<chapeau style="-uslm-lc:I11" class="indent0">In this part—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91598dfa-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/1"><num value="1">(1)</num><content> “Class I railroad”, “Class II railroad”, and “Class III railroad” mean railroad carriers that have annual carrier operating revenues that meet the threshold amount for Class I carriers, Class II carriers, and Class III carriers, respectively, as determined by the Surface Transportation Board under section 1201.1–1 of title 49, Code of Federal Regulations.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91598dfb-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/2"><num value="2">(2)</num><chapeau> “railroad”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id91598dfc-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/2/A"><num value="A">(A)</num><chapeau> means any form of nonhighway ground transportation that runs on rails or electromagnetic guideways, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id91598dfd-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/2/A/i"><num value="i">(i)</num><content> commuter or other short-haul railroad passenger service in a metropolitan or suburban area and commuter railroad service that was operated by the Consolidated Rail Corporation on <date date="1979-01-01">January 1, 1979</date>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id91598dfe-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/2/A/ii"><num value="ii">(ii)</num><content> high speed ground transportation systems that connect metropolitan areas, without regard to whether those systems use new technologies not associated with traditional railroads; but</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91598dff-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/2/B"><num value="B">(B)</num><content> does not include rapid transit operations in an urban area that are not connected to the general railroad system of transportation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91598e00-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/3"><num value="3">(3)</num><content> “railroad carrier” means a person providing railroad transportation, except that, upon petition by a group of commonly controlled railroad carriers that the Secretary determines is operating within the United States as a single, integrated rail system, the Secretary may by order treat the group of railroad carriers as a single railroad carrier for purposes of one or more provisions of part A, subtitle V of this title and implementing regulations and order, subject to any appropriate conditions that the Secretary may impose.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91598e01-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4"><num value="4">(4)</num><chapeau> “safety-related railroad employee” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id91598e02-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4/A"><num value="A">(A)</num><content> a railroad employee who is subject to chapter 211;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91598e03-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4/B"><num value="B">(B)</num><content> another operating railroad employee who is not subject to chapter 211;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91598e04-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4/C"><num value="C">(C)</num><content> an employee who maintains the right of way of a railroad;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91598e05-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4/D"><num value="D">(D)</num><content> an employee of a railroad carrier who is a hazmat employee as defined in <ref href="/us/usc/t49/s5102/3">section 5102(3) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91598e06-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4/E"><num value="E">(E)</num><content> an employee who inspects, repairs, or maintains locomotives, passenger cars, or freight cars; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91598e07-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20102/4/F"><num value="F">(F)</num><content> any other employee of a railroad carrier who directly affects railroad safety, as determined by the Secretary.</content>
