<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id10c08a9e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114"><num value="114">§ 114.</num><heading> Transportation Security Administration</heading><subsection style="-uslm-lc:I11" class="indent0" id="id10c08a9f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>The Transportation Security Administration shall be an administration of the Department of Homeland Security.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c08aa0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b"><num value="b">(b)</num><heading> <inline class="small-caps">Leadership.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c08aa1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Head of transportation security administration.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c08aa2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">Appointment</inline>.—</heading><content>The head of the Administration shall be the Administrator of the Transportation Security Administration (referred to in this section as the “Administrator”). The Administrator shall be appointed by the President, by and with the advice and consent of the Senate.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c08aa3-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><chapeau>The Administrator must—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c08aa4-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/1/B/i"><num value="i">(i)</num><content> be a citizen of the United States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c08aa5-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/1/B/ii"><num value="ii">(ii)</num><content> have experience in a field directly related to transportation or security.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c08aa6-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/1/C"><num value="C">(C)</num><heading> <inline class="small-caps">Term</inline>.—</heading><content>Effective with respect to any individual appointment by the President, by and with the advice and consent of the Senate, after the date of enactment of the TSA Modernization Act, the term of office of an individual appointed as the Administrator shall be 5 years. The term of office of an individual serving as the Administrator on the date of enactment of the TSA Modernization Act shall be 5 years beginning on the date that the Administrator began serving.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c08aa7-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Deputy administrator.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c08aa8-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">Appointment</inline>.—</heading><content>There is established in the Transportation Security Administration a Deputy Administrator, who shall assist the Administrator in the management of the Transportation Security Administration. The Deputy Administrator shall be appointed by the President.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0b1b9-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Vacancy</inline>.—</heading><content>The Deputy Administrator shall be Acting Administrator during the absence or incapacity of the Administrator or during a vacancy in the office of Administrator.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0b1ba-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><chapeau>The Deputy Administrator must—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c0b1bb-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/2/C/i"><num value="i">(i)</num><content> be a citizen of the United States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c0b1bc-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/2/C/ii"><num value="ii">(ii)</num><content> have experience in a field directly related to transportation or security.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0b1bd-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Chief counsel.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0b1be-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">Appointment</inline>.—</heading><content>There is established in the Transportation Security Administration a Chief Counsel, who shall advise the Administrator and other senior officials on all legal matters relating to the responsibilities, functions, and management of the Transportation Security Administration.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0b1bf-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/b/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><content>The Chief Counsel must be a citizen of the United States.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c0b1c0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/c"><num value="c">(c)</num><heading> <inline class="small-caps">Limitation on Ownership of Stocks and Bonds</inline>.—</heading><content>The Administrator may not own stock in or bonds of a transportation or security enterprise or an enterprise that makes equipment that could be used for security purposes.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c0b1c1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/d"><num value="d">(d)</num><heading> <inline class="small-caps">Functions</inline>.—</heading><chapeau>The Administrator shall be responsible for security in all modes of transportation, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id10c0b1c2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/d/1"><num value="1">(1)</num><content> carrying out chapter 449, relating to civil aviation security, and related research and development activities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0b1c3-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/d/2"><num value="2">(2)</num><content> security responsibilities over other modes of transportation that are exercised by the Department of Transportation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c0b1c4-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/e"><num value="e">(e)</num><heading> <inline class="small-caps">Screening Operations</inline>.—</heading><chapeau>The Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id10c0b1c5-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/e/1"><num value="1">(1)</num><content> be responsible for day-to-day Federal security screening operations for passenger air transportation and intrastate air transportation under sections 44901 and 44935;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0b1c6-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/e/2"><num value="2">(2)</num><content> develop standards for the hiring and retention of security screening personnel;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0b1c7-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/e/3"><num value="3">(3)</num><content> train and test security screening personnel; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8d8-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/e/4"><num value="4">(4)</num><content> be responsible for hiring and training personnel to provide security screening at all airports in the United States where screening is required under section 44901, in consultation with the Secretary of Transportation and the heads of other appropriate Federal agencies and departments.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c0d8d9-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f"><num value="f">(f)</num><heading> <inline class="small-caps">Additional Duties and Powers</inline>.—</heading><chapeau>In addition to carrying out the functions specified in subsections (d) and (e), the Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8da-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/1"><num value="1">(1)</num><content> receive, assess, and distribute intelligence information related to transportation security;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8db-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/2"><num value="2">(2)</num><content> assess threats to transportation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8dc-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/3"><num value="3">(3)</num><content> develop policies, strategies, and plans for dealing with threats to transportation security;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8dd-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/4"><num value="4">(4)</num><content> make other plans related to transportation security, including coordinating countermeasures with appropriate departments, agencies, and instrumentalities of the United States Government;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8de-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/5"><num value="5">(5)</num><content> serve as the primary liaison for transportation security to the intelligence and law enforcement communities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8df-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/6"><num value="6">(6)</num><content> on a day-to-day basis, manage and provide operational guidance to the field security resources of the Administration, including Federal Security Managers as provided by section 44933;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/7"><num value="7">(7)</num><content> enforce security-related regulations and requirements;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/8"><num value="8">(8)</num><content> identify and undertake research and development activities necessary to enhance transportation security;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/9"><num value="9">(9)</num><content> inspect, maintain, and test security facilities, equipment, and systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e3-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/10"><num value="10">(10)</num><content> ensure the adequacy of security measures for the transportation of cargo;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e4-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/11"><num value="11">(11)</num><content> oversee the implementation, and ensure the adequacy, of security measures at airports and other transportation facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e5-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/12"><num value="12">(12)</num><content> require background checks for airport security screening personnel, individuals with access to secure areas of airports, and other transportation security personnel;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0d8e6-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/13"><num value="13">(13)</num><content> work in conjunction with the Administrator of the Federal Aviation Administration with respect to any actions or activities that may affect aviation safety or air carrier operations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0fff7-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/14"><num value="14">(14)</num><content> work with the International Civil Aviation Organization and appropriate aeronautic authorities of foreign governments under section 44907 to address security concerns on passenger flights by foreign air carriers in foreign air transportation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0fff8-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/15"><num value="15">(15)</num><content> establish and maintain a National Deployment Office as required under <ref href="/us/usc/t49/s44948">section 44948 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c0fff9-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/f/16"><num value="16">(16)</num><content> carry out such other duties, and exercise such other powers, relating to transportation security as the Administrator considers appropriate, to the extent authorized by law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c0fffa-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g"><num value="g">(g)</num><heading> <inline class="small-caps">National Emergency Responsibilities.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c0fffb-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Subject to the direction and control of the Secretary of Homeland Security, the Administrator, during a national emergency, shall have the following responsibilities:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0fffc-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/1/A"><num value="A">(A)</num><content> To coordinate domestic transportation, including aviation, rail, and other surface transportation, and maritime transportation (including port security).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0fffd-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/1/B"><num value="B">(B)</num><content> To coordinate and oversee the transportation-related responsibilities of other departments and agencies of the Federal Government other than the Department of Defense and the military departments.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0fffe-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/1/C"><num value="C">(C)</num><content> To coordinate and provide notice to other departments and agencies of the Federal Government, and appropriate agencies of State and local governments, including departments and agencies for transportation, law enforcement, and border control, about threats to transportation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c0ffff-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/1/D"><num value="D">(D)</num><content> To carry out such other duties, and exercise such other powers, relating to transportation during a national emergency as the Secretary of Homeland Security shall prescribe.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c10000-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Authority of other departments and agencies</inline>.—</heading><content>The authority of the Administrator under this subsection shall not supersede the authority of any other department or agency of the Federal Government under law with respect to transportation or transportation-related matters, whether or not during a national emergency.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c10001-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/g/3"><num value="3">(3)</num><heading> <inline class="small-caps">Circumstances</inline>.—</heading><content>The Secretary of Homeland Security shall prescribe the circumstances constituting a national emergency for purposes of this subsection.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c10002-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h"><num value="h">(h)</num><heading> <inline class="small-caps">Management of Security Information</inline>.—</heading><chapeau>In consultation with the Transportation Security Oversight Board, the Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id10c12713-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h/1"><num value="1">(1)</num><content> enter into memoranda of understanding with Federal agencies or other entities to share or otherwise cross-check as necessary data on individuals identified on Federal agency databases who may pose a risk to transportation or national security;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c12714-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h/2"><num value="2">(2)</num><content> establish procedures for notifying the Administrator of the Federal Aviation Administration, appropriate State and local law enforcement officials, and airport or airline security officers of the identity of individuals known to pose, or suspected of posing, a risk of air piracy or terrorism or a threat to airline or passenger safety;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c12715-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h/3"><num value="3">(3)</num><chapeau> in consultation with other appropriate Federal agencies and air carriers, establish policies and procedures requiring air carriers—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c12716-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h/3/A"><num value="A">(A)</num><content> to use information from government agencies to identify individuals on passenger lists who may be a threat to civil aviation or national security; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c12717-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h/3/B"><num value="B">(B)</num><content> if such an individual is identified, notify appropriate law enforcement agencies, prevent the individual from boarding an aircraft, or take other appropriate action with respect to that individual; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c12718-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/h/4"><num value="4">(4)</num><content> consider requiring passenger air carriers to share passenger lists with appropriate Federal agencies for the purpose of identifying individuals who may pose a threat to aviation safety or national security.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c12719-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/i"><num value="i">(i)</num><heading> <inline class="small-caps">View of NTSB</inline>.—</heading><content>In taking any action under this section that could affect safety, the Administrator shall give great weight to the timely views of the National Transportation Safety Board.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1271a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j"><num value="j">(j)</num><heading> <inline class="small-caps">Acquisitions.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c1271b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Administrator is authorized—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1271c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/1/A"><num value="A">(A)</num><content> to acquire (by purchase, lease, condemnation, or otherwise) such real property, or any interest therein, within and outside the continental United States, as the Administrator considers necessary;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1271d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/1/B"><num value="B">(B)</num><content> to acquire (by purchase, lease, condemnation, or otherwise) and to construct, repair, operate, and maintain such personal property (including office space and patents), or any interest therein, within and outside the continental United States, as the Administrator considers necessary;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1271e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/1/C"><num value="C">(C)</num><content> to lease to others such real and personal property and to provide by contract or otherwise for necessary facilities for the welfare of its employees and to acquire, maintain, and operate equipment for these facilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c14e2f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/1/D"><num value="D">(D)</num><content> to acquire services, including such personal services as the Secretary of Homeland Security determines necessary, and to acquire (by purchase, lease, condemnation, or otherwise) and to construct, repair, operate, and maintain research and testing sites and facilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c14e30-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/1/E"><num value="E">(E)</num><content> in cooperation with the Administrator of the Federal Aviation Administration, to utilize the research and development facilities of the Federal Aviation Administration.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c14e31-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/j/2"><num value="2">(2)</num><heading> <inline class="small-caps">Title</inline>.—</heading><content>Title to any property or interest therein acquired pursuant to this subsection shall be held by the Government of the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c14e32-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/k"><num value="k">(k)</num><heading> <inline class="small-caps">Transfers of Funds</inline>.—</heading><content>The Administrator is authorized to accept transfers of unobligated balances and unexpended balances of funds appropriated to other Federal agencies (as such term is defined in <ref href="/us/usc/t5/s551/1">section 551(1) of title 5</ref>) to carry out functions assigned by law to the Administrator.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c14e33-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l"><num value="l">(l)</num><heading> <inline class="small-caps">Regulations.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c14e34-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Administrator is authorized to issue, rescind, and revise such regulations as are necessary to carry out the functions of the Administration.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c14e35-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/2"><num value="2">(2)</num><heading> <inline class="small-caps">Emergency procedures.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c14e36-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Notwithstanding any other provision of law or executive order (including an executive order requiring a cost-benefit analysis), if the Administrator determines that a regulation or security directive must be issued immediately in order to protect transportation security, the Administrator shall issue the regulation or security directive without providing notice or an opportunity for comment and without prior approval of the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c14e37-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Review by transportation security oversight board</inline>.—</heading><content>Any regulation or security directive issued under this paragraph shall be subject to review by the Transportation Security Oversight Board established under section 115. Any regulation or security directive issued under this paragraph shall remain effective for a period not to exceed 90 days unless ratified or disapproved by the Board or rescinded by the Administrator.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c14e38-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/3"><num value="3">(3)</num><heading> <inline class="small-caps">Factors to consider</inline>.—</heading><content>In determining whether to issue, rescind, or revise a regulation under this section, the Administrator shall consider, as a factor in the final determination, whether the costs of the regulation are excessive in relation to the enhancement of security the regulation will provide. The Administrator may waive requirements for an analysis that estimates the number of lives that will be saved by the regulation and the monetary value of such lives if the Administrator determines that it is not feasible to make such an estimate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c17549-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/4"><num value="4">(4)</num><heading> <inline class="small-caps">Airworthiness objections by faa.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1754a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Administrator shall not take an aviation security action under this title if the Administrator of the Federal Aviation Administration notifies the Administrator that the action could adversely affect the airworthiness of an aircraft.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1754b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/l/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Review by secretary</inline>.—</heading><content>Notwithstanding subparagraph (A), the Administrator may take such an action, after receiving a notification concerning the action from the Administrator of the Federal Aviation Administration under subparagraph (A), if the Secretary of Transportation subsequently approves the action.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1754c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/m"><num value="m">(m)</num><heading> <inline class="small-caps">Personnel and Services; Cooperation by Administrator.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c1754d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/m/1"><num value="1">(1)</num><heading> <inline class="small-caps">Authority of administrator</inline>.—</heading><content>In carrying out the functions of the Administration, the Administrator shall have the same authority as is provided to the Administrator of the Federal Aviation Administration under subsections (<i>l</i>) and (m) of section 106.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1754e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/m/2"><num value="2">(2)</num><heading> <inline class="small-caps">Authority of agency heads</inline>.—</heading><content>The head of a Federal agency shall have the same authority to provide services, supplies, equipment, personnel, and facilities to the Administrator as the head has to provide services, supplies, equipment, personnel, and facilities to the Administrator of the Federal Aviation Administration under section 106(m).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1754f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n"><num value="n">(n)</num><heading> <inline class="small-caps">Personnel Management System.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c17550-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The personnel management system established by the Administrator of the Federal Aviation Administration under section 40122 shall apply to employees of the Transportation Security Administration, or, subject to the requirements of such section, the Administrator may make such modifications to the personnel management system with respect to such employees as the Administrator considers appropriate, such as adopting aspects of other personnel systems of the Department of Homeland Security.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c17551-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2"><num value="2">(2)</num><heading> <inline class="small-caps">Meritorious executive or distinguished executive rank awards</inline>.—</heading><chapeau>Notwithstanding <ref href="/us/usc/t49/s40122/g/2">section 40122(g)(2) of this title</ref>, the applicable sections of title 5 shall apply to the Transportation Security Administration personnel management system, except that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c17552-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/A"><num value="A">(A)</num><chapeau> for purposes of applying such provisions to the personnel management system—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c17553-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/A/i"><num value="i">(i)</num><content> the term “agency” means the Department of Homeland Security;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c19c64-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/A/ii"><num value="ii">(ii)</num><content> the term “senior executive” means a Transportation Security Administration executive serving on a Transportation Security Executive Service appointment;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c19c65-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/A/iii"><num value="iii">(iii)</num><content> the term “career appointee” means a Transportation Security Administration executive serving on a career Transportation Security Executive Service appointment; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c19c66-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/A/iv"><num value="iv">(iv)</num><content> The <ref class="footnoteRef" idref="fn002003">1</ref><note type="footnote" id="fn002003"><num>1</num> So in original. Probably should not be capitalized.</note> term “senior career employee” means a Transportation Security Administration employee covered by the Transportation Security Administration Core Compensation System at the L or M pay band;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c19c67-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/B"><num value="B">(B)</num><content> receipt by a career appointee or a senior career employee of the rank of Meritorious Executive or Meritorious Senior Professional entitles the individual to a lump-sum payment of an amount equal to 20 percent of annual basic pay, which shall be in addition to the basic pay paid under the applicable Transportation Security Administration pay system; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c19c68-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/2/C"><num value="C">(C)</num><content> receipt by a career appointee or a senior career employee of the rank of Distinguished Executive or Distinguished Senior Professional entitles the individual to a lump-sum payment of an amount equal to 35 percent of annual basic pay, which shall be in addition to the basic pay paid under the applicable Transportation Security Administration pay system.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c19c69-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/3"><num value="3">(3)</num><heading> <inline class="small-caps">Definition of applicable sections of title 5</inline>.—</heading><chapeau>In this subsection, the term “applicable sections of title 5” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c19c6a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/3/A"><num value="A">(A)</num><content> subsections (b), (c) and (d) of <ref href="/us/usc/t5/s4507">section 4507 of title 5</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c19c6b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/n/3/B"><num value="B">(B)</num><content> subsections (b) and (c) of <ref href="/us/usc/t5/s4507a">section 4507a of title 5</ref>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c19c6c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/o"><num value="o">(o)</num><heading> <inline class="small-caps">Authority of Inspector General</inline>.—</heading><content>The Transportation Security Administration shall be subject to the Inspector General Act of 1978 (5 U.S.C. App.) and other laws relating to the authority of the Inspector General of the Department of Homeland Security.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1c37d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p"><num value="p">(p)</num><heading> <inline class="small-caps">Law Enforcement Powers.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c1c37e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Administrator may designate an employee of the Transportation Security Administration or other Federal agency to serve as a law enforcement officer.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1c37f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/2"><num value="2">(2)</num><heading> <inline class="small-caps">Powers</inline>.—</heading><chapeau>While engaged in official duties of the Administration as required to fulfill the responsibilities under this section, a law enforcement officer designated under paragraph (1) may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1c380-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/2/A"><num value="A">(A)</num><content> carry a firearm;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1c381-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/2/B"><num value="B">(B)</num><content> make an arrest without a warrant for any offense against the United States committed in the presence of the officer, or for any felony cognizable under the laws of the United States if the officer has probable cause to believe that the person to be arrested has committed or is committing the felony; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1c382-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/2/C"><num value="C">(C)</num><content> seek and execute warrants for arrest or seizure of evidence issued under the authority of the United States upon probable cause that a violation has been committed.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1c383-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/3"><num value="3">(3)</num><heading> <inline class="small-caps">Guidelines on exercise of authority</inline>.—</heading><content>The authority provided by this subsection shall be exercised in accordance with guidelines prescribed by the Administrator, in consultation with the Attorney General of the United States, and shall include adherence to the Attorney General’s policy on use of deadly force.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1c384-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/p/4"><num value="4">(4)</num><heading> <inline class="small-caps">Revocation or suspension of authority</inline>.—</heading><content>The powers authorized by this subsection may be rescinded or suspended should the Attorney General determine that the Administrator has not complied with the guidelines prescribed in paragraph (3) and conveys the determination in writing to the Secretary of Homeland Security and the Administrator.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1c385-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/q"><num value="q">(q)</num><heading> <inline class="small-caps">Authority To Exempt</inline>.—</heading><content>The Administrator may grant an exemption from a regulation prescribed in carrying out this section if the Administrator determines that the exemption is in the public interest.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1ea96-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r"><num value="r">(r)</num><heading> <inline class="small-caps">Nondisclosure of Security Activities.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c1ea97-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Notwithstanding <ref href="/us/usc/t5/s552">section 552 of title 5</ref>, the Administrator shall prescribe regulations prohibiting the disclosure of information obtained or developed in carrying out security under authority of the Aviation and Transportation Security Act (<ref href="/us/pl/107/71">Public Law 107–71</ref>) or under chapter 449 of this title if the Administrator decides that disclosing the information would—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1ea98-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/1/A"><num value="A">(A)</num><content> be an unwarranted invasion of personal privacy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1ea99-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/1/B"><num value="B">(B)</num><content> reveal a trade secret or privileged or confidential commercial or financial information; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1ea9a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/1/C"><num value="C">(C)</num><content> be detrimental to the security of transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1ea9b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/2"><num value="2">(2)</num><heading> <inline class="small-caps">Availability of information to congress</inline>.—</heading><content>Paragraph (1) does not authorize information to be withheld from a committee of Congress authorized to have the information.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1ea9c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/3"><num value="3">(3)</num><heading> <inline class="small-caps">Limitation on transferability of duties</inline>.—</heading><content>Except as otherwise provided by law, the Administrator may not transfer a duty or power under this subsection to another department, agency, or instrumentality of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c1ea9d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/4"><num value="4">(4)</num><heading> <inline class="small-caps">Limitations</inline>.—</heading><chapeau>Nothing in this subsection, or any other provision of law, shall be construed to authorize the designation of information as sensitive security information (as defined in section 1520.5 of title 49, Code of Federal Regulations)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1ea9e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/4/A"><num value="A">(A)</num><content> to conceal a violation of law, inefficiency, or administrative error;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1ea9f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/4/B"><num value="B">(B)</num><content> to prevent embarrassment to a person, organization, or agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1eaa0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/4/C"><num value="C">(C)</num><content> to restrain competition; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c1eaa1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/r/4/D"><num value="D">(D)</num><content> to prevent or delay the release of information that does not require protection in the interest of transportation security, including basic scientific research information not clearly related to transportation security.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c1eaa2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s"><num value="s">(s)</num><heading> <inline class="small-caps">Transportation Security Strategic Planning.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c1eaa3-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Secretary of Homeland Security shall develop, prepare, implement, and update, as needed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211b4-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/1/A"><num value="A">(A)</num><content> a National Strategy for Transportation Security; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211b5-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/1/B"><num value="B">(B)</num><content> transportation modal security plans addressing security risks, including threats, vulnerabilities, and consequences, for aviation, railroad, ferry, highway, maritime, pipeline, public transportation, over-the-road bus, and other transportation infrastructure assets.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c211b6-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/2"><num value="2">(2)</num><heading> <inline class="small-caps">Role of secretary of transportation</inline>.—</heading><content>The Secretary of Homeland Security shall work jointly with the Secretary of Transportation in developing, revising, and updating the documents required by paragraph (1).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c211b7-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3"><num value="3">(3)</num><heading> <inline class="small-caps">Contents of national strategy for transportation security</inline>.—</heading><chapeau>The National Strategy for Transportation Security shall include the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211b8-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/A"><num value="A">(A)</num><content> An identification and evaluation of the transportation assets in the United States that, in the interests of national security and commerce, must be protected from attack or disruption by terrorist or other hostile forces, including modal security plans for aviation, bridge and tunnel, commuter rail and ferry, highway, maritime, pipeline, rail, mass transit, over-the-road bus, and other public transportation infrastructure assets that could be at risk of such an attack or disruption.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211b9-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/B"><num value="B">(B)</num><content> The development of risk-based priorities, based on risk assessments conducted or received by the Secretary of Homeland Security (including assessments conducted under the Implementing Recommendations of the 9/11 Commission Act of 2007) across all transportation modes and realistic deadlines for addressing security needs associated with those assets referred to in subparagraph (A).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211ba-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/C"><num value="C">(C)</num><content> The most appropriate, practical, and cost-effective means of defending those assets against threats to their security.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211bb-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/D"><num value="D">(D)</num><content> A forward-looking strategic plan that sets forth the agreed upon roles and missions of Federal, State, regional, local, and tribal authorities and establishes mechanisms for encouraging cooperation and participation by private sector entities, including nonprofit employee labor organizations, in the implementation of such plan.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211bc-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/E"><num value="E">(E)</num><content> A comprehensive delineation of prevention, response, and recovery responsibilities and issues regarding threatened and executed acts of terrorism within the United States and threatened and executed acts of terrorism outside the United States to the extent such acts affect United States transportation systems.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c211bd-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/F"><num value="F">(F)</num><content> A prioritization of research and development objectives that support transportation security needs, giving a higher priority to research and development directed toward protecting vital transportation assets. Transportation security research and development projects shall be based, to the extent practicable, on such prioritization. Nothing in the preceding sentence shall be construed to require the termination of any research or development project initiated by the Secretary of Homeland Security or the Secretary of Transportation before the date of enactment of the Implementing Recommendations of the 9/11 Commission Act of 2007.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c238ce-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/G"><num value="G">(G)</num><content> A 3- and 10-year budget for Federal transportation security programs that will achieve the priorities of the National Strategy for Transportation Security.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c238cf-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/H"><num value="H">(H)</num><content> Methods for linking the individual transportation modal security plans and the programs contained therein, and a plan for addressing the security needs of intermodal transportation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c238d0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/3/I"><num value="I">(I)</num><content> Transportation modal security plans described in paragraph (1)(B), including operational recovery plans to expedite, to the maximum extent practicable, the return to operation of an adversely affected transportation system following a major terrorist attack on that system or other incident. These plans shall be coordinated with the resumption of trade protocols required under section 202 of the SAFE Port Act (<ref href="/us/usc/t6/s942">6 U.S.C. 942</ref>) and the National Maritime Transportation Security Plan required under <ref href="/us/usc/t46/s70103/a">section 70103(a) of title 46</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c238d1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4"><num value="4">(4)</num><heading> <inline class="small-caps">Submission of plans.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c238d2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretary of Homeland Security shall submit the National Strategy for Transportation Security, including the transportation modal security plans and any revisions to the National Strategy for Transportation Security and the transportation modal security plans, to appropriate congressional committees not less frequently than April 1 of each even-numbered year.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c238d3-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B"><num value="B">(B)</num><heading> <inline class="small-caps">Periodic progress report.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id10c238d4-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">Requirement for report</inline>.—</heading><content>Each year, in conjunction with the submission of the budget to Congress under <ref href="/us/usc/t31/s1105/a">section 1105(a) of title 31</ref>, United States Code, the Secretary of Homeland Security shall submit to the appropriate congressional committees an assessment of the progress made on implementing the National Strategy for Transportation Security, including the transportation modal security plans.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c238d5-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Content</inline>.—</heading><chapeau>Each progress report submitted under this subparagraph shall include, at a minimum, the following:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id10c238d6-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii/I"><num value="I">(I)</num><content> Recommendations for improving and implementing the National Strategy for Transportation Security and the transportation modal and intermodal security plans that the Secretary of Homeland Security, in consultation with the Secretary of Transportation, considers appropriate.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id10c25ee7-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii/II"><num value="II">(II)</num><content> An accounting of all grants for transportation security, including grants and contracts for research and development, awarded by the Secretary of Homeland Security in the most recent fiscal year and a description of how such grants accomplished the goals of the National Strategy for Transportation Security.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id10c25ee8-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii/III"><num value="III">(III)</num><chapeau> An accounting of all—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id10c25ee9-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii/III/aa"><num value="aa">(aa)</num><content> funds requested in the President’s budget submitted pursuant to <ref href="/us/usc/t31/s1105">section 1105 of title 31</ref> for the most recent fiscal year for transportation security, by mode;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id10c25eea-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii/III/bb"><num value="bb">(bb)</num><content> personnel working on transportation security by mode, including the number of contractors; and</content>

<item style="-uslm-lc:I580434" class="indent5" id="id10c25eeb-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/ii/III/cc"><num value="cc">(cc)</num><content> information on the turnover in the previous year among senior staff of the Department of Homeland Security, including component agencies, working on transportation security issues. Such information shall include the number of employees who have permanently left the office, agency, or area in which they worked, and the amount of time that they worked for the Department of Homeland Security.</content>
</item>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c25eec-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/B/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Written explanation of transportation security activities not delineated in the national strategy for transportation security</inline>.—</heading><content>At the end of each fiscal year, the Secretary of Homeland Security shall submit to the appropriate congressional committees a written explanation of any Federal transportation security activity that is inconsistent with the National Strategy for Transportation Security, including the amount of funds to be expended for the activity and the number of personnel involved.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c25eed-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/C"><num value="C">(C)</num><heading> <inline class="small-caps">Classified material</inline>.—</heading><content>Any part of the National Strategy for Transportation Security or the transportation modal security plans that involve information that is properly classified under criteria established by Executive order shall be submitted to the appropriate congressional committees separately in a classified format.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c25eee-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/4/D"><num value="D">(D)</num><heading> <inline class="small-caps">Appropriate congressional committees defined</inline>.—</heading><content>In this subsection, the term “appropriate congressional committees” means the Committee on Transportation and Infrastructure and the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation, the Committee on Homeland Security and Governmental Affairs, and the Committee on Banking, Housing, and Urban Affairs of the Senate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c25eef-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5"><num value="5">(5)</num><heading> <inline class="small-caps">Priority Status.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c28600-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The National Strategy for Transportation Security shall be the governing document for Federal transportation security efforts.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c28601-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/B"><num value="B">(B)</num><heading> <inline class="small-caps">Other plans and reports</inline>.—</heading><chapeau>The National Strategy for Transportation Security shall include, as an integral part or as an appendix—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c28602-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/B/i"><num value="i">(i)</num><content> the current National Maritime Transportation Security Plan under <ref href="/us/usc/t46/s70103">section 70103 of title 46</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c28603-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/B/ii"><num value="ii">(ii)</num><content> the report required by <ref href="/us/usc/t49/s44938">section 44938 of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c28604-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/B/iii"><num value="iii">(iii)</num><content> transportation modal security plans required under this section;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c28605-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/B/iv"><num value="iv">(iv)</num><content> the transportation sector specific plan required under Homeland Security Presidential Directive–7; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c28606-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/5/B/v"><num value="v">(v)</num><content> any other transportation security plan or report that the Secretary of Homeland Security determines appropriate for inclusion.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c28607-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/6"><num value="6">(6)</num><heading> <inline class="small-caps">Coordination</inline>.—</heading><content>In carrying out the responsibilities under this section, the Secretary of Homeland Security, in coordination with the Secretary of Transportation, shall consult, as appropriate, with Federal, State, and local agencies, tribal governments, private sector entities (including nonprofit employee labor organizations), institutions of higher learning, and other entities.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c28608-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/s/7"><num value="7">(7)</num><heading> <inline class="small-caps">Plan distribution</inline>.—</heading><content>The Secretary of Homeland Security shall make available and appropriately publicize an unclassified version of the National Strategy for Transportation Security, including its component transportation modal security plans, to Federal, State, regional, local and tribal authorities, transportation system owners or operators, private sector stakeholders, including nonprofit employee labor organizations representing transportation employees, institutions of higher learning, and other appropriate entities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c28609-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t"><num value="t">(t)</num><heading> <inline class="small-caps">Transportation Security Information Sharing Plan.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c2860a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/1"><num value="1">(1)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2860b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">Appropriate congressional committees</inline>.—</heading><content>The term “appropriate congressional committees” has the meaning given that term in subsection (s)(4)(E).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2860c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Plan</inline>.—</heading><content>The term “Plan” means the Transportation Security Information Sharing Plan established under paragraph (2).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2860d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/1/C"><num value="C">(C)</num><heading> <inline class="small-caps">Public and private stakeholders</inline>.—</heading><content>The term “public and private stakeholders” means Federal, State, and local agencies, tribal governments, and appropriate private entities, including nonprofit employee labor organizations representing transportation employees.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2ad1e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/1/D"><num value="D">(D)</num><heading> <inline class="small-caps">Transportation security information</inline>.—</heading><content>The term “transportation security information” means information relating to the risks to transportation modes, including aviation, public transportation, railroad, ferry, highway, maritime, pipeline, and over-the-road bus transportation, and may include specific and general intelligence products, as appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2ad1f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/2"><num value="2">(2)</num><heading> <inline class="small-caps">Establishment of plan</inline>.—</heading><content>The Secretary of Homeland Security, in consultation with the program manager of the information sharing environment established under section 1016 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<ref href="/us/usc/t6/s485">6 U.S.C. 485</ref>), the Secretary of Transportation, and public and private stakeholders, shall establish a Transportation Security Information Sharing Plan. In establishing the Plan, the Secretary of Homeland Security shall gather input on the development of the Plan from private and public stakeholders and the program manager of the information sharing environment established under section 1016 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<ref href="/us/usc/t6/s485">6 U.S.C. 485</ref>).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2ad20-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/3"><num value="3">(3)</num><heading> <inline class="small-caps">Purpose of plan</inline>.—</heading><content>The Plan shall promote sharing of transportation security information between the Department of Homeland Security and public and private stakeholders.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2ad21-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/4"><num value="4">(4)</num><heading> <inline class="small-caps">Content of plan</inline>.—</heading><chapeau>The Plan shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2ad22-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/4/A"><num value="A">(A)</num><content> a description of how intelligence analysts within the Department of Homeland Security will coordinate their activities within the Department and with other Federal, State, and local agencies, and tribal governments, including coordination with existing modal information sharing centers and the center described in section 1410 of the Implementing Recommendations of the 9/11 Commission Act of 2007;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2ad23-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/4/B"><num value="B">(B)</num><content> the establishment of a point of contact, which may be a single point of contact within the Department of Homeland Security, for each mode of transportation for the sharing of transportation security information with public and private stakeholders, including an explanation and justification to the appropriate congressional committees if the point of contact established pursuant to this subparagraph differs from the agency within the Department of Homeland Security that has the primary authority, or has been delegated such authority by the Secretary of Homeland Security, to regulate the security of that transportation mode;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2ad24-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/4/C"><num value="C">(C)</num><content> a reasonable deadline by which the Plan will be implemented; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2ad25-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/4/D"><num value="D">(D)</num><content> a description of resource needs for fulfilling the Plan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2ad26-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/5"><num value="5">(5)</num><heading> <inline class="small-caps">Coordination with information sharing</inline>.—</heading><chapeau>The Plan shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2ad27-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/5/A"><num value="A">(A)</num><content> implemented in coordination, as appropriate, with the program manager for the information sharing environment established under section 1016 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<ref href="/us/usc/t6/s485">6 U.S.C. 485</ref>); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2d438-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/5/B"><num value="B">(B)</num><content> consistent with the establishment of the information sharing environment and any policies, guidelines, procedures, instructions, or standards established by the President or the program manager for the implementation and management of the information sharing environment.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2d439-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/6"><num value="6">(6)</num><heading> <inline class="small-caps">Annual report on plan</inline>.—</heading><content>The Secretary of Homeland Security shall annually submit to the appropriate congressional committees a report containing the Plan.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2d43a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/7"><num value="7">(7)</num><heading> <inline class="small-caps">Security clearances</inline>.—</heading><content>The Secretary of Homeland Security shall, to the greatest extent practicable, take steps to expedite the security clearances needed for designated public and private stakeholders to receive and obtain access to classified information distributed under this section, as appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2d43b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/t/8"><num value="8">(8)</num><heading> <inline class="small-caps">Classification of material</inline>.—</heading><content>The Secretary of Homeland Security, to the greatest extent practicable, shall provide designated public and private stakeholders with transportation security information in an unclassified format.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c2d43c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u"><num value="u">(u)</num><heading> <inline class="small-caps">Enforcement of Regulations and Orders of the Secretary of Homeland Security.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c2d43d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1"><num value="1">(1)</num><heading> <inline class="small-caps">Application of subsection.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2d43e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>This subsection applies to the enforcement of regulations prescribed, and orders issued, by the Secretary of Homeland Security under a provision of chapter 701 of title 46 and under a provision of this title other than a provision of chapter 449 (in this subsection referred to as an “applicable provision of this title”).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2d43f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/B"><num value="B">(B)</num><heading> <inline class="small-caps">Violations of chapter 449</inline>.—</heading><content>The penalties for violations of regulations prescribed and orders issued by the Secretary of Homeland Security or the Administrator under chapter 449 of this title are provided under chapter 463 of this title.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2d440-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/C"><num value="C">(C)</num><heading> <inline class="small-caps">Nonapplication to certain violations.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id10c2d441-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/C/i"><num value="i">(i)</num><chapeau> Paragraphs (2) through (5) do not apply to violations of regulations prescribed, and orders issued, by the Secretary of Homeland Security under a provision of this title—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id10c2d442-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/C/i/I"><num value="I">(I)</num><content> involving the transportation of personnel or shipments of materials by contractors where the Department of Defense has assumed control and responsibility;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id10c2d443-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/C/i/II"><num value="II">(II)</num><content> by a member of the armed forces of the United States when performing official duties; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id10c2d444-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/C/i/III"><num value="III">(III)</num><content> by a civilian employee of the Department of Defense when performing official duties.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c2d445-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/1/C/ii"><num value="ii">(ii)</num><content> Violations described in subclause (I), (II), or (III) of clause (i) shall be subject to penalties as determined by the Secretary of Defense or the Secretary of Defense’s designee.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2fb56-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/2"><num value="2">(2)</num><heading> <inline class="small-caps">Civil penalty.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb57-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A person is liable to the United States Government for a civil penalty of not more than $10,000 for a violation of a regulation prescribed, or order issued, by the Secretary of Homeland Security under an applicable provision of this title.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb58-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Repeat violations</inline>.—</heading><content>A separate violation occurs under this paragraph for each day the violation continues.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c2fb59-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3"><num value="3">(3)</num><heading> <inline class="small-caps">Administrative imposition of civil penalties.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb5a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretary of Homeland Security may impose a civil penalty for a violation of a regulation prescribed, or order issued, under an applicable provision of this title. The Secretary shall give written notice of the finding of a violation and the penalty.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb5b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Scope of civil action</inline>.—</heading><content>In a civil action to collect a civil penalty imposed by the Secretary of Homeland Security under this subsection, a court may not re-examine issues of liability or the amount of the penalty.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb5c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/C"><num value="C">(C)</num><heading> <inline class="small-caps">Jurisdiction</inline>.—</heading><chapeau>The district courts of the United States shall have exclusive jurisdiction of civil actions to collect a civil penalty imposed by the Secretary of Homeland Security under this subsection if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c2fb5d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/C/i"><num value="i">(i)</num><chapeau> the amount in controversy is more than—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id10c2fb5e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/C/i/I"><num value="I">(I)</num><content> $400,000, if the violation was committed by a person other than an individual or small business concern; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id10c2fb5f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/C/i/II"><num value="II">(II)</num><content> $50,000 if the violation was committed by an individual or small business concern;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c2fb60-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/C/ii"><num value="ii">(ii)</num><content> the action is in rem or another action in rem based on the same violation has been brought; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c2fb61-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/C/iii"><num value="iii">(iii)</num><content> another action has been brought for an injunction based on the same violation.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb62-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/D"><num value="D">(D)</num><heading> <inline class="small-caps">Maximum penalty</inline>.—</heading><chapeau>The maximum civil penalty the Secretary of Homeland Security administratively may impose under this paragraph is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c2fb63-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/D/i"><num value="i">(i)</num><content> $400,000, if the violation was committed by a person other than an individual or small business concern; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c2fb64-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/D/ii"><num value="ii">(ii)</num><content> $50,000, if the violation was committed by an individual or small business concern.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c2fb65-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/E"><num value="E">(E)</num><heading> <inline class="small-caps">Notice and opportunity to request hearing</inline>.—</heading><chapeau>Before imposing a penalty under this section the Secretary of Homeland Security shall provide to the person against whom the penalty is to be imposed—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c32276-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/E/i"><num value="i">(i)</num><content> written notice of the proposed penalty; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c32277-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/3/E/ii"><num value="ii">(ii)</num><content> the opportunity to request a hearing on the proposed penalty, if the Secretary of Homeland Security receives the request not later than 30 days after the date on which the person receives notice.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c32278-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/4"><num value="4">(4)</num><heading> <inline class="small-caps">Compromise and setoff.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c32279-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/4/A"><num value="A">(A)</num><content> The Secretary of Homeland Security may compromise the amount of a civil penalty imposed under this subsection.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c3227a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/4/B"><num value="B">(B)</num><content> The Government may deduct the amount of a civil penalty imposed or compromised under this subsection from amounts it owes the person liable for the penalty.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c3227b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/5"><num value="5">(5)</num><heading> <inline class="small-caps">Investigations and proceedings</inline>.—</heading><content>Chapter 461 shall apply to investigations and proceedings brought under this subsection to the same extent that it applies to investigations and proceedings brought with respect to aviation security duties designated to be carried out by the Secretary of Homeland Security.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c3227c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/6"><num value="6">(6)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c3227d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">Person</inline>.—</heading><chapeau>The term “person” does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c3227e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/6/A/i"><num value="i">(i)</num><content> the United States Postal Service; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c3227f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/6/A/ii"><num value="ii">(ii)</num><content> the Department of Defense.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c32280-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Small business concern</inline>.—</heading><content>The term “small business concern” has the meaning given that term in section 3 of the Small Business Act (<ref href="/us/usc/t15/s632">15 U.S.C. 632</ref>).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c32281-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/7"><num value="7">(7)</num><heading> <inline class="small-caps">Enforcement transparency.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c32282-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/7/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Secretary of Homeland Security shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c32283-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/7/A/i"><num value="i">(i)</num><content> provide an annual summary to the public of all enforcement actions taken by the Secretary under this subsection; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c32284-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/7/A/ii"><num value="ii">(ii)</num><content> include in each such summary the docket number of each enforcement action, the type of alleged violation, the penalty or penalties proposed, and the final assessment amount of each penalty.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c32285-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/7/B"><num value="B">(B)</num><heading> <inline class="small-caps">Electronic availability</inline>.—</heading><content>Each summary under this paragraph shall be made available to the public by electronic means.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c32286-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/u/7/C"><num value="C">(C)</num><heading> <inline class="small-caps">Relationship to the freedom of information act and the privacy act</inline>.—</heading><content>Nothing in this subsection shall be construed to require disclosure of information or records that are exempt from disclosure under sections 552 or 552a of title 5.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c32287-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/v"><num value="v">(v)</num><heading> <inline class="small-caps">Authorization of Appropriations</inline>.—</heading><chapeau>There are authorized to be appropriated to the Transportation Security Administration for salaries, operations, and maintenance of the Administration—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id10c34998-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/v/1"><num value="1">(1)</num><content> $7,849,247,000 for fiscal year 2019;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c34999-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/v/2"><num value="2">(2)</num><content> $7,888,494,000 for fiscal year 2020; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c3499a-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/v/3"><num value="3">(3)</num><content> $7,917,936,000 for fiscal year 2021.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id10c3499b-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w"><num value="w">(w)</num><heading> <inline class="small-caps">Leadership and Organization.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id10c3499c-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>For each of the areas described in paragraph (2), the Administrator of the Transportation Security Administration shall appoint at least 1 individual who shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c3499d-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/1/A"><num value="A">(A)</num><content> report directly to the Administrator or the Administrator’s designated direct report; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c3499e-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/1/B"><num value="B">(B)</num><content> be responsible and accountable for that area.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c3499f-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2"><num value="2">(2)</num><heading> <inline class="small-caps">Areas described</inline>.—</heading><chapeau>The areas described in this paragraph are as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c349a0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/A"><num value="A">(A)</num><chapeau> Aviation security operations and training, including risk-based, adaptive security—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c349a1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/A/i"><num value="i">(i)</num><content> focused on airport checkpoint and baggage screening operations;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c349a2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/A/ii"><num value="ii">(ii)</num><content> workforce training and development programs; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c349a3-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/A/iii"><num value="iii">(iii)</num><content> ensuring compliance with aviation security law, including regulations, and other specialized programs designed to secure air transportation.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c349a4-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/B"><num value="B">(B)</num><chapeau> Surface transportation security operations and training, including risk-based, adaptive security—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id10c349a5-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/B/i"><num value="i">(i)</num><content> focused on accomplishing security systems assessments;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c349a6-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/B/ii"><num value="ii">(ii)</num><content> reviewing and prioritizing projects for appropriated surface transportation security grants;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c349a7-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/B/iii"><num value="iii">(iii)</num><content> operator compliance with surface transportation security law, including regulations, and voluntary industry standards; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id10c349a8-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/B/iv"><num value="iv">(iv)</num><content> workforce training and development programs, and other specialized programs designed to secure surface transportation.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370b9-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/C"><num value="C">(C)</num><content> Transportation industry engagement and planning, including the development, interpretation, promotion, and oversight of a unified effort regarding risk-based, risk-reducing security policies and plans (including strategic planning for future contingencies and security challenges) between government and transportation stakeholders, including airports, domestic and international airlines, general aviation, air cargo, mass transit and passenger rail, freight rail, pipeline, highway and motor carriers, and maritime.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370ba-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/D"><num value="D">(D)</num><content> International strategy and operations, including agency efforts to work with international partners to secure the global transportation network.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370bb-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/E"><num value="E">(E)</num><content> Trusted and registered traveler programs, including the management and marketing of the agency’s trusted traveler initiatives, including the PreCheck Program, and coordination with trusted traveler programs of other Department of Homeland Security agencies and the private sector.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370bc-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/F"><num value="F">(F)</num><content> Technology acquisition and deployment, including the oversight, development, testing, evaluation, acquisition, deployment, and maintenance of security technology and other acquisition programs.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370bd-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/G"><num value="G">(G)</num><content> Inspection and compliance, including the integrity, efficiency and effectiveness of the agency’s workforce, operations, and programs through objective audits, covert testing, inspections, criminal investigations, and regulatory compliance.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370be-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/H"><num value="H">(H)</num><content> Civil rights, liberties, and traveler engagement, including ensuring that agency employees and the traveling public are treated in a fair and lawful manner consistent with Federal laws and regulations protecting privacy and prohibiting discrimination and reprisal.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370bf-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/2/I"><num value="I">(I)</num><content> Legislative and public affairs, including communication and engagement with internal and external audiences in a timely, accurate, and transparent manner, and development and implementation of strategies within the agency to achieve congressional approval or authorization of agency programs and policies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id10c370c0-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/3"><num value="3">(3)</num><heading> <inline class="small-caps">Notification</inline>.—</heading><chapeau>The Administrator shall submit to the appropriate committees of Congress—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370c1-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/3/A"><num value="A">(A)</num><content> not later than 180 days after the date of enactment of the TSA Modernization Act, a list of the names of the individuals appointed under paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id10c370c2-b39a-11e9-865c-9c166f2a6fbc" identifier="/us/usc/t49/s114/w/3/B"><num value="B">(B)</num><content> an update of the list not later than 5 days after any new individual is appointed under paragraph (1).</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>In carrying out the responsibilities under section 114(f)(9) [probably means <ref href="/us/usc/t10/s114/f/9">section 114(f)(9) of Title 10</ref>, United States Code], the Administrator shall develop and implement, not later than 1 year after the date of enactment of this Act [<date date="2018-10-05">Oct. 5, 2018</date>], a program to enable a vendor of related security screening technology to obtain testing and verification, including as an alternative to the TSA’s test and evaluation process, by an appropriate third party, of such technology before procurement or deployment.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Detection Testing.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The third party testing and verification program authorized under subsection (a) shall include detection testing to evaluate the performance of the security screening technology system regarding the probability of detection, the probability of false alarm, and such other indicators that the system is able to meet the TSA’s mission needs.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Results</inline>.—</heading><content>The results of the third party detection testing under paragraph (1) shall be considered final if the results are approved by the Administration in accordance with approval standards developed by the Administrator.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Coordination with final testing</inline>.—</heading><content>To the extent practicable, but without compromising the integrity of the TSA test and evaluation process, the Administrator shall coordinate the third party detection testing under paragraph (1) with any subsequent, final Federal Government testing.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">International standards</inline>.—</heading><chapeau>To the extent practicable and permissible under law and considering the national security interests of the United States, the Administrator shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> share detection testing information and standards with appropriate international partners; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> coordinate with the appropriate international partners to align TSA testing and evaluation with relevant international standards to maximize the capability to detect explosives and other threats.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Operational Testing.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Subject to paragraph (2), the third party testing and verification program authorized under subsection (a) shall include operational testing.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><content>Third party operational testing under paragraph (1) may not exceed 1 year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Alternative</inline>.—</heading><chapeau>Third party testing under subsection (a) shall replace as an alternative, at the discretion of the Administrator, the testing at the TSA Systems Integration Facility, including testing for—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> health and safety factors;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> operator interface;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> human factors;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> environmental factors;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> throughput;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> reliability, maintainability, and availability factors; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> interoperability.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Testing and Verification Framework.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Administrator shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> establish a framework for the third party testing and for verifying a security technology is operationally effective and able to meet the TSA’s mission needs before it may enter or re-enter, as applicable, the operational context at an airport or other transportation facility;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> use phased implementation to allow the TSA and the third party to establish best practices; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> oversee the third party testing and evaluation framework.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Recommendations</inline>.—</heading><content>The Administrator shall request ASAC’s Security Technology Subcommittee, in consultation with representatives of the security manufacturers industry, to develop and submit to the Administrator recommendations for the third party testing and verification framework.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Field Testing</inline>.—</heading><content>The Administrator shall prioritize the field testing and evaluation, including by third parties, of security technology and equipment at airports and on site at security technology manufacturers whenever possible as an alternative to the TSA Systems Integration Facility.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Appropriate Third Parties.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Citizenship requirement</inline>.—</heading><chapeau>An appropriate third party under subsection (a) shall be—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> if an individual, a citizen of the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> if an entity, owned and controlled by a citizen of the United States.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Waiver</inline>.—</heading><content>The Administrator may waive the requirement under paragraph (1)(B) if the entity is a United States subsidiary of a parent company that has implemented a foreign ownership, control, or influence mitigation plan that has been approved by the Defense Security Service of the Department of Defense before applying to provide third party testing. The Administrator may reject any application to provide third party testing under subsection (a) submitted by an entity that requires a waiver under this paragraph.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Conflicts of interest</inline>.—</heading><chapeau>The Administrator shall ensure, to the extent possible, that an entity providing third party testing under this section does not have a contractual, business, or other pecuniary interest (exclusive of any such testing) in—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the security screening technology subject to such testing; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the vendor of such technology.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="h">“(h)</num><heading> <inline class="small-caps">GAO Review.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act [<date date="2018-10-05">Oct. 5, 2018</date>], the Comptroller General of the United States shall submit to the appropriate committees of Congress a study on the third party testing program developed under this section[.]</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Review</inline>.—</heading><chapeau>The study under paragraph (1) shall include a review of the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> Any efficiencies or gains in effectiveness achieved in TSA operations, including technology acquisition or screening operations, as a result of such program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> The degree to which the TSA conducts timely and regular oversight of the appropriate third parties engaged in such testing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><chapeau> The effect of such program on the following:</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> The introduction of innovative detection technologies into security screening operations.</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> The availability of testing for technologies developed by small to medium sized businesses.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><chapeau> Any vulnerabilities associated with such program, including with respect to the following:</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> National security.</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> Any conflicts of interest between the appropriate third parties engaged in such testing and the entities providing such technologies to be tested.</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> Waste, fraud, and abuse.”</content>
</clause>
</subparagraph>
</paragraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>The Administrator shall continue to operate the Transportation Security Administration Systems Integration Facility (referred to in this section as the ‘TSIF’) for the purposes of testing and evaluating advanced transportation security screening technologies related to the mission of the TSA.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Requirements</inline>.—</heading><chapeau>The TSIF shall—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> evaluate the technologies described in subsection (a) to enhance the security of transportation systems through screening and threat mitigation and detection;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> test the technologies described in subsection (a) to support identified mission needs of the TSA and to meet requirements for acquisitions and procurement;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> to the extent practicable, provide original equipment manufacturers with test plans to minimize requirement interpretation disputes and adhere to provided test plans;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> collaborate with other technical laboratories and facilities for purposes of augmenting the capabilities of the TSIF;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> deliver advanced transportation security screening technologies that enhance the overall security of domestic transportation systems; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><chapeau> to the extent practicable, provide funding and promote efforts to enable participation by a small business concern (as the term is described under section 3 of the Small Business Act (<ref href="/us/usc/t15/s632">15 U.S.C. 632</ref>)) that—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> has an advanced technology or capability; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> does not have adequate resources to participate in testing and evaluation processes.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Staffing and Resource Allocation</inline>.—</heading><chapeau>The Administrator shall ensure adequate staffing and resource allocations for the TSIF in a manner that—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> prevents unnecessary delays in the testing and evaluation of advanced transportation security screening technologies for acquisitions and procurement determinations;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> ensures the issuance of final paperwork certification no later than 45 days after the date such testing and evaluation has concluded; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> ensures collaboration with technology stakeholders to close capabilities gaps in transportation security.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Deadline.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Administrator shall notify the appropriate committees of Congress if testing and evaluation by the TSIF of an advanced transportation security screening technology under this section exceeds 180 days from the delivery date.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Notification</inline>.—</heading><chapeau>The notification under paragraph (1) shall include—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> information relating to the delivery date;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> a justification for why the testing and evaluation process has exceeded 180 days; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> the estimated date for completion of such testing and evaluation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Definition of delivery date</inline>.—</heading><chapeau>In this subsection, the term ‘delivery date’ means the date that the owner of an advanced transportation security screening technology—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> after installation, delivers the technology to the TSA for testing and evaluation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> submits to the Administrator, in such form and manner as the Administrator prescribes, a signed notification of the delivery described in subparagraph (A).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Retesting and Evaluation</inline>.—</heading><content>Advanced transportation security screening technology that fails testing and evaluation by the TSIF may be retested and evaluated at the discretion of the Administrator.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Rule of Construction</inline>.—</heading><content>Nothing in this section may be construed to affect the authority or responsibility of an officer of the Department, or an officer of any other Federal department or agency, with respect to research, development, testing, and evaluation of technologies, including such authorities or responsibilities of the Undersecretary for Science and Technology of the Department and Assistant Secretary of the Countering Weapons of Mass Destruction Office of the Department.”</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Public and private stakeholders</inline>.—</heading><content>The term ‘public and private stakeholders’ has the meaning given the term in <ref href="/us/usc/t49/s114/t/1/C">section 114(t)(1)(C) of title 49</ref>, United States Code.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Surface transportation asset</inline>.—</heading><chapeau>The term ‘surface transportation asset’ includes—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> facilities, equipment, or systems used to provide transportation services by—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> a public transportation agency (as the term is defined in section 1402 of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<ref href="/us/usc/t6/s1131">6 U.S.C. 1131</ref>));</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> a railroad carrier (as the term is defined in <ref href="/us/usc/t49/s20102">section 20102 of title 49</ref>, United States Code); [or]</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><chapeau> an owner or operator of—</chapeau><subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="I">     “(I)</num><content> an entity offering scheduled, fixed-route transportation services by over-the road bus (as the term is defined in section 1501 of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<ref href="/us/usc/t6/s1151">6 U.S.C. 1151</ref>)); or</content>
</subclause>
<subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="II">     “(II)</num><content> a bus terminal; or</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> other transportation facilities, equipment, or systems, as determined by the Secretary.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Public Area Security Working Group.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Working group</inline>.—</heading><chapeau>The Administrator, in coordination with the National Protection and Programs Directorate, shall establish a working group to promote collaborative engagement between the TSA and public and private stakeholders to develop non-binding recommendations for enhancing security in public areas of transportation facilities (including facilities that are surface transportation assets), including recommendations regarding the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> Information sharing and interoperable communication capabilities among the TSA and public and private stakeholders with respect to terrorist or other threats.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> Coordinated incident response procedures.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> The prevention of terrorist attacks and other incidents through strategic planning, security training, exercises and drills, law enforcement patrols, worker vetting, and suspicious activity reporting.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> Infrastructure protection through effective construction design barriers and installation of advanced surveillance and other security technologies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Annual report.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date the working group is established under paragraph (1), the Administrator shall submit to the appropriate committee of Congress [probably should be “appropriate committees of Congress”] a report, covering the 12-month period preceding the date of the report, on—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> the organization of the working group;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> the activities of the working group;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> the participation of the TSA and public and private stakeholders in the activities of the working group; [and]</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> the findings of the working group, including any recommendations.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Publication</inline>.—</heading><content>The Administrator may publish a public version of such report that describes the activities of the working group and such related matters as would be informative to the public, consistent with <ref href="/us/usc/t5/s552/b">section 552(b) of title 5</ref>, United States Code.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Nonapplicability of faca</inline>.—</heading><content>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the working group established under subsection (a) or any subcommittee thereof.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Technical Assistance.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> inform owners and operators of surface transportation assets about the availability of technical assistance, including vulnerability assessment tools and cybersecurity guidelines, to help protect and enhance the resilience of public areas of such assets; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> upon request, and subject to the availability of appropriations, provide such technical assistance to owners and operators of surface transportation assets.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Best practices</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date="2018-10-05">Oct. 5, 2018</date>], and periodically thereafter, the Secretary shall publish on the Department website and widely disseminate, as appropriate, current best practices for protecting and enhancing the resilience of public areas of transportation facilities (including facilities that are surface transportation assets), including associated frameworks or templates for implementation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Review.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, the Administrator shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> review of [sic] regulations, directives, policies, and procedures issued by the Administrator regarding the transportation of a firearm and ammunition; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> submit to the appropriate committees of Congress a report on the findings of the review under subparagraph (A), including, as appropriate, information on any plans to modify any regulation, directive, policy, or procedure based on the review.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><chapeau>In preparing the report under paragraph (1), the Administrator shall consult with—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> ASAC;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the Surface Transportation Security Advisory Committee under section 404 of the Homeland Security Act of 2002 [<ref href="/us/usc/t6/s204">6 U.S.C. 204</ref>]; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> appropriate public and private stakeholders.”</content>
</subparagraph>

</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Other appropriate transportation security stakeholders.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Information Sharing</inline>.—</heading><chapeau>The Administrator shall, in accordance with law—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> in coordination with the Office of the Director of National Intelligence and industry partners, implement improvements to the Air Domain Intelligence and Analysis Center to encourage increased participation from stakeholders and enhance government and industry security information sharing on transportation security threats, including on cybersecurity threat awareness;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> expand and improve the City and Airport Threat Assessment or similar program to public and private stakeholders to capture, quantify, communicate, and apply applicable intelligence to inform transportation infrastructure mitigation measures, such as—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> quantifying levels of risk by airport that can be used to determine risk-based security mitigation measures at each location; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> determining random and surge employee inspection operations based on changing levels of risk;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> continue to disseminate Transportation Intelligence Notes, tear-lines, and related intelligence products to appropriate transportation security stakeholders on a regular basis; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> continue to conduct both regular routine and threat-specific classified briefings between the TSA and appropriate transportation sector stakeholders on an individual or group basis to provide greater information sharing between public and private sectors.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Mass Notification</inline>.—</heading><content>The Administrator shall encourage security stakeholders to utilize mass notification systems, including the Integrated Public Alert Warning System of the Federal Emergency Management Agency and social media platforms, to disseminate information to transportation community employees, travelers, and the general public, as appropriate.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Public Awareness Programs</inline>.—</heading><content>The Secretary, in coordination with the Administrator, shall expand public programs of the Department of Homeland Security and the TSA that increase security threat awareness, education, and training to include transportation network public area employees, including airport and transportation vendors, local hotels, cab and limousine companies, ridesharing companies, cleaning companies, gas station attendants, cargo operators, and general aviation members.”</content>
</subsection>

</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> consider security breaches and attacks at domestic and international surface transportation facilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> consider the vulnerabilities and risks associated with specific modes of surface transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><chapeau> evaluate the vetting and security training of—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> employees in surface transportation; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> other individuals with access to sensitive or secure areas of surface transportation networks; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><chapeau> consider input from—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> representatives of different modes of surface transportation;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> representatives of critical infrastructure entities;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> the Transportation Systems Sector Coordinating Council; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> the heads of other relevant Federal departments or agencies.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Risk-based Surface Transportation Security Strategy.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date the security assessment under subsection (a) is complete, the Administrator shall use the results of the assessment—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> to develop and implement a cross-cutting, risk-based surface transportation security strategy that includes—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> all surface transportation modes;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> a mitigating strategy that aligns with each vulnerability and risk identified in subsection (a);</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> a planning process to inform resource allocation;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> priorities, milestones, and performance metrics to measure the effectiveness of the risk-based surface transportation security strategy; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> processes for sharing relevant and timely intelligence threat information with appropriate stakeholders;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><chapeau> to develop a management oversight strategy that—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> identifies the parties responsible for the implementation, management, and oversight of the risk-based surface transportation security strategy; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> includes a plan for implementing the risk-based surface transportation security strategy; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> to modify the risk-based budget and resource allocations, in accordance with section 1965(c) [set out as a note below], for the Transportation Security Administration.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Coordinated approach</inline>.—</heading><chapeau>In developing and implementing the risk-based surface transportation security strategy under paragraph (1), the Administrator shall coordinate with the heads of other relevant Federal departments or agencies, and stakeholders, as appropriate—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> to evaluate existing surface transportation security programs, policies, and initiatives, including the explosives detection canine teams, for consistency with the risk-based security strategy and, to the extent practicable, avoid any unnecessary duplication of effort;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> to determine the extent to which stakeholder security programs, policies, and initiatives address the vulnerabilities and risks to surface transportation systems identified in subsection (a); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> subject to subparagraph (B), to mitigate each vulnerability and risk to surface transportation systems identified in subsection (a).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Report.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date the security assessment under subsection (a) is complete, the Administrator shall submit to the appropriate committees of Congress and the Inspector General of the Department a report that—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> describes the process used to complete the security assessment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> describes the process used to develop the risk-based security strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> describes the risk-based security strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> includes the management oversight strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><chapeau> includes—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> the findings of the security assessment;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> a description of the actions recommended or taken by the Administrator to mitigate the vulnerabilities and risks identified in subsection (a), including interagency coordination;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> any recommendations for improving the coordinated approach to mitigating vulnerabilities and risks to surface transportation systems; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> any recommended changes to the National Infrastructure Protection Plan, the modal annexes to such plan, or relevant surface transportation security programs, policies, or initiatives; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> may contain a classified annex.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Protections</inline>.—</heading><content>In preparing the report, the Administrator shall take appropriate actions to safeguard information described by <ref href="/us/usc/t5/s552/b">section 552(b) of title 5</ref>, United States Code, or protected from disclosure by any other law of the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Updates</inline>.—</heading><content>Not less frequently than semiannually, the Administrator shall report to or brief the appropriate committees of Congress on the vulnerabilities of and risks to surface transportation systems and how those vulnerabilities and risks affect the risk-based security strategy.”</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>In conjunction with the submission of the Department’s annual budget request to the Office of Management and Budget, the Administrator shall submit to the appropriate committees of Congress a report that describes a risk-based budget and resource allocation plan for surface transportation sectors, within and across modes, that—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> reflects the risk-based surface transportation security strategy under section 1964(b) [set out as a note above]; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> is organized by appropriations account, program, project, and initiative.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Budget Transparency</inline>.—</heading><content>In submitting the annual budget of the United States Government under <ref href="/us/usc/t31/s1105">section 1105 of title 31</ref>, United States Code, the President shall clearly distinguish the resources requested for surface transportation security from the resources requested for aviation security.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Resource Reallocation.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 15 days after the date on which the Transportation Security Administration allocates any resources or personnel, including personnel sharing, detailing, or assignment, or the use of facilities, technology systems, or vetting resources, for a nontransportation security purpose or National Special Security Event (as defined in section 2001 of Homeland Security Act of 2002 (<ref href="/us/usc/t6/s601">6 U.S.C. 601</ref>)), the Secretary shall provide the notification described in paragraph (2) to the appropriate committees of Congress.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Notification</inline>.—</heading><chapeau>A notification described in this paragraph shall include—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the reason for and a justification of the resource or personnel allocation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the expected end date of the resource or personnel allocation; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> the projected cost to the Transportation Security Administration of the personnel or resource allocation.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> 5<inline class="small-caps">-year Capital Investment Plan</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date="2018-10-05">Oct. 5, 2018</date>], the Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Homeland Security of the House of Representatives a 5-year capital investment plan, consistent with the 5-year technology investment plan under section 1611 of title XVI of the Homeland Security Act of 2002 [<ref href="/us/usc/t6/s563">6 U.S.C. 563</ref>], as amended by section 3 of the Transportation Security Acquisition Reform Act (<ref href="/us/pl/113/245">Public Law 113–245</ref>; <ref href="/us/stat/128/2871">128 Stat. 2871</ref>).”</content>

</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> current staff allocations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> data collection or research relating to the development of the rulemaking;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> current efforts, if any, with security experts, advisory committees, and other stakeholders; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> other relevant details associated with the development of the rulemaking that impact the progress of the rulemaking.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Inspector General Review</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, and every 2 years thereafter until all of the requirements under titles XIII [<ref href="/us/usc/t6/s1111">6 U.S.C. 1111</ref> et seq.], XIV [<ref href="/us/usc/t6/s1131">6 U.S.C. 1131</ref> et seq.], and XV [<ref href="/us/usc/t6/s1151">6 U.S.C. 1151</ref> et seq.] of the Implementing Recommendations of the 9/11 Commission Act of 2007 (<ref href="/us/usc/t6/s1111">6 U.S.C. 1111</ref> et seq.) and under this title [see Tables for classification] have been fully implemented, the Inspector General of the Department shall submit to the appropriate committees of Congress [Committees on Commerce, Science, and Transportation and Homeland Security and Governmental Affairs of the Senate and Committee on Homeland Security of the House of Representatives] a report that—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> identifies the requirements under such titles of that Act and under this title that have not been fully implemented;</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than 120 days after the date that annual risk-based priorities are developed under subsection (a), the Administrator shall submit to the appropriate committees of Congress a report that includes the following:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> Copies of the risk assessments for each transportation mode.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> A summary that ranks the risks within and across modes.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> A description of the risk-based priorities for securing the transportation sector that identifies and prioritizes the greatest security needs of such transportation sector, both across and within modes, in the order that such priorities should be addressed.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Information on the underlying methodologies used to assess risks across and within each transportation mode and the basis for any assumptions regarding threats, vulnerabilities, and consequences made in assessing and prioritizing risks within each such mode and across modes.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Classification</inline>.—</heading><content>The information provided under subsection (c) may be submitted in a classified format or unclassified format, as the Administrator considers appropriate.”</content>

</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>The plan required under paragraph (1) shall include the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> The incorporation of best practices for information sharing.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> The identification of areas of overlap and redundancy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> An evaluation and incorporation of stakeholder input in the development of such plan.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> The integration of any recommendations of the Comptroller General of the United States on information sharing.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Solicitation</inline>.—</heading><content>The Administrator shall solicit on an annual basis input from appropriate stakeholders, including State and local transportation entities, on the quality and quantity of intelligence received by such stakeholders relating to information sharing.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Best Practices Sharing.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date="2018-10-05">Oct. 5, 2018</date>], the Administrator shall establish a mechanism to share with State and local transportation entities best practices from across the law enforcement spectrum, including Federal, State, local, and tribal entities, that relate to employee training, employee professional development, technology development and deployment, hardening tactics, and passenger and employee awareness programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Consultation</inline>.—</heading><chapeau>The Administrator shall solicit and incorporate stakeholder input—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> in developing the mechanism for sharing best practices as required under paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> not less frequently than annually on the quality and quantity of information such stakeholders receive through the mechanism established under such paragraph.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Cybersecurity.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Administrator, in consultation with the Secretary, shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> not later than 120 days after the date of enactment of this Act [<date date="2018-10-05">Oct. 5, 2018</date>], implement the Framework for Improving Critical Infrastructure Cybersecurity (referred to in this section as the ‘Framework’ developed by the National Institute of Standards and Technology, and any update to such Framework under section 2 of the National Institute of Standards and Technology Act (<ref href="/us/usc/t15/s272">15 U.S.C. 272</ref>), to manage the agency’s cybersecurity risks; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> evaluate, on a periodic basis, but not less often than biennially, the use of the Framework under subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Cybersecurity enhancements to aviation security activities</inline>.—</heading><content>The Secretary, in consultation with the Secretary of Transportation, shall, upon request, conduct cybersecurity vulnerability assessments for airports and air carriers.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">TSA trusted traveler and credentialing program cyber evaluation.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">Evaluation required</inline>.—</heading><chapeau>Not later than 120 days after the date of enactment of this Act, the Secretary shall—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> evaluate the cybersecurity of TSA trusted traveler and credentialing programs that contain personal information of specific individuals or information that identifies specific individuals, including the Transportation Worker Identification Credential and PreCheck programs;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> identify any cybersecurity risks under the programs described in clause (i); and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> develop remediation plans to address the cybersecurity risks identified under clause (ii).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Submission to congress</inline>.—</heading><content>Not later than 30 days after the date the evaluation under subparagraph (A) is complete, the Secretary shall submit to the appropriate committees of Congress information relating to such evaluation, including any cybersecurity vulnerabilities identified and remediation plans to address such vulnerabilities. Such submission shall be provided in a classified form.</content>
</subparagraph>
</paragraph>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> any supplemental standards established by the Administrator of the Transportation Security Administration (referred to in this section as the ‘Administrator’).</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><content> The airport authority or air carrier operator that sponsors the company under the Registered Traveler program shall hereafter be known as the ‘Sponsoring Entity’.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><content> The Administrator shall hereafter require any company covered by subsection (a) to provide, not later than 30 days after the date of enactment of this Act [<date date="2015-03-04">Mar. 4, 2015</date>], to the Sponsoring Entity written certification that the procedures used by the company to safeguard and dispose of information are in compliance with the requirements under subsection (a). Such certification shall include a description of the procedures used by the company to comply with such requirements.”</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Establish requirements to implement trusted passenger programs and use available technologies to expedite the security screening of passengers who participate in such programs, thereby allowing security screening personnel to focus on those passengers who should be subject to more extensive screening.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> In consultation with the Commissioner of the Food and Drug Administration, develop alternative security procedures under which a medical product to be transported on a flight of an air carrier would not be subject to an inspection that would irreversibly damage the product.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> Provide for the use of technologies, including wireless and wire line data technologies, to enable the private and secure communication of threats to aid in the screening of passengers and other individuals on airport property who are identified on any State or Federal security-related data base for the purpose of having an integrated response coordination of various authorized airport security forces.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> In consultation with the Administrator of the Federal Aviation Administration, consider whether to require all pilot licenses to incorporate a photograph of the license holder and appropriate biometric imprints.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> Provide for the use of voice stress analysis, biometric, or other technologies to prevent a person who might pose a danger to air safety or security from boarding the aircraft of an air carrier or foreign air carrier in air transportation or intrastate air transportation.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> Provide for the use of technology that will permit enhanced instant communications and information between airborne passenger aircraft and appropriate individuals or facilities on the ground.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> Require that air carriers provide flight attendants with a discreet, hands-free, wireless method of communicating with the pilots.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 6 months after the date of enactment of this Act [<date date="2001-11-19">Nov. 19, 2001</date>], and annually thereafter until the Under Secretary [now the Administrator of the Transportation Security Administration] has implemented or decided not to take each of the actions specified in subsection (a), the Under Secretary shall transmit to Congress a report on the progress of the Under Secretary in evaluating and taking such actions, including any legislative recommendations that the Under Secretary may have for enhancing transportation security.”</content>
