<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id350ca4b7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904"><num value="24904">§ 24904.</num><heading> Northeast Corridor planning</heading><subsection style="-uslm-lc:I11" class="indent0" id="id350ca4b8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a"><num value="a">(a)</num><heading> Northeast Corridor Capital Investment Plan.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4b9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Requirement</inline>.—</heading><chapeau>Not later than May 1 of each year, the Northeast Corridor Commission established under section 24905 (referred to in this section as the “Commission”) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4ba-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/1/A"><num value="A">(A)</num><content> develop a capital investment plan for the Northeast Corridor; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4bb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/1/B"><num value="B">(B)</num><content> submit the capital investment plan to the Secretary of Transportation and the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4bc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>The capital investment plan shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4bd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/A"><num value="A">(A)</num><content> reflect coordination and network optimization across the entire Northeast Corridor;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4be-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/B"><num value="B">(B)</num><content> integrate the individual capital and service plans developed by each operator using the methods described in the cost allocation policy developed under section 24905(c);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4bf-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/C"><num value="C">(C)</num><content> cover a period of 5 fiscal years, beginning with the first fiscal year after the date on which the plan is completed;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4c0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/D"><num value="D">(D)</num><chapeau> notwithstanding section 24902(b), identify, prioritize, and phase the implementation of projects and programs to achieve the service outcomes identified in the Northeast Corridor service development plan and the asset condition needs identified in the Northeast Corridor asset management plans, once available, and consider—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id350ca4c1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/D/i"><num value="i">(i)</num><content> the benefits and costs of capital investments in the plan;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4c2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/D/ii"><num value="ii">(ii)</num><content> project and program readiness;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4c3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/D/iii"><num value="iii">(iii)</num><content> the operational impacts; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4c4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/D/iv"><num value="iv">(iv)</num><content> Federal and non-Federal funding availability;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4c5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/E"><num value="E">(E)</num><chapeau> categorize capital projects and programs as primarily associated with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id350ca4c6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/E/i"><num value="i">(i)</num><content> normalized capital replacement and basic infrastructure renewals;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4c7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/E/ii"><num value="ii">(ii)</num><content> replacement or rehabilitation of major Northeast Corridor infrastructure assets, including tunnels, bridges, stations, and other assets;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4c8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/E/iii"><num value="iii">(iii)</num><content> statutory, regulatory, or other legal mandates;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4c9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/E/iv"><num value="iv">(iv)</num><content> improvements to support service enhancements or growth; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4ca-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/E/v"><num value="v">(v)</num><content> strategic initiatives that will improve overall operational performance or lower costs;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4cb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/F"><num value="F">(F)</num><content> identify capital projects and programs that are associated with more than 1 category described in subparagraph (E);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4cc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/G"><num value="G">(G)</num><chapeau> describe the anticipated outcomes of each project or program, including an assessment of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id350ca4cd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/G/i"><num value="i">(i)</num><content> the potential effect on passenger accessibility, operations, safety, reliability, and resiliency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4ce-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/G/ii"><num value="ii">(ii)</num><content> the ability of infrastructure owners and operators to meet regulatory requirements if the project or program is not funded; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4cf-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/G/iii"><num value="iii">(iii)</num><content> the benefits and costs; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4d0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/2/H"><num value="H">(H)</num><content> include a financial plan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4d1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Financial plan</inline>.—</heading><chapeau>The financial plan under paragraph (2)(H) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4d2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/3/A"><num value="A">(A)</num><content> identify funding sources and financing methods;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4d3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/3/B"><num value="B">(B)</num><content> identify the expected allocated shares of costs pursuant to the cost allocation policy developed under section 24905(c);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4d4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/3/C"><num value="C">(C)</num><content> identify the projects and programs that the Commission expects will receive Federal financial assistance; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4d5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/a/3/D"><num value="D">(D)</num><content> identify the eligible entity or entities that the Commission expects will receive the Federal financial assistance described under subparagraph (C) and implement each capital project.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id350ca4d6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/b"><num value="b">(b)</num><heading> <inline class="small-caps">Failure To Develop a Capital Investment Plan</inline>.—</heading><chapeau>If a capital investment plan has not been developed by the Commission for a given fiscal year, then the funds assigned to the Northeast Corridor account established under section 24317(b) for that fiscal year may be spent only on—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4d7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/b/1"><num value="1">(1)</num><content> capital projects described in clause (i) or (iii) of subsection (a)(2)(E) of this section; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4d8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/b/2"><num value="2">(2)</num><content> capital projects described in subsection (a)(2)(E)(iv) or (v) of this section that are for the sole benefit of Amtrak.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id350ca4d9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c"><num value="c">(c)</num><heading> Northeast Corridor Asset Management.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4da-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>With regard to its infrastructure, Amtrak and each State and public transportation entity that owns infrastructure that supports or provides for intercity rail passenger transportation on the Northeast Corridor shall develop an asset management system and develop and update, as necessary, a Northeast Corridor asset management plan for each service territory described in subsection (a) that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4db-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1/A"><num value="A">(A)</num><content> is consistent with the Federal Transit Administration process, as authorized under section 5326, when implemented; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4dc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1/B"><num value="B">(B)</num><chapeau> includes, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id350ca4dd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1/B/i"><num value="i">(i)</num><content> an inventory of all capital assets owned by the developer of the asset management plan;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4de-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1/B/ii"><num value="ii">(ii)</num><content> an assessment of asset condition;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4df-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1/B/iii"><num value="iii">(iii)</num><content> a description of the resources and processes necessary to bring or maintain those assets in a state of good repair, including decision-support tools and investment prioritization methods; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id350ca4e0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/1/B/iv"><num value="iv">(iv)</num><content> a description of changes in asset condition since the previous version of the plan.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350ca4e1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Transmittal</inline>.—</heading><chapeau>Each entity described in paragraph (1) shall transmit to the Commission—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4e2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/2/A"><num value="A">(A)</num><content> not later than 2 years after the date of enactment of the Passenger Rail Reform and Investment Act of 2015, a Northeast Corridor asset management plan developed under paragraph (1); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id350ca4e3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/c/2/B"><num value="B">(B)</num><content> at least biennially thereafter, an update to such plan.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id350ca4e4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/d"><num value="d">(d)</num><heading> <inline class="small-caps">Northeast Corridor Service Development Plan Updates</inline>.—</heading><content>Not less frequently than once every 10 years, the Commission shall update the Northeast Corridor service development plan.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id350ca4e5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s24904/e"><num value="e">(e)</num><heading> <inline class="small-caps">Definition of Northeast Corridor</inline>.—</heading><content>In this section, the term “Northeast Corridor” means the main line between Boston, Massachusetts, and the District of Columbia, and the Northeast Corridor branch lines connecting to Harrisburg, Pennsylvania, Springfield, Massachusetts, and Spuyten Duyvil, New York, including the facilities and services used to operate and maintain those lines.</content>
