</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e080df-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/b"><num value="b" class="bold">(b)</num><heading class="bold"> Accountability criteria</heading><chapeau>Within 18 months after <date date="1996-02-08">February 8, 1996</date>, the Commission shall prescribe such regulations as are necessary to implement this section. Such regulations shall ensure that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13e080e0-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/b/1"><num value="1">(1)</num><content> video programming first published or exhibited after the effective date of such regulations is fully accessible through the provision of closed captions, except as provided in subsection (d); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e080e1-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/b/2"><num value="2">(2)</num><content> video programming providers or owners maximize the accessibility of video programming first published or exhibited prior to the effective date of such regulations through the provision of closed captions, except as provided in subsection (d).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e080e2-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c"><num value="c" class="bold">(c)</num><heading class="bold"> Deadlines for captioning</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e080e3-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The regulations prescribed pursuant to subsection (b) shall include an appropriate schedule of deadlines for the provision of closed captioning of video programming once published or exhibited on television.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e080e4-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Deadlines for programming delivered using Internet protocol</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e080e5-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Regulations on closed captioning on video programming delivered using Internet protocol</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 6 months after the submission of the report to the Commission required by subsection (e)(1) <ref class="footnoteRef" idref="fn002035">1</ref><note type="footnote" id="fn002035"><num>1</num> See References in Text note below.</note> of the Twenty-First Century Communications and Video Accessibility Act of 2010, the Commission shall revise its regulations to require the provision of closed captioning on video programming delivered using Internet protocol that was published or exhibited on television with captions after the effective date of such regulations.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e080e6-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Schedule</heading><content><p style="-uslm-lc:I13" class="indent2">The regulations prescribed under this paragraph shall include an appropriate schedule of deadlines for the provision of closed captioning, taking into account whether such programming is prerecorded and edited for Internet distribution, or whether such programming is live or near-live and not edited for Internet distribution.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e080e7-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Cost</heading><content><p style="-uslm-lc:I13" class="indent2">The Commission may delay or waive the regulation promulgated under subparagraph (A) to the extent the Commission finds that the application of the regulation to live video programming delivered using Internet protocol with captions after the effective date of such regulations would be economically burdensome to providers of video programming or program owners.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e0a7f8-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Requirements for regulations</heading><chapeau>The regulations prescribed under this paragraph—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id13e0a7f9-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/i"><num value="i">(i)</num><content> shall contain a definition of “near-live programming” and “edited for Internet distribution”;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id13e0a7fa-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/ii"><num value="ii">(ii)</num><content> may exempt any service, class of service, program, class of program, equipment, or class of equipment for which the Commission has determined that the application of such regulations would be economically burdensome for the provider of such service, program, or equipment;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id13e0a7fb-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/iii"><num value="iii">(iii)</num><content> shall clarify that, for the purposes of implementation, of this subsection, the terms “video programming distributors” and “video programming providers” include an entity that makes available directly to the end user video programming through a distribution method that uses Internet protocol;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id13e0a7fc-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/iv"><num value="iv">(iv)</num><content> and describe the responsibilities of video programming providers or distributors and video programming owners;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id13e0a7fd-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/v"><num value="v">(v)</num><content> shall establish a mechanism to make available to video programming providers and distributors information on video programming subject to the Act on an ongoing basis;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id13e0a7fe-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/vi"><num value="vi">(vi)</num><content> shall consider that the video programming provider or distributor shall be deemed in compliance if such entity enables the rendering or pass through of closed captions and makes a good faith effort to identify video programming subject to the Act using the mechanism created in (v); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id13e0a7ff-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/2/D/vii"><num value="vii">(vii)</num><content> shall provide that de minimis failure to comply with such regulations by a video programming provider or owner shall not be treated as a violation of the regulations.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e0a800-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Alternate means of compliance</heading><content><p style="-uslm-lc:I12" class="indent1">An entity may meet the requirements of this section through alternate means than those prescribed by regulations pursuant to subsection (b), as revised pursuant to paragraph (2)(A) of this subsection, if the requirements of this section are met, as determined by the Commission.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e0a801-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/d"><num value="d" class="bold">(d)</num><heading class="bold"> Exemptions</heading><chapeau>Notwithstanding subsection (b)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13e0a802-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/d/1"><num value="1">(1)</num><content> the Commission may exempt by regulation programs, classes of programs, or services for which the Commission has determined that the provision of closed captioning would be economically burdensome to the provider or owner of such programming;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e0a803-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/d/2"><num value="2">(2)</num><content> a provider of video programming or the owner of any program carried by the provider shall not be obligated to supply closed captions if such action would be inconsistent with contracts in effect on <date date="1996-02-08">February 8, 1996</date>, except that nothing in this section shall be construed to relieve a video programming provider of its obligations to provide services required by Federal law; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e0cf14-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/d/3"><num value="3">(3)</num><content> a provider of video programming or program owner may petition the Commission for an exemption from the requirements of this section, and the Commission may grant such petition upon a showing that the requirements contained in this section would be economically burdensome. During the pendency of such a petition, such provider or owner shall be exempt from the requirements of this section. The Commission shall act to grant or deny any such petition, in whole or in part, within 6 months after the Commission receives such petition, unless the Commission finds that an extension of the 6-month period is necessary to determine whether such requirements are economically burdensome.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e0cf15-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/e"><num value="e" class="bold">(e)</num><heading class="bold"> Undue burden</heading><chapeau>The term “undue burden” means significant difficulty or expense. In determining whether the closed captions necessary to comply with the requirements of this paragraph would result in an undue economic burden, the factors to be considered include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13e0cf16-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/e/1"><num value="1">(1)</num><content> the nature and cost of the closed captions for the programming;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e0cf17-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/e/2"><num value="2">(2)</num><content> the impact on the operation of the provider or program owner;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e0cf18-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/e/3"><num value="3">(3)</num><content> the financial resources of the provider or program owner; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e0cf19-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/e/4"><num value="4">(4)</num><content> the type of operations of the provider or program owner.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e0cf1a-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f"><num value="f" class="bold">(f)</num><heading class="bold"> Video description</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e0cf1b-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Reinstatement of regulations</heading><content><p style="-uslm-lc:I12" class="indent1">On the day that is 1 year after <date date="2010-10-08">October 8, 2010</date>, the Commission shall, after a rulemaking, reinstate its video description regulations contained in the Implementation of Video Description of Video Programming Report and Order (15 F.C.C.R. 15,230 (2000)), recon. granted in part and denied in part, (16 F.C.C.R. 1251 (2001)), modified as provided in paragraph (2).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e0cf1c-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Modifications to reinstated regulations</heading><chapeau>Such regulations shall be modified only as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0cf1d-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/A"><num value="A">(A)</num><content> The regulations shall apply to video programming, as defined in subsection (h), insofar as such programming is transmitted for display on television in digital format.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0cf1e-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/B"><num value="B">(B)</num><content> The Commission shall update the list of the top 25 designated market areas, the list of the top 5 national nonbroadcast networks that have at least 50 hours per quarter of prime time programming that is not exempt under this paragraph, and the beginning calendar quarter for which compliance shall be calculated.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0cf1f-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/C"><num value="C">(C)</num><content> The regulations may permit a provider of video programming or a program owner to petition the Commission for an exemption from the requirements of this section upon a showing that the requirements contained in this section be economically burdensome.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0f630-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/D"><num value="D">(D)</num><content> The Commission may exempt from the regulations established pursuant to paragraph (1) a service, class of services, program, class of programs, equipment, or class of equipment for which the Commission has determined that the application of such regulations would be economically burdensome for the provider of such service, program, or equipment.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0f631-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/E"><num value="E">(E)</num><content> The regulations shall not apply to live or near-live programming.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0f632-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/F"><num value="F">(F)</num><content> The regulations shall provide for an appropriate phased schedule of deadlines for compliance.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id13e0f633-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/2/G"><num value="G">(G)</num><content> The Commission shall consider extending the exemptions and limitations in the reinstated regulations for technical capability reasons to all providers and owners of video programming.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e0f634-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Inquiries on further video description requirements</heading><chapeau>The Commission shall commence the following inquiries not later than 1 year after the completion of the phase-in of the reinstated regulations and shall report to Congress 1 year thereafter on the findings for each of the following:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e0f635-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Video description in television programming</heading><content><p style="-uslm-lc:I13" class="indent2">The availability, use, and benefits of video description on video programming distributed on television, the technical and creative issues associated with providing such video description, and the financial costs of providing such video description for providers of video programming and program owners.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e0f636-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Video description in video programming distributed on the Internet</heading><content><p style="-uslm-lc:I13" class="indent2">The technical and operational issues, costs, and benefits of providing video descriptions for video programming that is delivered using Internet protocol.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e0f637-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Continuing Commission authority</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e0f638-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Commission may not issue additional regulations unless the Commission determines, at least 2 years after completing the reports required in paragraph (3), that the need for and benefits of providing video description for video programming, insofar as such programming is transmitted for display on television, are greater than the technical and economic costs of providing such additional programming.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e0f639-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">If the Commission makes the determination under subparagraph (A) and issues additional regulations, the Commission may not increase, in total, the hour requirement for additional described programming by more than 75 percent of the requirement in the regulations reinstated under paragraph (1).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id13e0f63a-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Application to designated market areas</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id13e0f63b-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">After the Commission completes the reports on video description required in paragraph (3), the Commission shall phase in the video description regulations for the top 60 designated market areas, except that the Commission may grant waivers to entities in specific designated market areas where it deems appropriate.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id13e11d4c-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Phase-in deadline</heading><content><p style="-uslm-lc:I14" class="indent3">The phase-in described in clause (i) shall be completed not later than 6 years after <date date="2010-10-08">October 8, 2010</date>.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id13e11d4d-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Report</heading><chapeau>Nine years after <date date="2010-10-08">October 8, 2010</date>, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report assessing—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id13e11d4e-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/I"><num value="I">(I)</num><content> the types of described video programming that is available to consumers;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d4f-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/II"><num value="II">(II)</num><content> consumer use of such programming;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d50-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/III"><num value="III">(III)</num><content> the costs to program owners, providers, and distributors of creating such programming;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d51-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/IV"><num value="IV">(IV)</num><content> the potential costs to program owners, providers, and distributors in designated market areas outside of the top 60 of creating such programming;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d52-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/V"><num value="V">(V)</num><content> the benefits to consumers of such programming;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d53-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/VI"><num value="VI">(VI)</num><content> the amount of such programming currently available; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d54-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iii/VII"><num value="VII">(VII)</num><content> the need for additional described programming in designated market areas outside the top 60.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id13e11d55-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> Additional market areas</heading><chapeau>Ten years after <date date="2010-10-08">October 8, 2010</date>, the Commission shall have the authority, based upon the findings, conclusions, and recommendations contained in the report under clause (iii), to phase in the video description regulations for up to an additional 10 designated market areas each year—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id13e11d56-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iv/I"><num value="I">(I)</num><content> if the costs of implementing the video description regulations to program owners, providers, and distributors in those additional markets are reasonable, as determined by the Commission; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id13e11d57-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/f/4/C/iv/II"><num value="II">(II)</num><content> except that the Commission may grant waivers to entities in specific designated market areas where it deems appropriate.</content>
</subclause>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e11d58-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/g"><num value="g" class="bold">(g)</num><heading class="bold"> Emergency information</heading><chapeau>Not later than 1 year after the Advisory Committee report under subsection (e)(2) <sup>1</sup> is submitted to the Commission, the Commission shall complete a proceeding to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13e11d59-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/g/1"><num value="1">(1)</num><content> identify methods to convey emergency information (as that term is defined in section 79.2 of title 47, Code of Federal Regulations) in a manner accessible to individuals who are blind or visually impaired; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13e11d5a-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/g/2"><num value="2">(2)</num><content> promulgate regulations that require video programming providers and video programming distributors (as those terms are defined in section 79.1 of title 47, Code of Federal Regulations) and program owners to convey such emergency information in a manner accessible to individuals who are blind or visually impaired.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id13e1446b-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/h"><num value="h" class="bold">(h)</num><heading class="bold"> Definitions</heading><chapeau>For purposes of this section, <ref href="/us/usc/t47/s303">section 303 of this title</ref>, and <ref href="/us/usc/t47/s330">section 330 of this title</ref>:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id13e1446c-62c9-11ea-af78-ee2414800e65" identifier="/us/usc/t47/s613/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Video description</heading><content><p style="-uslm-lc:I12" class="indent1">The term “video description” means the insertion of audio narrated descriptions of a television program’s key visual elements into natural pauses between the program’s dialogue.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> Representatives of vendors, developers, and manufacturers of systems, facilities, equipment, and capabilities for the provision of video programming delivered using Internet protocol or a national organization representing such vendors, developers, or manufacturers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Representatives of manufacturers of consumer electronics or information technology equipment or a national organization representing such manufacturers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Representatives of video programming producers or a national organization representing such producers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> Representatives of national organizations representing accessibility advocates, including individuals with disabilities and the elderly.</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Commission Oversight</inline>.—</heading><content>The Chairman shall appoint a member of the Commission’s staff to moderate and direct the work of the Advisory Committee.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Technical Staff</inline>.—</heading><content>The Commission shall appoint a member of the Commission’s technical staff to provide technical assistance to the Advisory Committee.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Development of Recommendations.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Closed captioning report</inline>.—</heading><chapeau>Within 6 months after the date of the first meeting of the Advisory Committee, the Advisory Committee shall develop and submit to the Commission a report that includes the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> A recommended schedule of deadlines for the provision of closed captioning service.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> An identification of the performance objectives for protocols, technical capabilities, and technical procedures needed to permit content providers, content distributors, Internet service providers, software developers, and device manufacturers to reliably encode, transport, receive, and render closed captions of video programming, except for consumer generated media, delivered using Internet protocol.</content>
</subparagraph>

</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> With respect to user interfaces, a recommendation for the standards, protocols, and procedures used to enable the functions of apparatus designed to receive or display video programming transmitted simultaneously with sound (including apparatus designed to receive or display video programming transmitted by means of services using Internet protocol) to be accessible to and usable by individuals with disabilities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="G">“(G)</num><content> With respect to user interfaces, a recommendation for the standards, protocols, and procedures used to enable on-screen text menus and other visual indicators used to access the functions on an apparatus described in subparagraph (F) to be accompanied by audio output so that such menus or indicators are accessible to and usable by individuals with disabilities.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="H">“(H)</num><content> With respect to video programming guides and menus, a recommendation for the standards, protocols, and procedures used to enable video programming information and selection provided by means of a navigation device, guide, or menu to be accessible in real-time by individuals who are blind or visually impaired.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Consideration of work by standard-setting organizations</inline>.—</heading><content>The recommendations of the advisory committee shall, insofar as possible, incorporate the standards, protocols, and procedures that have been adopted by recognized industry standard-setting organizations for each of the purposes described in paragraphs (1) and (2).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Meetings.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Initial meeting</inline>.—</heading><content>The initial meeting of the Advisory Committee shall take place not later than 180 days after the date of the enactment of this Act [<date date="2010-10-08">Oct. 8, 2010</date>].</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Other meetings</inline>.—</heading><content>After the initial meeting, the Advisory Committee shall meet at the call of the Chairman.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Notice; open meetings</inline>.—</heading><content>Any meeting held by the Advisory Committee shall be noticed at least 14 days before such meeting and shall be open to the public.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Procedural Rules.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Quorum</inline>.—</heading><content>The presence of one-third of the members of the Advisory Committee shall constitute a quorum for conducting the business of the Advisory Committee.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Subcommittees</inline>.—</heading><content>To assist the Advisory Committee in carrying out its functions, the Chairman may establish appropriate subcommittees composed of members of the Advisory Committee and other subject matter experts.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Additional procedural rules</inline>.—</heading><content>The Advisory Committee may adopt other procedural rules as needed.</content>
</paragraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="h">“(h)</num><heading> <inline class="small-caps">Federal Advisory Committee Act</inline>.—</heading><content>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee.”</content>
