<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3478f05d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303"><num value="1303">§ 1303.</num><heading> Administrative provisions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3478f05e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a"><num value="a">(a)</num><heading> Open Meetings.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3478f05f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Board shall be deemed to be an agency for purposes of <ref href="/us/usc/t5/s552b">section 552b of title 5</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3478f060-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2"><num value="2">(2)</num><heading> Nonpublic collaborative discussions.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f061-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Notwithstanding <ref href="/us/usc/t5/s552b">section 552b of title 5</ref>, a majority of the members may hold a meeting that is not open to public observation to discuss official agency business if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3478f062-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/A/i"><num value="i">(i)</num><content> no formal or informal vote or other official agency action is taken at the meeting;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3478f063-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/A/ii"><num value="ii">(ii)</num><content> each individual present at the meeting is a member or an employee of the Board; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3478f064-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/A/iii"><num value="iii">(iii)</num><content> the General Counsel of the Board is present at the meeting.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f065-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/B"><num value="B">(B)</num><heading> <inline class="small-caps">Disclosure of nonpublic collaborative discussions</inline>.—</heading><chapeau>Except as provided under subparagraph (C), not later than 2 business days after the conclusion of a meeting under subparagraph (A), the Board shall make available to the public, in a place easily accessible to the public—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3478f066-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/B/i"><num value="i">(i)</num><content> a list of the individuals present at the meeting; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3478f067-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/B/ii"><num value="ii">(ii)</num><content> a summary of the matters discussed at the meeting, except for any matters the Board properly determines may be withheld from the public under <ref href="/us/usc/t5/s552b/c">section 552b(c) of title 5</ref>.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f068-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/C"><num value="C">(C)</num><heading> <inline class="small-caps">Summary</inline>.—</heading><content>If the Board properly determines matters may be withheld from the public under <ref href="/us/usc/t5/s555b/c">section 555b(c) of title 5</ref>, the Board shall provide a summary with as much general information as possible on those matters withheld from the public.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f069-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/D"><num value="D">(D)</num><heading> <inline class="small-caps">Ongoing proceedings</inline>.—</heading><content>If a discussion under subparagraph (A) directly relates to an ongoing proceeding before the Board, the Board shall make the disclosure under subparagraph (B) on the date of the final Board decision.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f06a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/E"><num value="E">(E)</num><heading> <inline class="small-caps">Preservation of open meetings requirements for agency action</inline>.—</heading><content>Nothing in this paragraph may be construed to limit the applicability of <ref href="/us/usc/t5/s552b">section 552b of title 5</ref> with respect to a meeting of the members other than that described in this paragraph.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f06b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/F"><num value="F">(F)</num><heading> <inline class="small-caps">Statutory construction</inline>.—</heading><chapeau>Nothing in this paragraph may be construed—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3478f06c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/F/i"><num value="i">(i)</num><content> to limit the applicability of <ref href="/us/usc/t5/s552b">section 552b of title 5</ref> with respect to any information which is proposed to be withheld from the public under subparagraph (B)(ii); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3478f06d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/a/2/F/ii"><num value="ii">(ii)</num><content> to authorize the Board to withhold from any individual any record that is accessible to that individual under <ref href="/us/usc/t5/s552a">section 552a of title 5</ref>, United States Code.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3478f06e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/b"><num value="b">(b)</num><heading> <inline class="small-caps">Representation by Attorneys</inline>.—</heading><content>Attorneys designated by the Chairman of the Board may appear for, and represent the Board in, any civil action brought in connection with any function carried out by the Board pursuant to this chapter or subtitle IV or as otherwise authorized by law.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3478f06f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/c"><num value="c">(c)</num><heading> <inline class="small-caps">Admission To Practice</inline>.—</heading><content>Subject to <ref href="/us/usc/t5/s500">section 500 of title 5</ref>, the Board may regulate the admission of individuals to practice before it and may impose a reasonable admission fee.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3478f070-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/d"><num value="d">(d)</num><heading> Submission of Certain Documents to Congress.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3478f071-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>If the Board submits any budget estimate, budget request, supplemental budget estimate, or other budget information, legislative recommendation, prepared testimony for a congressional hearing, or comment on legislation to the President or to the Office of Management and Budget, the Board shall concurrently submit a copy of such document to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f072-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/d/1/A"><num value="A">(A)</num><content> the Committee on Commerce, Science, and Transportation of the Senate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3478f073-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/d/1/B"><num value="B">(B)</num><content> the Committee on Transportation and Infrastructure of the House of Representatives.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3478f074-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s1303/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">No approval required</inline>.—</heading><content>No officer or agency of the United States has any authority to require the Board to submit budget estimates or requests, legislative recommendations, prepared testimony for congressional hearings, or comments on legislation to any officer or agency of the United States for approval, comments, or review before submitting such recommendations, testimony, or comments to Congress.</content>
