<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id88a237cd-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s20116"><num value="20116">§ 20116.</num><heading> Rulemaking process</heading>
<chapeau style="-uslm-lc:I11" class="indent0">No rule or order issued by the Secretary under this part shall be effective if it incorporates by reference a code, rule, standard, requirement, or practice issued by an association or other entity that is not an agency of the Federal Government, unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id88a237ce-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s20116/1"><num value="1">(1)</num><content> the date on which the code, rule, standard, requirement, or practice was adopted is specifically cited in the rule or order; or</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id88a237cf-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s20116/2"><num value="2">(2)</num><content> the code, rule, standard, requirement, or practice has been subject to notice and comment under a rule or order issued under this part.</content>
