<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id88bec0c5-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322"><num value="24322">§ 24322.</num><heading> Rolling stock purchases</heading><subsection style="-uslm-lc:I11" class="indent0" id="id88bec0c6-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Prior to entering into any contract in excess of $100,000,000 for rolling stock and locomotive procurements Amtrak shall submit a business case analysis to the Secretary of Transportation, the Committee on Commerce, Science, and Transportation and the Committee on Appropriations of the Senate and the Committee on Transportation and Infrastructure and the Committee on Appropriations of the House of Representatives, on the utility of such procurements.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id88bec0c7-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/b"><num value="b">(b)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>The business case analysis shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id88bec0c8-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/b/1"><num value="1">(1)</num><content> include a cost and benefit comparison that describes the total lifecycle costs and the anticipated benefits related to revenue, operational efficiency, reliability, and other factors;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88bec0c9-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/b/2"><num value="2">(2)</num><content> set forth the total payments by fiscal year;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88bec0ca-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/b/3"><num value="3">(3)</num><content> identify the specific source and amounts of funding for each payment, including Federal funds, State funds, Amtrak profits, Federal, State, or private loans or loan guarantees, and other funding;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88bec0cb-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/b/4"><num value="4">(4)</num><content> include an explanation of whether any payment under the contract will increase Amtrak’s funding request in its general and legislative annual report required under section 24315(b) in a particular fiscal year; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88bec0cc-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/b/5"><num value="5">(5)</num><content> describe how Amtrak will adjust the procurement if future funding is not available.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id88bec0cd-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s24322/c"><num value="c">(c)</num><heading> <inline class="small-caps">Rule of Construction</inline>.—</heading><content>Nothing in this section shall be construed as requiring Amtrak to disclose confidential information regarding a potential vendor’s proposed pricing or other sensitive business information prior to contract execution or prohibiting Amtrak from entering into a contract after submission of a business case analysis under subsection (a).</content>
