<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id87f925b1-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102"><num value="102">§ 102.</num><heading> Department of Transportation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id87f925b2-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/a"><num value="a">(a)</num><content> The Department of Transportation is an executive department of the United States Government at the seat of Government.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id87f925b3-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/b"><num value="b">(b)</num><content> The head of the Department is the Secretary of Transportation. The Secretary is appointed by the President, by and with the advice and consent of the Senate.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id87f925b4-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/c"><num value="c">(c)</num><chapeau> The Department has a Deputy Secretary of Transportation appointed by the President, by and with the advice and consent of the Senate. The Deputy Secretary—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id87f925b5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/c/1"><num value="1">(1)</num><content> shall carry out duties and powers prescribed by the Secretary; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id87f925b6-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/c/2"><num value="2">(2)</num><content> acts for the Secretary when the Secretary is absent or unable to serve or when the office of Secretary is vacant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id87f925b7-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/d"><num value="d">(d)</num><content> The Department has an Under Secretary of Transportation for Policy appointed by the President, by and with the advice and consent of the Senate. The Under Secretary shall provide leadership in the development of policy for the Department, supervise the policy activities of Assistant Secretaries with primary responsibility for aviation, international, and other transportation policy development and carry out other powers and duties prescribed by the Secretary. The Under Secretary acts for the Secretary when the Secretary and the Deputy Secretary are absent or unable to serve, or when the offices of Secretary and Deputy Secretary are vacant.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id87f925b8-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e"><num value="e">(e)</num><heading> <inline class="small-caps">Assistant Secretaries; General Counsel.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id87f925b9-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">Appointment</inline>.—</heading><chapeau>The Department has 6 Assistant Secretaries and a General Counsel, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925ba-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e/1/A"><num value="A">(A)</num><content> an Assistant Secretary for Aviation and International Affairs, an Assistant Secretary for Governmental Affairs, an Assistant Secretary for Research and Technology, and an Assistant Secretary for Transportation Policy, who shall each be appointed by the President, with the advice and consent of the Senate;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925bb-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e/1/B"><num value="B">(B)</num><content> an Assistant Secretary for Budget and Programs who shall be appointed by the President;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925bc-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e/1/C"><num value="C">(C)</num><content> an Assistant Secretary for Administration, who shall be appointed by the Secretary, with the approval of the President; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925bd-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e/1/D"><num value="D">(D)</num><content> a General Counsel, who shall be appointed by the President, with the advice and consent of the Senate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id87f925be-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Duties and powers</inline>.—</heading><content>The officers set forth in paragraph (1) shall carry out duties and powers prescribed by the Secretary. An Assistant Secretary or the General Counsel, in the order prescribed by the Secretary, acts for the Secretary when the Secretary, Deputy Secretary, and Under Secretary of Transportation for Policy are absent or unable to serve, or when the offices of the Secretary, Deputy Secretary, and Under Secretary of Transportation for Policy are vacant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id87f925bf-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/f"><num value="f">(f)</num><heading> <inline class="small-caps">Deputy Assistant Secretary for Tribal Government Affairs.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id87f925c0-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>In accordance with Federal policies promoting Indian self determination, the Department of Transportation shall have, within the office of the Secretary, a Deputy Assistant Secretary for Tribal Government Affairs appointed by the President to plan, coordinate, and implement the Department of Transportation policy and programs serving Indian tribes and tribal organizations and to coordinate tribal transportation programs and activities in all offices and administrations of the Department and to be a participant in any negotiated rulemaking relating to, or having an impact on, projects, programs, or funding associated with the tribal transportation program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id87f925c1-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Reservation of trust obligations.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925c2-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/f/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Responsibility of secretary</inline>.—</heading><content>In carrying out this title, the Secretary shall be responsible to exercise the trust obligations of the United States to Indians and Indian tribes to ensure that the rights of a tribe or individual Indian are protected.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925c3-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/f/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Preservation of united states responsibility</inline>.—</heading><content>Nothing in this title shall absolve the United States from any responsibility to Indians and Indian tribes, including responsibilities derived from the trust relationship and any treaty, executive order, or agreement between the United States and an Indian tribe.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id87f925c4-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/g"><num value="g">(g)</num><heading> <inline class="small-caps">Office of Climate Change and Environment.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id87f925c5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><chapeau>There is established in the Department an Office of Climate Change and Environment to plan, coordinate, and implement—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925c6-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/g/1/A"><num value="A">(A)</num><content> department-wide research, strategies, and actions under the Department’s statutory authority to reduce transportation-related energy use and mitigate the effects of climate change; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id87f925c7-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/g/1/B"><num value="B">(B)</num><content> department-wide research strategies and actions to address the impacts of climate change on transportation systems and infrastructure.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id87f925c8-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Clearinghouse</inline>.—</heading><content>The Office shall establish a clearinghouse of solutions, including cost-effective congestion reduction approaches, to reduce air pollution and transportation-related energy use and mitigate the effects of climate change.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id87f925c9-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s102/h"><num value="h">(h)</num><content> The Department shall have a seal that shall be judicially recognized.</content>
