to the fee amount required under subparagraph (A)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida61adfb4-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/3/B/i"><num value="i">(i)</num><content> in consideration of the public benefit provided by a grant of an easement or right-of-way; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida61adfb5-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/3/B/ii"><num value="ii">(ii)</num><content> in the interest of expanding wireless and broadband coverage.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfb6-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Use of fees collected</heading><content><p style="-uslm-lc:I12" class="indent1">Any fee amounts collected by an executive agency pursuant to paragraph (3) may be made available, as provided in appropriations Acts, to such agency to cover the costs of granting the easement or right-of-way.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida61adfb7-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/c"><num value="c" class="bold">(c)</num><heading class="bold"> Master contracts for wireless facility sitings</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfb8-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>Notwithstanding section 704 of the Telecommunications Act of 1996 or any other provision of law, and not later than 60 days after <date date="2012-02-22">February 22, 2012</date>, the Administrator of General Services shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida61adfb9-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/c/1/A"><num value="A">(A)</num><content> develop 1 or more master contracts that shall govern the placement of wireless service antenna structures on buildings and other property owned by the Federal Government; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida61adfba-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/c/1/B"><num value="B">(B)</num><content> in developing the master contract or contracts, standardize the treatment of the placement of wireless service antenna structures on building rooftops or facades, the placement of wireless service antenna equipment on rooftops or inside buildings, the technology used in connection with wireless service antenna structures or equipment placed on Federal buildings and other property, and any other key issues the Administrator of General Services considers appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfbb-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I12" class="indent1">The master contract or contracts developed by the Administrator of General Services under paragraph (1) shall apply to all publicly accessible buildings and other property owned by the Federal Government, unless the Administrator of General Services decides that issues with respect to the siting of a wireless service antenna structure on a specific building or other property warrant nonstandard treatment of such building or other property.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida61adfbc-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator of General Services shall develop a common form or set of forms for wireless service antenna structure siting applications under this subsection for all executive agencies that shall be used by applicants with respect to the buildings and other property of each such agency.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida61adfbd-2e14-11e4-895c-ee86c5eccc60" identifier="/us/usc/t47/s1455/d"><num value="d" class="bold">(d)</num><heading class="bold"> Executive agency defined</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the term “executive agency” has the meaning given such term in <ref href="/us/usc/t40/s102">section 102 of title 40</ref>.</p>
