<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0edaa40e-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337"><num value="337">§ 337.</num><heading> Allocation and assignment of new public safety services licenses and commercial licenses</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0edaa40f-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than <date date="1998-01-01">January 1, 1998</date>, the Commission shall allocate the electromagnetic spectrum between 746 megahertz and 806 megahertz, inclusive, as follows:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0edaa410-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/a/1"><num value="1">(1)</num><content> 34 megahertz of that spectrum for public safety services according to the terms and conditions established by the Commission, in consultation with the Secretary of Commerce and the Attorney General; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0edacb21-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/a/2"><num value="2">(2)</num><content> 26 megahertz of that spectrum for commercial use to be assigned by competitive bidding pursuant to <ref href="/us/usc/t47/s309/j">section 309(j) of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0edacb22-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/b"><num value="b" class="bold">(b)</num><heading class="bold"> Assignment</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission shall commence assignment of licenses for public safety services created pursuant to subsection (a) no later than <date date="1998-09-30">September 30, 1998</date>.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0edacb23-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c"><num value="c" class="bold">(c)</num><heading class="bold"> Licensing of unused frequencies for public safety services</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0edacb24-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Use of unused channels for public safety services</heading><chapeau style="-uslm-lc:I12" class="indent1">Upon application by an entity seeking to provide public safety services, the Commission shall waive any requirement of this chapter or its regulations implementing this chapter (other than its regulations regarding harmful interference) to the extent necessary to permit the use of unassigned frequencies for the provision of public safety services by such entity. An application shall be granted under this subsection if the Commission finds that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0edacb25-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/1/A"><num value="A">(A)</num><content> no other spectrum allocated to public safety services is immediately available to satisfy the requested public safety service use;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edacb26-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/1/B"><num value="B">(B)</num><content> the requested use is technically feasible without causing harmful interference to other spectrum users entitled to protection from such interference under the Commission’s regulations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edacb27-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/1/C"><num value="C">(C)</num><content> the use of the unassigned frequency for the provision of public safety services is consistent with other allocations for the provision of such services in the geographic area for which the application is made;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edacb28-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/1/D"><num value="D">(D)</num><content> the unassigned frequency was allocated for its present use not less than 2 years prior to the date on which the application is granted; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edacb29-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/1/E"><num value="E">(E)</num><content> granting such application is consistent with the public interest.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0edaf23a-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I12" class="indent1">Paragraph (1) shall apply to any application to provide public safety services that is pending or filed on or after <date date="1997-08-05">August 5, 1997</date>.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0edaf23b-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d"><num value="d" class="bold">(d)</num><heading class="bold"> Conditions on licenses</heading><chapeau style="-uslm-lc:I11" class="indent0">In establishing service rules with respect to licenses granted pursuant to this section, the Commission—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0edaf23c-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d/1"><num value="1">(1)</num><content> shall establish interference limits at the boundaries of the spectrum block and service area;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0edaf23d-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d/2"><num value="2">(2)</num><content> shall establish any additional technical restrictions necessary to protect full-service analog television service and digital television service during a transition to digital television service;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0edaf23e-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d/3"><num value="3">(3)</num><chapeau> may permit public safety services licensees and commercial licensees—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0edaf23f-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d/3/A"><num value="A">(A)</num><content> to aggregate multiple licenses to create larger spectrum blocks and service areas; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edaf240-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d/3/B"><num value="B">(B)</num><content> to disaggregate or partition licenses to create smaller spectrum blocks or service areas; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0edaf241-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/d/4"><num value="4">(4)</num><content> shall establish rules insuring that public safety services licensees using spectrum reallocated pursuant to subsection (a)(1) shall not be subject to harmful interference from television broadcast licensees.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0edaf242-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/e"><num value="e" class="bold">(e)</num><heading class="bold"> Removal and relocation of incumbent broadcast licensees</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0edaf243-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Channels 52 to 69</heading><content><p style="-uslm-lc:I12" class="indent1">Any full-power television station licensee that holds a television broadcast license to operate between 698 and 806 megahertz may not operate at that frequency after <date date="2009-06-12">June 12, 2009</date>.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0edaf244-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Incumbent qualifying low-power stations</heading><content><p style="-uslm-lc:I12" class="indent1">After making any allocation or assignment under this section, the Commission shall seek to assure, consistent with the Commission’s plan for allotments for digital television service, that each qualifying low-power television station is assigned a frequency below 698 megahertz to permit the continued operation of such station.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0edb1955-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f"><num value="f" class="bold">(f)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0edb1956-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Public safety services</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “public safety services” means services—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0edb1957-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/1/A"><num value="A">(A)</num><content> the sole or principal purpose of which is to protect the safety of life, health, or property;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edb1958-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/1/B"><num value="B">(B)</num><chapeau> that are provided—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id0edb1959-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/1/B/i"><num value="i">(i)</num><content> by State or local government entities; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id0edb195a-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/1/B/ii"><num value="ii">(ii)</num><content> by nongovernmental organizations that are authorized by a governmental entity whose primary mission is the provision of such services; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edb195b-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/1/C"><num value="C">(C)</num><content> that are not made commercially available to the public by the provider.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0edb195c-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Qualifying low-power television stations</heading><chapeau style="-uslm-lc:I12" class="indent1">A station is a qualifying low-power television station if, during the 90 days preceding <date date="1997-08-05">August 5, 1997</date>—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id0edb195d-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/2/A"><num value="A">(A)</num><content> such station broadcast a minimum of 18 hours per day;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edb195e-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/2/B"><num value="B">(B)</num><content> such station broadcast an average of at least 3 hours per week of programming that was produced within the market area served by such station; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id0edb195f-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s337/f/2/C"><num value="C">(C)</num><content> such station was in compliance with the requirements applicable to low-power television stations.</content>

<paragraph style="-uslm-lc:I21" class="indent0"><num value="6">“(6)</num><content> Notwithstanding section 309(d)(1) of the Communications Act of 1934 (<ref href="/us/usc/t47/s309/d/1">47 U.S.C. 309(d)(1)</ref>), the Federal Communications Commission may specify a period (which shall be not less than 5 days following issuance of the public notice described in paragraph (5)) for the filing of petitions to deny any application for an instrument of authorization for the frequencies described in paragraph (4).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Reports</inline>.—</heading><paragraph style="-uslm-lc:I21" class="indent0"><num value="1">(1)</num><chapeau> Not later than 30 days after the date of the enactment of this Act [<date date="1999-11-29">Nov. 29, 1999</date>], the Director of the Office of Management and Budget and the Federal Communications Commission shall each submit to the appropriate congressional committees a report which shall—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><chapeau> set forth the anticipated schedule (including specific dates) for—</chapeau><clause style="-uslm-lc:I23" class="indent2"><num value="i">“(i)</num><content> preparing and conducting the competitive bidding process required by subsection (a); and</content>
</clause>
<clause style="-uslm-lc:I23" class="indent2"><num value="ii">“(ii)</num><content> depositing the receipts of the competitive bidding process;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> set forth each significant milestone in the rulemaking process with respect to the competitive bidding process; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> include an explanation of the effect of each requirement in subsection (a) on the schedule for the competitive bidding process and any post-bidding activities (including the deposit of receipts) when compared with the schedule for the competitive bidding and any post-bidding activities (including the deposit of receipts) that would otherwise have occurred under section 337(b)(2) of the Communications Act of 1934 (<ref href="/us/usc/t47/s337/b/2">47 U.S.C. 337(b)(2)</ref>) if not for the enactment of subsection (a).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><chapeau> Not later than 60 days after the date of the enactment of this Act [<date date="1999-11-29">Nov. 29, 1999</date>], the Federal Communications Commission shall submit to the appropriate congressional committees a report which shall set forth for each spectrum auction held by the Commission since <date date="1998-01-01">January 1, 1998</date>, information on—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> the time required for each stage of preparation for the auction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> the date of the commencement and of the completion of the auction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> the time which elapsed between the date of the completion of the auction and the date of the first deposit of receipts from the auction in the Treasury; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> the amounts, summarized by month, of all subsequent deposits in a Treasury receipt account from the auction.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><chapeau> Not later than <date date="2000-10-31">October 31, 2000</date>, the Federal Communications Commission shall submit to the appropriate congressional committees a report which shall—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> describe the course of the competitive bidding process required by subsection (a) through <date date="2000-09-30">September 30, 2000</date>, including the amount of any receipts from the competitive bidding process deposited in the Treasury as of <date date="2000-09-30">September 30, 2000</date>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> if the course of the competitive bidding process has included any deviations from the schedule set forth under paragraph (1)(A), an explanation for such deviations from the schedule.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="4">“(4)</num><content> Each report required by this subsection shall be prepared by the agency concerned without influence of any other Federal department or agency.</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="5">“(5)</num><chapeau> In this subsection, the term “appropriate congressional committees” means the following:</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> The Committees on Appropriations, the Budget, and Commerce, Science, and Transportation of the Senate.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> The Committees on Appropriations, the Budget, and Commerce of the House of Representatives.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Construction</inline>.—</heading><content>Nothing in this section shall be construed to supersede the requirements placed on the Federal Communications Commission by section 337(d)(4) of the Communications Act of 1934 (<ref href="/us/usc/t47/s337/d/4">47 U.S.C. 337(d)(4)</ref>).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Repeal of Superseded Provisions</inline>.—</heading><content>Section 8124 of the Department of Defense Appropriations Act, 2000 [<ref href="/us/pl/106/79">Pub. L. 106–79</ref>, amending this section and enacting provisions formerly set out under this section] is repealed.”</content>
