<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id91763dae-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s21101"><num value="21101">§ 21101.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91763daf-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s21101/1"><num value="1">(1)</num><content> “designated terminal” means the home or away-from-home terminal for the assignment of a particular crew.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id91763db0-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s21101/2"><num value="2">(2)</num><content> “dispatching service employee” means an operator, train dispatcher, or other train employee who by the use of an electrical or mechanical device dispatches, reports, transmits, receives, or delivers orders related to or affecting train movements.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id91763db1-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s21101/3"><num value="3">(3)</num><content> “employee” means a dispatching service employee, a signal employee, or a train employee.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id91763db2-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s21101/4"><num value="4">(4)</num><content> “signal employee” means an individual who is engaged in installing, repairing, or maintaining signal systems.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id91763db3-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s21101/5"><num value="5">(5)</num><content> “train employee” means an individual engaged in or connected with the movement of a train, including a hostler.</content>

<p style="-uslm-lc:I21" class="indent0">Clause (2) is added to avoid the necessity of repeating the substance of the definition every time a “dispatching service employee” is referred to in this chapter. The language in clause (2) is derived from 45:63.</p>
<p style="-uslm-lc:I21" class="indent0">Clause (3) is added to provide a definition of “employee” when the source provisions apply to all types of employees covered by this chapter.</p>
<p style="-uslm-lc:I21" class="indent0">Clause (4) is added to avoid the necessity of repeating the substance of the definition every time a “signal employee” is referred to in this chapter. The language in clause (4) is derived from 45:63a.</p>

<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> to require training of affected employees and supervisors, including training of employees in the entry of hours of service data.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> Procedure.—</heading><content>In lieu of issuing a notice of proposed rulemaking as contemplated by <ref href="/us/usc/t5/s553">section 553 of title 5</ref>, United States Code, the Secretary may utilize the Railroad Safety Advisory Committee to assist in development of the regulation. The Secretary may propose and adopt amendments to the revised regulations thereafter as may be necessary in light of experience under the revised requirements.”</content>
