<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3cfcdf2e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116"><num value="116">§ 116.</num><heading> National Surface Transportation and Innovative Finance Bureau</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf2f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/a"><num value="a">(a)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>The Secretary of Transportation shall establish a National Surface Transportation and Innovative Finance Bureau in the Department.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf30-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/b"><num value="b">(b)</num><heading> <inline class="small-caps">Purposes</inline>.—</heading><chapeau>The purposes of the Bureau shall be—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf31-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/b/1"><num value="1">(1)</num><content> to provide assistance and communicate best practices and financing and funding opportunities to eligible entities for the programs referred to in subsection (d)(1);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf32-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/b/2"><num value="2">(2)</num><content> to administer the application processes for programs within the Department in accordance with subsection (d);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf33-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/b/3"><num value="3">(3)</num><content> to promote innovative financing best practices in accordance with subsection (e);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf34-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/b/4"><num value="4">(4)</num><content> to reduce uncertainty and delays with respect to environmental reviews and permitting in accordance with subsection (f); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf35-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/b/5"><num value="5">(5)</num><content> to reduce costs and risks to taxpayers in project delivery and procurement in accordance with subsection (g).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf36-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c"><num value="c">(c)</num><heading> <inline class="small-caps">Executive Director.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf37-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Appointment</inline>.—</heading><content>The Bureau shall be headed by an Executive Director, who shall be appointed in the competitive service by the Secretary, with the approval of the President.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf38-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Duties</inline>.—</heading><chapeau>The Executive Director shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf39-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c/2/A"><num value="A">(A)</num><content> report to the Under Secretary of Transportation for Policy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf3a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c/2/B"><num value="B">(B)</num><content> be responsible for the management and oversight of the daily activities, decisions, operations, and personnel of the Bureau;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf3b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c/2/C"><num value="C">(C)</num><content> support the Council on Credit and Finance established under section 117 in accordance with this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf3c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/c/2/D"><num value="D">(D)</num><content> carry out such additional duties as the Secretary may prescribe.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf3d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d"><num value="d">(d)</num><heading> <inline class="small-caps">Administration of Certain Application Processes.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf3e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Bureau shall administer the application processes for the following programs:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf3f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/1/A"><num value="A">(A)</num><content> The infrastructure finance programs authorized under chapter 6 of title 23.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf40-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/1/B"><num value="B">(B)</num><content> The railroad rehabilitation and improvement financing program authorized under sections 22401 through 22403.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf41-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/1/C"><num value="C">(C)</num><content> Amount allocations authorized under section 142(m) of the Internal Revenue Code of 1986.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf42-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/1/D"><num value="D">(D)</num><content> The Rural and Tribal Assistance Pilot Program established under section 21205(b)(1) of the Surface Transportation Investment Act of 2021.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf43-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Congressional notification</inline>.—</heading><content>The Executive Director shall ensure that the congressional notification requirements for each program referred to in paragraph (1) are followed in accordance with the statutory provisions applicable to the program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf44-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Reports</inline>.—</heading><content>The Executive Director shall ensure that the reporting requirements for each program referred to in paragraph (1) are followed in accordance with the statutory provisions applicable to the program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf45-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Coordination</inline>.—</heading><content>In administering the application processes for the programs referred to in paragraph (1), the Executive Director shall coordinate with appropriate officials in the Department and its modal administrations responsible for administering such programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf46-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/5"><num value="5">(5)</num><heading> <inline class="small-caps">Streamlining approval processes</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this section, the Executive Director shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation, the Committee on Banking, Housing, and Urban Affairs, and the Committee on Environment and Public Works of the Senate a report that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf47-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/5/A"><num value="A">(A)</num><content> evaluates the application processes for the programs referred to in paragraph (1);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf48-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/5/B"><num value="B">(B)</num><content> identifies administrative and legislative actions that would improve the efficiency of the application processes without diminishing Federal oversight; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf49-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/5/C"><num value="C">(C)</num><content> describes how the Executive Director will implement administrative actions identified under subparagraph (B) that do not require an Act of Congress.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf4a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6"><num value="6">(6)</num><heading> <inline class="small-caps">Procedures and transparency.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf4b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/A"><num value="A">(A)</num><heading> <inline class="small-caps">Procedures</inline>.—</heading><chapeau>With respect to the programs referred to in paragraph (1), the Executive Director shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf4c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/A/i"><num value="i">(i)</num><content> establish procedures for analyzing and evaluating applications and for utilizing the recommendations of the Council on Credit and Finance;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf4d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/A/ii"><num value="ii">(ii)</num><content> establish procedures for addressing late-arriving applications, as applicable, and communicating the Bureau’s decisions for accepting or rejecting late applications to the applicant and the public; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf4e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/A/iii"><num value="iii">(iii)</num><content> document major decisions in the application evaluation process through a decision memorandum or similar mechanism that provides a clear rationale for such decisions.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf4f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/B"><num value="B">(B)</num><heading> <inline class="small-caps">Review.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf50-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Comptroller General of the United States shall review the compliance of the Executive Director with the requirements of this paragraph.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf51-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Recommendations</inline>.—</heading><content>The Comptroller General may make recommendations to the Executive Director in order to improve compliance with the requirements of this paragraph.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf52-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/d/6/B/iii"><num value="iii">(iii)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 3 years after the date of enactment of this section, the Comptroller General shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works, the Committee on Banking, Housing, and Urban Affairs, and the Committee on Commerce, Science, and Transportation of the Senate a report on the results of the review conducted under clause (i), including findings and recommendations for improvement.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf53-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e"><num value="e">(e)</num><heading> <inline class="small-caps">Innovative Financing Best Practices.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf54-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Bureau shall work with the modal administrations within the Department, eligible entities, and other public and private interests to develop and promote best practices for innovative financing and public-private partnerships.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf55-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Activities</inline>.—</heading><chapeau>The Bureau shall carry out paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf56-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/A"><num value="A">(A)</num><content> by making Federal credit assistance programs more accessible to eligible recipients;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf57-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/B"><num value="B">(B)</num><content> by providing advice and expertise to eligible entities that seek to leverage public and private funding;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf58-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/C"><num value="C">(C)</num><content> by sharing innovative financing best practices and case studies from eligible entities with other eligible entities that are interested in utilizing innovative financing methods; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf59-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D"><num value="D">(D)</num><chapeau> by developing and monitoring—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf5a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/i"><num value="i">(i)</num><chapeau> best practices with respect to standardized State public-private partnership authorities and practices, including best practices related to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id3cfcdf5b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/i/I"><num value="I">(I)</num><content> accurate and reliable assumptions for analyzing public-private partnership procurements;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3cfcdf5c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/i/II"><num value="II">(II)</num><content> procedures for the handling of unsolicited bids;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3cfcdf5d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/i/III"><num value="III">(III)</num><content> policies with respect to noncompete clauses; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id3cfcdf5e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/i/IV"><num value="IV">(IV)</num><content> other significant terms of public-private partnership procurements, as determined appropriate by the Bureau;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf5f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/ii"><num value="ii">(ii)</num><content> standard contracts for the most common types of public-private partnerships for transportation facilities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf60-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/2/D/iii"><num value="iii">(iii)</num><content> analytical tools and other techniques to aid eligible entities in determining the appropriate project delivery model, including a value for money analysis.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf61-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3"><num value="3">(3)</num><heading> <inline class="small-caps">Transparency</inline>.—</heading><chapeau>The Bureau shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf62-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3/A"><num value="A">(A)</num><chapeau> ensure the transparency of a project receiving credit assistance under a program referred to in subsection (d)(1) and procured as a public-private partnership by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf63-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3/A/i"><num value="i">(i)</num><content> requiring the sponsor of the project to undergo a value for money analysis or a comparable analysis prior to deciding to advance the project as a public-private partnership;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf64-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3/A/ii"><num value="ii">(ii)</num><content> requiring the analysis required under subparagraph (A), and other key terms of the relevant public-private partnership agreement, to be made publicly available by the project sponsor at an appropriate time;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf65-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3/A/iii"><num value="iii">(iii)</num><content> not later than 3 years after the date of completion of the project, requiring the sponsor of the project to conduct a review regarding whether the private partner is meeting the terms of the relevant public-private partnership agreement; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf66-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3/A/iv"><num value="iv">(iv)</num><content> providing a publicly available summary of the total level of Federal assistance in such project; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf67-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/3/B"><num value="B">(B)</num><content> develop guidance to implement this paragraph that takes into consideration variations in State and local laws and requirements related to public-private partnerships.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf68-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/e/4"><num value="4">(4)</num><heading> <inline class="small-caps">Support to project sponsors</inline>.—</heading><content>At the request of an eligible entity, the Bureau shall provide technical assistance to the eligible entity regarding proposed public-private partnership agreements for transportation facilities, including assistance in performing a value for money analysis or comparable analysis.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf69-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f"><num value="f">(f)</num><heading> <inline class="small-caps">Environmental Review and Permitting.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf6a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Bureau shall take actions that are appropriate and consistent with the Department’s goals and policies to improve the delivery timelines for projects carried out under the programs referred to in subsection (d)(1).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf6b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f/2"><num value="2">(2)</num><heading> <inline class="small-caps">Activities</inline>.—</heading><chapeau>The Bureau shall carry out paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf6c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f/2/A"><num value="A">(A)</num><content> by coordinating efforts to improve the efficiency and effectiveness of the environmental review and permitting process;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf6d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f/2/B"><num value="B">(B)</num><content> by providing technical assistance and training to field and headquarters staff of Federal agencies on policy changes and innovative approaches to the delivery of projects; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf6e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f/2/C"><num value="C">(C)</num><content> by identifying, developing, and tracking metrics for permit reviews and decisions by Federal agencies for projects under the National Environmental Policy Act of 1969.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf6f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/f/3"><num value="3">(3)</num><heading> <inline class="small-caps">Support to project sponsors</inline>.—</heading><content>At the request of an eligible entity that is carrying out a project under a program referred to in subsection (d)(1), the Bureau, in coordination with the appropriate modal administrations within the Department, shall provide technical assistance with regard to the compliance of the project with the requirements of the National Environmental Policy Act 1969 and relevant Federal environmental permits.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf70-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g"><num value="g">(g)</num><heading> <inline class="small-caps">Project Procurement.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf71-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Bureau shall promote best practices in procurement for a project receiving assistance under a program referred to in subsection (d)(1) by developing, in coordination with modal administrations within the Department as appropriate, procurement benchmarks in order to ensure accountable expenditure of Federal assistance over the life cycle of the project.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf72-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/2"><num value="2">(2)</num><heading> <inline class="small-caps">Procurement benchmarks</inline>.—</heading><chapeau>To the maximum extent practicable, the procurement benchmarks developed under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf73-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/2/A"><num value="A">(A)</num><content> establish maximum thresholds for acceptable project cost increases and delays in project delivery;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf74-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/2/B"><num value="B">(B)</num><content> establish uniform methods for States to measure cost and delivery changes over the life cycle of a project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf75-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/2/C"><num value="C">(C)</num><content> be tailored, as necessary, to various types of project procurements, including design-bid-build, design-build, and public-private partnerships.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf76-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/3"><num value="3">(3)</num><heading> <inline class="small-caps">Data collection</inline>.—</heading><chapeau>The Bureau shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf77-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/3/A"><num value="A">(A)</num><content> collect information related to procurement benchmarks developed under paragraph (1), including project specific information detailed under paragraph (2); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf78-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/g/3/B"><num value="B">(B)</num><content> provide on a publicly accessible Internet Web site of the Department a report on the information collected under subparagraph (A).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf79-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h"><num value="h">(h)</num><heading> <inline class="small-caps">Elimination and Consolidation of Duplicative Offices.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf7a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/1"><num value="1">(1)</num><heading> <inline class="small-caps">Elimination of offices</inline>.—</heading><chapeau>The Secretary may eliminate any office within the Department if the Secretary determines that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf7b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/1/A"><num value="A">(A)</num><content> the purposes of the office are duplicative of the purposes of the Bureau; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf7c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/1/B"><num value="B">(B)</num><content> the elimination of the office does not adversely affect the obligations of the Secretary under any Federal law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf7d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/2"><num value="2">(2)</num><heading> <inline class="small-caps">Consolidation of offices and office functions</inline>.—</heading><content>The Secretary may consolidate any office or office function within the Department into the Bureau that the Secretary determines has duties, responsibilities, resources, or expertise that support the purposes of the Bureau.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf7e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3"><num value="3">(3)</num><heading> <inline class="small-caps">Staffing and budgetary resources.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf7f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretary shall ensure that the Bureau is adequately staffed and funded.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf80-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Staffing</inline>.—</heading><content>The Secretary may transfer to the Bureau a position within the Department from any office that is eliminated or consolidated under this subsection if the Secretary determines that the position is necessary to carry out the purposes of the Bureau.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf81-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3/C"><num value="C">(C)</num><heading> <inline class="small-caps">Savings provision</inline>.—</heading><content>If the Secretary transfers a position to the Bureau under subparagraph (B), the Secretary, in coordination with the appropriate modal administration, shall ensure that the transfer of the position does not adversely affect the obligations of the modal administration under any Federal law.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf82-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3/D"><num value="D">(D)</num><heading> <inline class="small-caps">Budgetary resources.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf83-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3/D/i"><num value="i">(i)</num><heading> <inline class="small-caps">Transfer of funds from eliminated or consolidated offices</inline>.—</heading><content>The Secretary may transfer to the Bureau funds allocated to any office or office function that is eliminated or consolidated under this subsection to carry out the purposes of the Bureau. Any such funds or limitation of obligations or portions thereof transferred to the Bureau may be transferred back to and merged with the original account.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3cfcdf84-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/3/D/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Transfer of funds allocated to administrative costs</inline>.—</heading><content>The Secretary may transfer to the Bureau funds allocated to the administrative costs of processing applications for the programs referred to in subsection (d)(1). Any such funds or limitation of obligations or portions thereof transferred to the Bureau may be transferred back to and merged with the original account.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf85-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/4"><num value="4">(4)</num><heading> <inline class="small-caps">Notification</inline>.—</heading><chapeau>Not later than 90 days after the date of enactment of this section, and every 90 days thereafter, the Secretary shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works, the Committee on Banking, Housing, and Urban Affairs, and the Committee on Commerce, Science, and Transportation of the Senate of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf86-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/4/A"><num value="A">(A)</num><content> the offices eliminated under paragraph (1) and the rationale for elimination of the offices;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf87-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/4/B"><num value="B">(B)</num><content> the offices and office functions consolidated under paragraph (2) and the rationale for consolidation of the offices and office functions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf88-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/4/C"><num value="C">(C)</num><content> the actions taken under paragraph (3) and the rationale for taking such actions; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdf89-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/h/4/D"><num value="D">(D)</num><content> any additional legislative actions that may be needed.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf8a-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/i"><num value="i">(i)</num><heading> <inline class="small-caps">Savings Provisions.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf8b-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/i/1"><num value="1">(1)</num><heading> <inline class="small-caps">Laws and regulations</inline>.—</heading><content>Nothing in this section may be construed to change a law or regulation with respect to a program referred to in subsection (d)(1).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf8c-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/i/2"><num value="2">(2)</num><heading> <inline class="small-caps">Responsibilities</inline>.—</heading><content>Nothing in this section may be construed to abrogate the responsibilities of an agency, operating administration, or office within the Department otherwise charged by a law or regulation with other aspects of program administration, oversight, or project approval or implementation for the programs and projects subject to this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf8d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/i/3"><num value="3">(3)</num><heading> <inline class="small-caps">Applicability</inline>.—</heading><content>Nothing in this section may be construed to affect any pending application under 1 or more of the programs referred to in subsection (d)(1) that was received by the Secretary on or before the date of enactment of this section.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf8e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/j"><num value="j">(j)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf8f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/j/1"><num value="1">(1)</num><heading> <inline class="small-caps">Bureau</inline>.—</heading><content>The term “Bureau” means the National Surface Transportation and Innovative Finance Bureau of the Department.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdf93-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s116/j/5"><num value="5">(5)</num><heading> <inline class="small-caps">Multimodal project</inline>.—</heading><content>The term “multimodal project” means a project involving the participation of more than 1 modal administration or secretarial office within the Department.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Establishment.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Secretary [of Transportation] shall establish within the Build America Bureau a pilot program, to be known as the ‘Rural and Tribal Assistance Pilot Program’, to provide to eligible entities the assistance and information described in paragraph (2).</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Assistance and information</inline>.—</heading><chapeau>In carrying out the pilot program, the Secretary may provide to an eligible entity the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> Financial, technical, and legal assistance to evaluate potential projects reasonably expected to be eligible to receive funding or financing assistance under an eligible program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><chapeau> Assistance with development-phase activities, including—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> project planning;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> feasibility studies;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> revenue forecasting and funding and financing options analyses;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> environmental review;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> preliminary engineering and design work;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vi">“(vi)</num><content> economic assessments and cost-benefit analyses;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vii">“(vii)</num><content> public benefit studies;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="viii">“(viii)</num><content> statutory and regulatory framework analyses;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ix">“(ix)</num><content> value for money studies;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="x">“(x)</num><content> evaluations of costs to sustain the project;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xi">“(xi)</num><content> evaluating opportunities for private financing and project bundling; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="xii">“(xii)</num><content> any other activity determined to be appropriate by the Secretary.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> Information regarding innovative financing best practices and case studies, if the eligible entity is interested in using innovative financing methods.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Assistance From Expert Firms</inline>.—</heading><content>The Secretary may retain the services of expert firms, including counsel, in the field of municipal and project finance to assist in providing financial, technical, and legal assistance to eligible entities under the pilot program.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Website.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Description of pilot program.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Secretary shall make publicly available on the website of the Department [of Transporation] a description of the pilot program, including—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> the resources available to eligible entities under the pilot program; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> the application process established under paragraph (2)(A).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Clearinghouse</inline>.—</heading><content>The Secretary may establish a clearinghouse for tools, templates, and best practices on the page of the website of the Department that contains the information described in subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Applications.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act [<date date="2021-11-15">Nov. 15, 2021</date>], the Secretary shall establish a process by which an eligible entity may submit to the Secretary an application under the pilot program, in such form and containing such information as the Secretary may require.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Online portal</inline>.—</heading><content>The Secretary shall develop and make available to the public an online portal through which the Secretary may receive applications under subparagraph (A), on a rolling basis.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><heading> <inline class="small-caps">Approval.—</inline></heading><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 60 days after the date on which the Secretary receives a complete application under subparagraph (A), the Secretary shall provide to each eligible entity that submitted the application a notice describing whether the application is approved or disapproved.</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><heading> <inline class="small-caps">Additional written notification.—</inline></heading><subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="I">     “(I)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Not later than 30 days after the date on which the Secretary provides to an eligible entity a notification under clause (i), the Secretary shall provide to the eligible entity an additional written notification of the approval or disapproval of the application.</content>
</subclause>
<subclause style="-uslm-lc:I36" class="indent4 firstIndent-4"><num value="II">     “(II)</num><heading> <inline class="small-caps">Disapproved applications</inline>.—</heading><content>If the application of an eligible entity is disapproved under this subparagraph, the additional written notification provided to the eligible entity under subclause (I) shall include an offer for a written or telephonic debrief by the Secretary that will provide an explanation of, and guidance regarding, the reasons why the application was disapproved.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><heading> <inline class="small-caps">Insufficient applications</inline>.—</heading><content>The Secretary shall not approve an application under this subparagraph if the application fails to meet the applicable criteria established under this section.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Dashboard</inline>.—</heading><chapeau>The Secretary shall publish on the website of the Department a monthly report that includes, for each application received under the pilot program—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the type of eligible entity that submitted the application;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> the location of each potential project described in the application;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> a brief description of the assistance requested;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> the date on which the Secretary received the application; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> the date on which the Secretary provided the notice of approval or disapproval under paragraph (2)(C)(i).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Experts</inline>.—</heading><content>An eligible entity that receives assistance under the pilot program may retain the services of an expert for any phase of a project carried out using the assistance, including project development, regardless of whether the expert is retained by the Secretary under subsection (c).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Funding.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>For each of fiscal years 2022 through 2026, the Secretary may use to carry out the pilot program, including to retain the services of expert firms under subsection (c), any amount made available to the Secretary to provide credit assistance under an eligible program that is not otherwise obligated, subject to paragraph (2).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><chapeau>The amount used under paragraph (1) to carry out the pilot program shall be not more than—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> $1,600,000 for fiscal year 2022;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> $1,800,000 for fiscal year 2023;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> $2,000,000 for fiscal year 2024;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> $2,200,000 for fiscal year 2025; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> $2,400,000 for fiscal year 2026.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Geographical distribution</inline>.—</heading><content>Not more than 20 percent of the funds made available to carry out the pilot program for a fiscal year may be used for projects in a single State during that fiscal year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Sunset</inline>.—</heading><content>The pilot program shall terminate on the date that is 5 years after the date of enactment of this Act [<date date="2021-11-15">Nov. 15, 2021</date>].</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="h">“(h)</num><heading> <inline class="small-caps">Nonapplicability</inline>.—</heading><content>Nothing in this section limits the ability of the Build America Bureau or the Secretary to establish or carry out any other assistance program under title 23 or title 49, United States Code.”</content>
