<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id91aa94f6-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102"><num value="30102">§ 30102.</num><heading> Definitions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id91aa94f7-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a"><num value="a">(a)</num><heading> General Definitions.—</heading><chapeau>In this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91aa94f8-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/1"><num value="1">(1)</num><content> “dealer” means a person selling and distributing new motor vehicles or motor vehicle equipment primarily to purchasers that in good faith purchase the vehicles or equipment other than for resale.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa94f9-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/2"><num value="2">(2)</num><content> “defect” includes any defect in performance, construction, a component, or material of a motor vehicle or motor vehicle equipment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa94fa-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/3"><num value="3">(3)</num><content> “distributor” means a person primarily selling and distributing motor vehicles or motor vehicle equipment for resale.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa94fb-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/4"><num value="4">(4)</num><content> “interstate commerce” means commerce between a place in a State and a place in another State or between places in the same State through another State.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa94fc-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/5"><num value="5">(5)</num><chapeau> “manufacturer” means a person—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id91aa94fd-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/5/A"><num value="A">(A)</num><content> manufacturing or assembling motor vehicles or motor vehicle equipment; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91aa94fe-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/5/B"><num value="B">(B)</num><content> importing motor vehicles or motor vehicle equipment for resale.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa94ff-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/6"><num value="6">(6)</num><content> “motor vehicle” means a vehicle driven or drawn by mechanical power and manufactured primarily for use on public streets, roads, and highways, but does not include a vehicle operated only on a rail line.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa9500-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/7"><num value="7">(7)</num><chapeau> “motor vehicle equipment” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id91aa9501-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/7/A"><num value="A">(A)</num><content> any system, part, or component of a motor vehicle as originally manufactured;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91aa9502-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/7/B"><num value="B">(B)</num><content> any similar part or component manufactured or sold for replacement or improvement of a system, part, or component, or as an accessory or addition to a motor vehicle; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id91aa9503-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/7/C"><num value="C">(C)</num><chapeau> any device or an article or apparel, including a motorcycle helmet and excluding medicine or eyeglasses prescribed by a licensed practitioner, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id91aa9504-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/7/C/i"><num value="i">(i)</num><content> is not a system, part, or component of a motor vehicle; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id91aa9505-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/7/C/ii"><num value="ii">(ii)</num><content> is manufactured, sold, delivered, or offered to be sold for use on public streets, roads, and highways with the apparent purpose of safeguarding users of motor vehicles against risk of accident, injury, or death.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa9506-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/8"><num value="8">(8)</num><content> “motor vehicle safety” means the performance of a motor vehicle or motor vehicle equipment in a way that protects the public against unreasonable risk of accidents occurring because of the design, construction, or performance of a motor vehicle, and against unreasonable risk of death or injury in an accident, and includes nonoperational safety of a motor vehicle.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa9507-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/9"><num value="9">(9)</num><content> “motor vehicle safety standard” means a minimum standard for motor vehicle or motor vehicle equipment performance.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa9508-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/10"><num value="10">(10)</num><content> “State” means a State of the United States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, Guam, American Samoa, and the Virgin Islands.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91aa9509-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/a/11"><num value="11">(11)</num><content> “United States district court” means a district court of the United States, a United States court for Guam, the Virgin Islands, and American Samoa, and the district court for the Northern Mariana Islands.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id91aa950a-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b"><num value="b">(b)</num><heading> Limited Definitions.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id91aa950b-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1"><num value="1">(1)</num><chapeau> In sections 30117(b), 30118–30121, and 30166(f) of this title—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa950c-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/A"><num value="A">(A)</num><content> “adequate repair” does not include repair resulting in substantially impaired operation of a motor vehicle or motor vehicle equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa950d-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/B"><num value="B">(B)</num><content> “first purchaser” means the first purchaser of a motor vehicle or motor vehicle equipment other than for resale;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa950e-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/C"><num value="C">(C)</num><content> “original equipment” means motor vehicle equipment (including a tire) installed in or on a motor vehicle at the time of delivery to the first purchaser;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa950f-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/D"><num value="D">(D)</num><content> “replacement equipment” means motor vehicle equipment (including a tire) that is not original equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa9510-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/E"><num value="E">(E)</num><content> a brand name owner of a tire marketed under a brand name not owned by the manufacturer of the tire is deemed to be the manufacturer of the tire;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa9511-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/F"><num value="F">(F)</num><content> a defect in original equipment, or noncompliance of original equipment with a motor vehicle safety standard prescribed under this chapter, is deemed to be a defect or noncompliance of the motor vehicle in or on which the equipment was installed at the time of delivery to the first purchaser;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa9512-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/G"><num value="G">(G)</num><content> a manufacturer of a motor vehicle in or on which original equipment was installed when delivered to the first purchaser is deemed to be the manufacturer of the equipment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id91aa9513-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/1/H"><num value="H">(H)</num><content> a retreader of a tire is deemed to be the manufacturer of the tire.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id91aa9514-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s30102/b/2"><num value="2">(2)</num><content> The Secretary of Transportation may prescribe regulations changing paragraph (1)(C), (D), (F), or (G) of this subsection.</content>

In clause (10), the word “means” is substituted for “includes” as being more appropriate. The words “a State of the United States” are substituted for “each of the several States” for consistency. The words “the Commonwealth of” are omitted as surplus. In clause (11), the word “Federal” is omitted as surplus. The words “of the Commonwealth of Puerto Rico” are omitted as unnecessary because the district court of Puerto Rico is a district court of the United States under 28:119.</p>
