<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id350eeedb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101"><num value="26101">§ 26101.</num><heading> High-speed rail corridor planning</heading><subsection style="-uslm-lc:I11" class="indent0" id="id350eeedc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/a"><num value="a">(a)</num><heading> <inline class="small-caps">Corridor Planning Assistance</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id350eeedd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/a/1"><num value="1">(1)</num><content> The Secretary may provide under this section financial assistance to a public agency or group of public agencies for corridor planning for up to 50 percent of the publicly financed costs associated with eligible activities.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id350eeede-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/a/2"><num value="2">(2)</num><content> No less than 20 percent of the publicly financed costs associated with eligible activities shall come from State and local sources, which State and local sources may not include funds from any Federal program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id350eeedf-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b"><num value="b">(b)</num><heading> <inline class="small-caps">Eligible Activities</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id350eeee0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1"><num value="1">(1)</num><chapeau> A corridor planning activity is eligible for financial assistance under subsection (a) if the Secretary determines that it is necessary to establish appropriate engineering, operational, financial, environmental, or socioeconomic projections for the establishment of high-speed rail service in the corridor and that it leads toward development of a prudent financial and institutional plan for implementation of specific high-speed rail improvements, or if it is an activity described in subparagraph (M). Eligible corridor planning activities include—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/A"><num value="A">(A)</num><content> environmental assessments;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/B"><num value="B">(B)</num><content> feasibility studies emphasizing commercial technology improvements or applications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/C"><num value="C">(C)</num><content> economic analyses, including ridership, revenue, and operating expense forecasting;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/D"><num value="D">(D)</num><content> assessing the impact on rail employment of developing high-speed rail corridors;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/E"><num value="E">(E)</num><content> assessing community economic impacts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/F"><num value="F">(F)</num><content> coordination with State and metropolitan area transportation planning and corridor planning with other States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/G"><num value="G">(G)</num><content> operational planning;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/H"><num value="H">(H)</num><content> route selection analyses and purchase of rights-of-way for proposed high-speed rail service;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeee9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/I"><num value="I">(I)</num><content> preliminary engineering and design;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeeea-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/J"><num value="J">(J)</num><content> identification of specific improvements to a corridor, including electrification, line straightening and other right-of-way improvements, bridge rehabilitation and replacement, use of advanced locomotives and rolling stock, ticketing, coordination with other modes of transportation, parking and other means of passenger access, track, signal, station, and other capital work, and use of intermodal terminals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeeeb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/K"><num value="K">(K)</num><content> preparation of financing plans and prospectuses;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeeec-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/L"><num value="L">(L)</num><content> creation of public/private partnerships; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id350eeeed-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/1/M"><num value="M">(M)</num><content> the acquisition of locomotives, rolling stock, track, and signal equipment.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id350eeeee-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/b/2"><num value="2">(2)</num><content> No financial assistance shall be provided under this section for corridor planning with respect to the main line of the Northeast Corridor, between Washington, District of Columbia, and Boston, Massachusetts.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id350eeeef-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c"><num value="c">(c)</num><heading> <inline class="small-caps">Criteria for Determining Financial Assistance</inline>.—</heading><chapeau>Selection by the Secretary of recipients of financial assistance under this section shall be based on such criteria as the Secretary considers appropriate, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/1"><num value="1">(1)</num><content> the relationship of the corridor to the Secretary’s national high-speed ground transportation policy;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/2"><num value="2">(2)</num><content> the extent to which the proposed planning focuses on systems which will achieve sustained speeds of 125 mph or greater;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/3"><num value="3">(3)</num><content> the integration of the corridor into metropolitan area and statewide transportation planning;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/4"><num value="4">(4)</num><content> the potential interconnection of the corridor with other parts of the Nation’s transportation system, including the interconnection with other countries;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/5"><num value="5">(5)</num><content> the anticipated effect of the corridor on the congestion of other modes of transportation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/6"><num value="6">(6)</num><content> whether the work to be funded will aid the efforts of State and local governments to comply with the Clean Air Act (<ref href="/us/usc/t42/s7401">42 U.S.C. 7401</ref> et seq.);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/7"><num value="7">(7)</num><content> the past and proposed financial commitments and other support of State and local governments and the private sector to the proposed high-speed rail program, including the acquisition of rolling stock;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/8"><num value="8">(8)</num><content> the estimated level of ridership;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/9"><num value="9">(9)</num><content> the estimated capital cost of corridor improvements, including the cost of closing, improving, or separating highway-rail grade crossings;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeef9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/10"><num value="10">(10)</num><content> rail transportation employment impacts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeefa-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/11"><num value="11">(11)</num><content> community economic impacts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeefb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/12"><num value="12">(12)</num><content> the extent to which the projected revenues of the proposed high-speed rail service, along with any financial commitments of State or local governments and the private sector, are expected to cover capital costs and operating and maintenance expenses;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeefc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/13"><num value="13">(13)</num><content> whether a specific route has been selected, specific improvements identified, and capacity studies completed; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id350eeefd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s26101/c/14"><num value="14">(14)</num><content> whether the corridor has been designated as a high-speed rail corridor by the Secretary.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> new high-speed rail service should not receive Federal subsidies for operating and maintenance expenses;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> State and local governments should take the prime responsibility for the development and implementation of high-speed rail service;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> the private sector should participate in funding the development of high-speed rail systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> in some intercity corridors, Federal planning assistance may be required to supplement the funding commitments of State and local governments and the private sector to ensure the adequate planning, including reasonable estimates of the costs and benefits, of high-speed rail systems;</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> improvement of existing technologies can facilitate the development of high-speed rail systems in the United States; and</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> Federal assistance is required for the improvement, adaptation, and integration of proven technologies for commercial application in high-speed rail service in the United States.</content>
