and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id34e67efa-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/2/A/ii\"><num value=\"ii\">(ii)</num><content> high speed ground transportation systems that connect metropolitan areas, without regard to whether those systems use new technologies not associated with traditional railroads; but</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id34e67efb-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/2/B\"><num value=\"B\">(B)</num><content> does not include rapid transit operations in an urban area that are not connected to the general railroad system of transportation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id34e67efc-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/3\"><num value=\"3\">(3)</num><content> “railroad carrier” means a person providing railroad transportation, except that, upon petition by a group of commonly controlled railroad carriers that the Secretary determines is operating within the United States as a single, integrated rail system, the Secretary may by order treat the group of railroad carriers as a single railroad carrier for purposes of one or more provisions of part A, subtitle V of this title and implementing regulations and order, subject to any appropriate conditions that the Secretary may impose.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id34e67efd-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/4\"><num value=\"4\">(4)</num><chapeau> “safety-related railroad employee” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id34e67efe-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/4/A\"><num value=\"A\">(A)</num><content> a railroad employee who is subject to chapter 211;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id34e67eff-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/4/B\"><num value=\"B\">(B)</num><content> another operating railroad employee who is not subject to chapter 211;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id34e67f00-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/4/C\"><num value=\"C\">(C)</num><content> an employee who maintains the right of way of a railroad;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id34e67f01-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/4/D\"><num value=\"D\">(D)</num><content> an employee of a railroad carrier who is a hazmat employee as defined in <ref href=\"/us/usc/t49/s5102/3\">section 5102(3) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id34e67f02-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s20102/4/E\"><num value=\"E\">(E)</num><content> an employee who inspects, repairs, or maintains locomotives, passenger cars, or freight cars;
