<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3aee03c7-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501"><num value="14501">§ 14501.</num><heading> Federal authority over intrastate transportation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3aee03c8-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/a"><num value="a">(a)</num><heading> Motor Carriers of Passengers.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03c9-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Limitation on state law</inline>.—</heading><chapeau>No State or political subdivision thereof and no interstate agency or other political agency of 2 or more States shall enact or enforce any law, rule, regulation, standard, or other provision having the force and effect of law relating to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03ca-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/a/1/A"><num value="A">(A)</num><content> scheduling of interstate or intrastate transportation (including discontinuance or reduction in the level of service) provided by a motor carrier of passengers subject to jurisdiction under subchapter I of chapter 135 of this title on an interstate route;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03cb-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/a/1/B"><num value="B">(B)</num><content> the implementation of any change in the rates for such transportation or for any charter transportation except to the extent that notice, not in excess of 30 days, of changes in schedules may be required; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03cc-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/a/1/C"><num value="C">(C)</num><content> the authority to provide intrastate or interstate charter bus transportation.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">This paragraph shall not apply to intrastate commuter bus operations, or to intrastate bus transportation of any nature in the State of Hawaii.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03cd-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Matters not covered</inline>.—</heading><content>Paragraph (1) shall not restrict the safety regulatory authority of a State with respect to motor vehicles, the authority of a State to impose highway route controls or limitations based on the size or weight of the motor vehicle, or the authority of a State to regulate carriers with regard to minimum amounts of financial responsibility relating to insurance requirements and self-insurance authorization.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3aee03ce-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/b"><num value="b">(b)</num><heading> Freight Forwarders and Brokers.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03cf-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">General rule</inline>.—</heading><content>Subject to paragraph (2) of this subsection, no State or political subdivision thereof and no intrastate agency or other political agency of 2 or more States shall enact or enforce any law, rule, regulation, standard, or other provision having the force and effect of law relating to intrastate rates, intrastate routes, or intrastate services of any freight forwarder or broker.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03d0-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Continuation of hawaii’s authority</inline>.—</heading><content>Nothing in this subsection and the amendments made by the Surface Freight Forwarder Deregulation Act of 1986 shall be construed to affect the authority of the State of Hawaii to continue to regulate a motor carrier operating within the State of Hawaii.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3aee03d1-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c"><num value="c">(c)</num><heading> Motor Carriers of Property.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03d2-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">General rule</inline>.—</heading><content>Except as provided in paragraphs (2) and (3), a State, political subdivision of a State, or political authority of 2 or more States may not enact or enforce a law, regulation, or other provision having the force and effect of law related to a price, route, or service of any motor carrier (other than a carrier affiliated with a direct air carrier covered by section 41713(b)(4)) or any motor private carrier, broker, or freight forwarder with respect to the transportation of property.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03d3-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Matters not covered</inline>.—</heading><chapeau>Paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03d4-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/2/A"><num value="A">(A)</num><content> shall not restrict the safety regulatory authority of a State with respect to motor vehicles, the authority of a State to impose highway route controls or limitations based on the size or weight of the motor vehicle or the hazardous nature of the cargo, or the authority of a State to regulate motor carriers with regard to minimum amounts of financial responsibility relating to insurance requirements and self-insurance authorization;</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03d6-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/2/C"><num value="C">(C)</num><content> does not apply to the authority of a State or a political subdivision of a State to enact or enforce a law, regulation, or other provision relating to the price of for-hire motor vehicle transportation by a tow truck, if such transportation is performed without the prior consent or authorization of the owner or operator of the motor vehicle.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03d7-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3"><num value="3">(3)</num><heading> State standard transportation practices.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03d8-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">Continuation</inline>.—</heading><chapeau>Paragraph (1) shall not affect any authority of a State, political subdivision of a State, or political authority of 2 or more States to enact or enforce a law, regulation, or other provision, with respect to the intrastate transportation of property by motor carriers, related to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3aee03d9-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/A/i"><num value="i">(i)</num><content> uniform cargo liability rules,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3aee03da-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/A/ii"><num value="ii">(ii)</num><content> uniform bills of lading or receipts for property being transported,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3aee03db-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/A/iii"><num value="iii">(iii)</num><content> uniform cargo credit rules,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3aee03dc-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/A/iv"><num value="iv">(iv)</num><content> antitrust immunity for joint line rates or routes, classifications, mileage guides, and pooling, or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3aee03dd-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/A/v"><num value="v">(v)</num><content> antitrust immunity for agent-van line operations (as set forth in section 13907),</content>
</clause>

<continuation style="-uslm-lc:I32" class="indent2 firstIndent0">if such law, regulation, or provision meets the requirements of subparagraph (B).</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03de-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Requirements</inline>.—</heading><chapeau>A law, regulation, or provision of a State, political subdivision, or political authority meets the requirements of this subparagraph if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3aee03df-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/B/i"><num value="i">(i)</num><content> the law, regulation, or provision covers the same subject matter as, and compliance with such law, regulation, or provision is no more burdensome than compliance with, a provision of this part or a regulation issued by the Secretary or the Board under this part; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3aee03e0-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/B/ii"><num value="ii">(ii)</num><content> the law, regulation, or provision only applies to a carrier upon request of such carrier.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03e1-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/3/C"><num value="C">(C)</num><heading> <inline class="small-caps">Election</inline>.—</heading><content>Notwithstanding any other provision of law, a carrier affiliated with a direct air carrier through common controlling ownership may elect to be subject to a law, regulation, or provision of a State, political subdivision, or political authority under this paragraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03e2-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/4"><num value="4">(4)</num><heading> <inline class="small-caps">Nonapplicability to hawaii</inline>.—</heading><content>This subsection shall not apply with respect to the State of Hawaii.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03e3-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/c/5"><num value="5">(5)</num><heading> <inline class="small-caps">Limitation on statutory construction</inline>.—</heading><content>Nothing in this section shall be construed to prevent a State from requiring that, in the case of a motor vehicle to be towed from private property without the consent of the owner or operator of the vehicle, the person towing the vehicle have prior written authorization from the property owner or lessee (or an employee or agent thereof) or that such owner or lessee (or an employee or agent thereof) be present at the time the vehicle is towed from the property, or both.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3aee03e4-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d"><num value="d">(d)</num><heading> Pre-Arranged Ground Transportation.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03e5-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>No State or political subdivision thereof and no interstate agency or other political agency of 2 or more States shall enact or enforce any law, rule, regulation, standard or other provision having the force and effect of law requiring a license or fee on account of the fact that a motor vehicle is providing pre-arranged ground transportation service if the motor carrier providing such service—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03e6-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/1/A"><num value="A">(A)</num><content> meets all applicable registration requirements under chapter 139 for the interstate transportation of passengers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03e7-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/1/B"><num value="B">(B)</num><content> meets all applicable vehicle and intrastate passenger licensing requirements of the State or States in which the motor carrier is domiciled or registered to do business; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03e8-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/1/C"><num value="C">(C)</num><chapeau> is providing such service pursuant to a contract for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id3aee03e9-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/1/C/i"><num value="i">(i)</num><content> transportation by the motor carrier from one State, including intermediate stops, to a destination in another State; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id3aee03ea-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/1/C/ii"><num value="ii">(ii)</num><content> transportation by the motor carrier from one State, including intermediate stops in another State, to a destination in the original State.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03eb-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Intermediate stop defined</inline>.—</heading><content>In this section, the term “intermediate stop”, with respect to transportation by a motor carrier, means a pause in the transportation in order for one or more passengers to engage in personal or business activity, but only if the driver providing the transportation to such passenger or passengers does not, before resuming the transportation of such passenger (or at least 1 of such passengers), provide transportation to any other person not included among the passengers being transported when the pause began.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3aee03ec-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Matters not covered</inline>.—</heading><chapeau>Nothing in this subsection shall be construed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03ed-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/3/A"><num value="A">(A)</num><content> as subjecting taxicab service to regulation under chapter 135 or section 31138;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03ee-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/3/B"><num value="B">(B)</num><content> as prohibiting or restricting an airport, train, or bus terminal operator from contracting to provide preferential access or facilities to one or more providers of pre-arranged ground transportation service; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3aee03ef-3bf5-11e3-a342-84d17a7c85b8" identifier="/us/usc/t49/s14501/d/3/C"><num value="C">(C)</num><content> as restricting the right of any State or political subdivision of a State to require, in a nondiscriminatory manner, that any individual operating a vehicle providing prearranged ground transportation service originating in the State or political subdivision have submitted to pre-licensing drug testing or a criminal background investigation of the records of the State in which the operator is domiciled, by the State or political subdivision by which the operator is licensed to provide such service, or by the motor carrier providing such service, as a condition of providing such service.</content>
