<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id91657530-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20132"><num value="20132">§ 20132.</num><heading> Visible markers for rear cars</heading><subsection style="-uslm-lc:I11" class="indent0" id="id91657531-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20132/a"><num value="a">(a)</num><heading> General.—</heading><chapeau>The Secretary of Transportation shall prescribe regulations and issue orders that may be necessary to require that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91657532-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20132/a/1"><num value="1">(1)</num><content> the rear car of each passenger and commuter train has at least one highly visible marker that is lighted during darkness and when weather conditions restrict clear visibility; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id91657533-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20132/a/2"><num value="2">(2)</num><content> the rear car of each freight train has highly visible markers during darkness and when weather conditions restrict clear visibility.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id91657534-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s20132/b"><num value="b">(b)</num><heading> Preemption.—</heading><content>Notwithstanding <ref href="/us/usc/t49/s20106">section 20106 of this title</ref>, subsection (a) of this section does not prohibit a State from continuing in force a law, regulation, or order in effect on <date date="1976-07-08">July 8, 1976</date>, related to lighted markers on the rear car of a freight train except to the extent it would cause the car to be in violation of this section.</content>
