<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3438efc0-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112"><num value="112">§ 112.</num><heading> Office of the Assistant Secretary for Research and Technology of the Department of Transportation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3438efc1-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/a"><num value="a">(a)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>The Office of the Assistant Secretary for Research and Technology of the Department of Transportation shall be an administration in the Department of Transportation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3438efc2-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/b"><num value="b">(b)</num><heading> Administrator.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3438efc3-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Appointment</inline>.—</heading><content>The Administration shall be headed by an Administrator who shall be appointed by the President, by and with the advice and consent of the Senate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efc4-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Reporting</inline>.—</heading><content>The Administrator shall report directly to the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3438efc5-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/c"><num value="c">(c)</num><heading> <inline class="small-caps">Deputy Administrator</inline>.—</heading><content>The Administration shall have a Deputy Administrator who shall be appointed by the Secretary of Transportation. The Deputy Administrator shall carry out duties and powers prescribed by the Administrator.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3438efc6-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d"><num value="d">(d)</num><heading> <inline class="small-caps">Powers and Duties of the Administrator</inline>.—</heading><chapeau>The Administrator shall carry out—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3438efc7-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/1"><num value="1">(1)</num><chapeau> powers and duties prescribed by the Secretary for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efc8-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/1/A"><num value="A">(A)</num><content> coordination, facilitation, and review of the Department’s research and development programs and activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efc9-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/1/B"><num value="B">(B)</num><content> advancement, and research and development, of innovative technologies, including intelligent transportation systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efca-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/1/C"><num value="C">(C)</num><content> comprehensive transportation statistics research, analysis, and reporting;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efcb-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/1/D"><num value="D">(D)</num><content> education and training in transportation and transportation-related fields; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efcc-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/1/E"><num value="E">(E)</num><content> activities of the Volpe National Transportation Center; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efcd-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/d/2"><num value="2">(2)</num><content> other powers and duties prescribed by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3438efce-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/e"><num value="e">(e)</num><heading> <inline class="small-caps">Administrative Authorities</inline>.—</heading><chapeau>The Administrator may enter into grants and cooperative agreements with Federal agencies, State and local government agencies, other public entities, private organizations, and other persons—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3438efcf-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/e/1"><num value="1">(1)</num><content> to conduct research into transportation service and infrastructure assurance; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efd0-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/e/2"><num value="2">(2)</num><content> to carry out other research activities of the Administration.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3438efd1-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/f"><num value="f">(f)</num><heading> <inline class="small-caps">Program Evaluation and Oversight</inline>.—</heading><content>For each of fiscal years 2013 and 2014, the Administrator is authorized to expend not more than 1 ½ percent of the amounts authorized to be appropriated for necessary expenses for administration and operations of the Research and Innovative Technology Administration for the coordination, evaluation, and oversight of the programs administered by the Administration.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3438efd2-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g"><num value="g">(g)</num><heading> Collaborative Research and Development.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3438efd3-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>To encourage innovative solutions to multimodal transportation problems and stimulate the deployment of new technology, the Administrator may carry out, on a cost-shared basis, collaborative research and development with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efd4-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/1/A"><num value="A">(A)</num><content> non-Federal entities, including State and local governments, foreign governments, institutions of higher education, corporations, institutions, partnerships, sole proprietorships, and trade associations that are incorporated or established under the laws of any State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efd5-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/1/B"><num value="B">(B)</num><content> Federal laboratories; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efd6-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/1/C"><num value="C">(C)</num><content> other Federal agencies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efd7-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Cooperation, grants, contracts, and agreements</inline>.—</heading><content>Notwithstanding any other provision of law, the Administrator may directly initiate contracts, grants, cooperative research and development agreements (as defined in section 12 of the Stevenson-Wydler Technology Innovation Act of 1980 (<ref href="/us/usc/t15/s3710a">15 U.S.C. 3710a</ref>)), and other agreements to fund, and accept funds from, the Transportation Research Board of the National Research Council of the National Academy of Sciences, State departments of transportation, cities, counties, institutions of higher education, associations, and the agents of those entities to carry out joint transportation research and technology efforts.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efd8-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/3"><num value="3">(3)</num><heading> Federal share.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efd9-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to subparagraph (B), the Federal share of the cost of an activity carried out under paragraph (2) shall not exceed 50 percent.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efda-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Exception</inline>.—</heading><content>If the Secretary determines that the activity is of substantial public interest or benefit, the Secretary may approve a greater Federal share.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3438efdb-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/3/C"><num value="C">(C)</num><heading> <inline class="small-caps">Non-federal share</inline>.—</heading><content>All costs directly incurred by the non-Federal partners, including personnel, travel, facility, and hardware development costs, shall be credited toward the non-Federal share of the cost of an activity described in subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efdc-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/4"><num value="4">(4)</num><heading> <inline class="small-caps">Use of technology</inline>.—</heading><content>The research, development, or use of a technology under a contract, grant, cooperative research and development agreement, or other agreement entered into under this subsection, including the terms under which the technology may be licensed and the resulting royalties may be distributed, shall be subject to the Stevenson-Wydler Technology Innovation Act of 1980 (<ref href="/us/usc/t15/s3701">15 U.S.C. 3701</ref> et seq.).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3438efdd-aaf6-11e3-9a62-c14889029fe0" identifier="/us/usc/t49/s112/g/5"><num value="5">(5)</num><heading> <inline class="small-caps">Waiver of advertising requirements</inline>.—</heading><content><ref href="/us/usc/t41/s6101">Section 6101 of title 41</ref> shall not apply to a contract, grant, or other agreement entered into under this section.</content>
