<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0eac416e-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262"><num value="262">§ 262.</num><heading> Ensuring the integrity of voice communications</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac416f-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/a"><num value="a" class="bold">(a)</num><heading class="bold"> Registration and compliance by intermediate providers</heading><chapeau style="-uslm-lc:I11" class="indent0">An intermediate provider that offers or holds itself out as offering the capability to transmit covered voice communications from one destination to another and that charges any rate to any other entity (including an affiliated entity) for the transmission shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0eac4170-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/a/1"><num value="1">(1)</num><content> register with the Commission; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0eac4171-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/a/2"><num value="2">(2)</num><content> comply with the service quality standards for such transmission to be established by the Commission under subsection (c)(1)(B).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac4172-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/b"><num value="b" class="bold">(b)</num><heading class="bold"> Required use of registered intermediate providers</heading><content><p style="-uslm-lc:I11" class="indent0">A covered provider may not use an intermediate provider to transmit covered voice communications unless such intermediate provider is registered under subsection (a)(1).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac4173-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c"><num value="c" class="bold">(c)</num><heading class="bold"> Commission rules</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0eac4174-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id0eac6885-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Registry</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 180 days after <date date="2018-02-26">February 26, 2018</date>, the Commission shall promulgate rules to establish a registry to record registrations under subsection (a)(1).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id0eac6886-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Service quality standards</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 1 year after <date date="2018-02-26">February 26, 2018</date>, the Commission shall promulgate rules to establish service quality standards for the transmission of covered voice communications by intermediate providers.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0eac6887-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">In promulgating the rules required by paragraph (1), the Commission shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0eac6888-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c/2/A"><num value="A">(A)</num><content> ensure the integrity of the transmission of covered voice communications to all customers in the United States; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0eac6889-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/c/2/B"><num value="B">(B)</num><content> prevent unjust or unreasonable discrimination among areas of the United States in the delivery of covered voice communications.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac688a-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/d"><num value="d" class="bold">(d)</num><heading class="bold"> Public availability of registry</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall make the registry established under subsection (c)(1)(A) publicly available on the website of the Commission.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac688b-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/e"><num value="e" class="bold">(e)</num><heading class="bold"> Scope of application</heading><content><p style="-uslm-lc:I11" class="indent0">The requirements of this section shall apply regardless of the format by which any communication or service is provided, the protocol or format by which the transmission of such communication or service is achieved, or the regulatory classification of such communication or service.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac8f9c-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/f"><num value="f" class="bold">(f)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to affect the regulatory classification of any communication or service.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac8f9d-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/g"><num value="g" class="bold">(g)</num><heading class="bold"> Effect on other laws</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to preempt or expand the authority of a State public utility commission or other relevant State agency to collect data, or investigate and enforce State law and regulations, regarding the completion of intrastate voice communications, regardless of the format by which any communication or service is provided, the protocol or format by which the transmission of such communication or service is achieved, or the regulatory classification of such communication or service.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eac8f9e-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/h"><num value="h" class="bold">(h)</num><heading class="bold"> Exception</heading><chapeau style="-uslm-lc:I11" class="indent0">The requirement under subsection (a)(2) to comply with the service quality standards established under subsection (c)(1)(B) shall not apply to a covered provider that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0eac8f9f-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/h/1"><num value="1">(1)</num><content> on or before the date that is 1 year after <date date="2018-02-26">February 26, 2018</date>, has certified as a Safe Harbor provider under section 64.2107(a) of title 47, Code of Federal Regulations, or any successor regulation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0eac8fa0-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/h/2"><num value="2">(2)</num><content> continues to meet the requirements under such section 64.2107(a).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0eacb6b1-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i"><num value="i" class="bold">(i)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0eacb6b2-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Covered provider</heading><content><p style="-uslm-lc:I12" class="indent1">The term “covered provider” has the meaning given the term in section 64.2101 of title 47, Code of Federal Regulations, or any successor thereto.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0eacb6b3-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Covered voice communication</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “covered voice communication” means a voice communication (including any related signaling information) that is generated—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0eacb6b4-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/2/A"><num value="A">(A)</num><content> from the placement of a call from a connection using a North American Numbering Plan resource or a call placed to a connection using such a numbering resource; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0eacb6b5-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/2/B"><num value="B">(B)</num><content> through any service provided by a covered provider.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0eacb6b6-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/3"><num value="3" class="bold">(3)</num><heading class="bold"> Intermediate provider</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “intermediate provider” means any entity that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0eacb6b7-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/3/A"><num value="A">(A)</num><chapeau> enters into a business arrangement with a covered provider or other intermediate provider for the specific purpose of carrying, routing, or transmitting voice traffic that is generated from the placement of a call placed—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id0eacb6b8-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/3/A/i"><num value="i">(i)</num><content> from an end user connection using a North American Numbering Plan resource; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0eacddc9-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/3/A/ii"><num value="ii">(ii)</num><content> to an end user connection using such a numbering resource; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0eacddca-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s262/i/3/B"><num value="B">(B)</num><content> does not itself, either directly or in conjunction with an affiliate, serve as a covered provider in the context of originating or terminating a given call.</content>
</subparagraph>
