<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbc99b7e6-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115"><num value="115">§ 115.</num><heading> Transportation Security Oversight Board</heading><subsection style="-uslm-lc:I11" class="indent0" id="idbc99def7-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>There is established in the Department of Homeland Security a board to be known as the “Transportation Security Oversight Board”.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbc99def8-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b"><num value="b">(b)</num><heading> <inline class="small-caps">Membership.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idbc99def9-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Number and appointment</inline>.—</heading><chapeau>The Board shall be composed of 7 members as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99defa-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/A"><num value="A">(A)</num><content> The Secretary of Homeland Security, or the Secretary’s designee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99defb-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/B"><num value="B">(B)</num><content> The Secretary of Transportation, or the Secretary’s designee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99defc-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/C"><num value="C">(C)</num><content> The Attorney General, or the Attorney General’s designee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99defd-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/D"><num value="D">(D)</num><content> The Secretary of Defense, or the Secretary’s designee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99defe-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/E"><num value="E">(E)</num><content> The Secretary of the Treasury, or the Secretary’s designee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99deff-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/F"><num value="F">(F)</num><content> The Director of National Intelligence, or the Director’s designee.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbc99df00-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/1/G"><num value="G">(G)</num><content> One member appointed by the President to represent the National Security Council.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc99df01-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Chairperson</inline>.—</heading><content>The Chairperson of the Board shall be the Secretary of Homeland Security.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbc9a0612-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c"><num value="c">(c)</num><heading> <inline class="small-caps">Duties</inline>.—</heading><chapeau>The Board shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbc9a0613-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c/1"><num value="1">(1)</num><content> review and ratify or disapprove any regulation or security directive issued by the Administrator of the Transportation Security Administration under section 114(<i>l</i>)(2) within 30 days after the date of issuance of such regulation or directive;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc9a0614-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c/2"><num value="2">(2)</num><content> facilitate the coordination of intelligence, security, and law enforcement activities affecting transportation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc9a0615-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c/3"><num value="3">(3)</num><content> facilitate the sharing of intelligence, security, and law enforcement information affecting transportation among Federal agencies and with carriers and other transportation providers as appropriate;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc9a0616-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c/4"><num value="4">(4)</num><content> explore the technical feasibility of developing a common database of individuals who may pose a threat to transportation or national security;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc9a0617-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c/5"><num value="5">(5)</num><content> review plans for transportation security;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbc9a0618-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/c/6"><num value="6">(6)</num><content> make recommendations to the Administrator regarding matters reviewed under paragraph (5).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbc9a0619-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/d"><num value="d">(d)</num><heading> <inline class="small-caps">Quarterly Meetings</inline>.—</heading><content>The Board shall meet at least quarterly.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbc9a061a-09a0-11eb-8bc1-b42614a89997" identifier="/us/usc/t49/s115/e"><num value="e">(e)</num><heading> <inline class="small-caps">Consideration of Security Information</inline>.—</heading><content>A majority of the Board may vote to close a meeting of the Board to the public, except that meetings shall be closed to the public whenever classified,<ref class="footnoteRef" idref="fn002004">1</ref><note type="footnote" id="fn002004"><num>1</num> So in original.
