</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id79faf7a4-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/b"><num value="b">(b)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id79faf7a5-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/b/1"><num value="1">(1)</num><content> The head of the Administration is the Administrator who is appointed by the President, by and with the advice and consent of the Senate. The Administrator reports directly to the Secretary of Transportation.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id79faf7a6-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/b/2"><num value="2">(2)</num><content> The Administration has a Deputy Federal Highway Administrator who is appointed by the Secretary, with the approval of the President. The Deputy Administrator shall carry out duties and powers prescribed by the Administrator.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id79faf7a7-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/b/3"><num value="3">(3)</num><content> The Administration has an Assistant Federal Highway Administrator appointed in the competitive service by the Secretary, with the approval of the President. The Assistant Administrator is the chief engineer of the Administration. The Assistant Administrator shall carry out duties and powers prescribed by the Administrator.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id79faf7a8-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/c"><num value="c">(c)</num><chapeau> The Administrator shall carry out—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id79faf7a9-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/c/1"><num value="1">(1)</num><content> duties and powers vested in the Secretary by chapter 4 of title 23 for highway safety programs, research, and development related to highway design, construction and maintenance, traffic control devices, identification and surveillance of accident locations, and highway-related aspects of pedestrian safety; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id79faf7aa-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/c/2"><num value="2">(2)</num><content> additional duties and powers prescribed by the Secretary.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id79faf7ab-8774-11ed-996c-96d5b093875f" identifier="/us/usc/t49/s104/d"><num value="d">(d)</num><content> Notwithstanding the provisions of sections 101(d) and 144 of title 23, highway bridges determined to be unreasonable obstructions to navigation under the Truman-Hobbs Act may be funded from amounts set aside from the discretionary bridge program. The Secretary shall transfer these allocations and the responsibility for administration of these funds to the United States Coast Guard.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Preference</inline>.—</heading><content>In locating the technical resource centers, the Secretary shall give preference to cities that house, on the date of enactment of this Act [<date date="1998-06-09">June 9, 1998</date>], the Federal Highway Administration regional offices and are in locations that minimize the travel distance between the technical resource centers and the Federal Highway Administration division offices that will be served by the new technical resource centers.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Report to Congress</inline>.—</heading><content>The Secretary shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a detailed implementation plan to carry out this section not later than <date date="1998-09-30">September 30, 1998</date>, and thereafter provide periodic progress reports on carrying out this section to such Committees.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Implementation</inline>.—</heading><content>The Secretary shall begin implementation of the plan transmitted under subsection (c) not later than <date date="1998-12-31">December 31, 1998</date>.”</content>
