<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id0f0fe4e7-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552"><num value="552">§ 552.</num><heading> Consumer protection and customer service</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0f0fe4e8-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/a"><num value="a" class="bold">(a)</num><heading class="bold"> Franchising authority enforcement</heading><chapeau style="-uslm-lc:I11" class="indent0">A franchising authority may establish and enforce—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0f0fe4e9-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/a/1"><num value="1">(1)</num><content> customer service requirements of the cable operator; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0f0fe4ea-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/a/2"><num value="2">(2)</num><content> construction schedules and other construction-related requirements, including construction-related performance requirements, of the cable operator.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0f0fe4eb-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/b"><num value="b" class="bold">(b)</num><heading class="bold"> Commission standards</heading><chapeau style="-uslm-lc:I11" class="indent0">The Commission shall, within 180 days of <date date="1992-10-05">October 5, 1992</date>, establish standards by which cable operators may fulfill their customer service requirements. Such standards shall include, at a minimum, requirements governing—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id0f0fe4ec-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/b/1"><num value="1">(1)</num><content> cable system office hours and telephone availability;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0f0fe4ed-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/b/2"><num value="2">(2)</num><content> installations, outages, and service calls; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id0f0fe4ee-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/b/3"><num value="3">(3)</num><content> communications between the cable operator and the subscriber (including standards governing bills and refunds).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0f0fe4ef-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/c"><num value="c" class="bold">(c)</num><heading class="bold"> Subscriber notice</heading><content><p style="-uslm-lc:I11" class="indent0">A cable operator may provide notice of service and rate changes to subscribers using any reasonable written means at its sole discretion. Notwithstanding <ref href="/us/usc/t47/s543/b/6">section 543(b)(6) of this title</ref> or any other provision of this chapter, a cable operator shall not be required to provide prior notice of any rate change that is the result of a regulatory fee, franchise fee, or any other fee, tax, assessment, or charge of any kind imposed by any Federal agency, State, or franchising authority on the transaction between the operator and the subscriber.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id0f100c00-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/d"><num value="d" class="bold">(d)</num><heading class="bold"> Consumer protection laws and customer service agreements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0f100c01-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Consumer protection laws</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subchapter shall be construed to prohibit any State or any franchising authority from enacting or enforcing any consumer protection law, to the extent not specifically preempted by this subchapter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id0f100c02-188c-11eb-9054-eff4ebea7f1f" identifier="/us/usc/t47/s552/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Customer service requirement agreements</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section shall be construed to preclude a franchising authority and a cable operator from agreeing to customer service requirements that exceed the standards established by the Commission under subsection (b). Nothing in this subchapter shall be construed to prevent the establishment or enforcement of any municipal law or regulation, or any State law, concerning customer service that imposes customer service requirements that exceed the standards set by the Commission under this section, or that addresses matters not addressed by the standards set by the Commission under this section.</p>
