<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3cfcdf9d-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117"><num value="117">§ 117.</num><heading> Council on Credit and Finance</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf9e-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/a"><num value="a">(a)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>The Secretary of Transportation shall establish a Council on Credit and Finance in accordance with this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdf9f-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b"><num value="b">(b)</num><heading> <inline class="small-caps">Membership.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfa0-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>The Council shall be composed of the following members:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa1-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/A"><num value="A">(A)</num><content> The Deputy Secretary of Transportation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa2-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/B"><num value="B">(B)</num><content> The Under Secretary of Transportation for Policy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa3-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/C"><num value="C">(C)</num><content> The Chief Financial Officer and Assistant Secretary for Budget and Programs.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa4-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/D"><num value="D">(D)</num><content> The General Counsel of the Department of Transportation.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa5-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/E"><num value="E">(E)</num><content> The Assistant Secretary for Transportation Policy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa6-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/F"><num value="F">(F)</num><content> The Administrator of the Federal Highway Administration.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa7-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/G"><num value="G">(G)</num><content> The Administrator of the Federal Transit Administration.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfa8-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/1/H"><num value="H">(H)</num><content> The Administrator of the Federal Railroad Administration.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfa9-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Additional members</inline>.—</heading><content>The Secretary may designate up to 3 additional officials of the Department to serve as at-large members of the Council.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfaa-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Chairperson and vice chairperson.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfab-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">Chairperson</inline>.—</heading><content>The Deputy Secretary of Transportation shall serve as the chairperson of the Council.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3cfcdfac-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Vice chairperson</inline>.—</heading><content>The Chief Financial Officer and Assistant Secretary for Budget and Programs shall serve as the vice chairperson of the Council.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfad-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Executive director</inline>.—</heading><content>The Executive Director of the National Surface Transportation and Innovative Finance Bureau shall serve as a nonvoting member of the Council.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3cfcdfae-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/c"><num value="c">(c)</num><heading> <inline class="small-caps">Duties</inline>.—</heading><chapeau>The Council shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfaf-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/c/1"><num value="1">(1)</num><content> review applications for assistance submitted under the programs referred to in subparagraphs (A), (B), and (C) of section 116(d)(1);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfb0-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/c/2"><num value="2">(2)</num><content> review applications for assistance submitted under the program referred to in section 116(d)(1)(D), as determined appropriate by the Secretary;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfb1-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/c/3"><num value="3">(3)</num><content> make recommendations to the Secretary regarding the selection of projects to receive assistance under such programs;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfb2-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/c/4"><num value="4">(4)</num><content> review, on a regular basis, projects that received assistance under such programs; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3cfcdfb3-7fa1-11ec-9118-e82f24c6522f" identifier="/us/usc/t49/s117/c/5"><num value="5">(5)</num><content> carry out such additional duties as the Secretary may prescribe.</content>
