<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4ab16d87-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s30307"><num value="30307">§ 30307.</num><heading> Criminal penalties</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4ab16d88-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s30307/a"><num value="a">(a)</num><heading> <inline class="small-caps">General Penalty</inline>.—</heading><chapeau>A person (except an individual described in section 30305(b)(6) <ref class="footnoteRef" idref="fn002097">1</ref><note type="footnote" id="fn002097"><num>1</num> See References in Text note below.</note> of this title) shall be fined under title 18, imprisoned for not more than one year, or both, if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4ab16d89-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s30307/a/1"><num value="1">(1)</num><content> the person receives under <ref href="/us/usc/t49/s30305">section 30305 of this title</ref> information specified in section 30304(b)(1)(A) or (C) of this title;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id4ab16d8a-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s30307/a/2"><num value="2">(2)</num><content> disclosure of the information is not authorized by <ref href="/us/usc/t49/s30305">section 30305 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4ab16d8b-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s30307/a/3"><num value="3">(3)</num><content> the person willfully discloses the information knowing that disclosure is not authorized.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id4ab16d8c-8cc4-11e7-9b0c-fe296c75b81c" identifier="/us/usc/t49/s30307/b"><num value="b">(b)</num><heading> <inline class="small-caps">Information Penalty</inline>.—</heading><content>A person knowingly and willfully requesting, or under false pretenses obtaining, information specified in section 30304(b)(1)(A) or (C) of this title from a person receiving the information under <ref href="/us/usc/t49/s30305">section 30305 of this title</ref> shall be fined under title 18, imprisoned for not more than one year, or both.</content>

<p style="-uslm-lc:I21" class="indent0">In subsection (a), before clause (1), the reference to “<ref href="/us/usc/t49/s30305/b/6">section 30305(b)(6) of this title</ref>” is used to carry out the probable intent of Congress. Section 305(b)(1) of the Airport and Airway Safety and Capacity Expansion Act of 1987 (<ref href="/us/pl/100/223">Public Law 100–223</ref>, <ref href="/us/stat/101/1526">101 Stat. 1526</ref>) amended section 206(b) of the National Driver Register Act of 1982 (<ref href="/us/pl/97/364">Public Law 97–364</ref>, <ref href="/us/stat/96/1744">96 Stat. 1744</ref>) by “redesignating paragraphs (3) and (4), and any reference thereto, as paragraphs (4) and (5), respectively”. Because the reference to “section 206(b)(4)” in section 208 of the National Driver Register Act of 1982 appears to have been incorrect before that amendment, and would continue to be incorrect if the reference is redesignated as required by the amendment, a reference to section 30305(b)(6) is used in this section to carry out the probable intent of Congress.</p>
