A, title I, §§ 1301(b), 1302(b), 1303(b), title XI, § 11502(b), Dec. 4, 2015, 129 Stat. 1376, 1378, 1690.)","seq_in_title":19,"parent_identifier":"/us/usc/t49/stI/ch3/schI","ancestors":[{"identifier":"/us/usc/t49","level":"title","num":"Title 49—","heading":"TRANSPORTATION","status":null,"is_section":false},{"identifier":"/us/usc/t49/stI","level":"subtitle","num":"SUBTITLE I—","heading":"DEPARTMENT OF TRANSPORTATION","status":null,"is_section":false},{"identifier":"/us/usc/t49/stI/ch3","level":"chapter","num":"CHAPTER 3—","heading":"GENERAL DUTIES AND POWERS","status":null,"is_section":false},{"identifier":"/us/usc/t49/stI/ch3/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"DUTIES OF THE SECRETARY OF TRANSPORTATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id6541c9a3-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303\"><num value=\"303\">§ 303.</num><heading> Policy on lands, wildlife and waterfowl refuges, and historic sites</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9a4-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/a\"><num value=\"a\">(a)</num><content> It is the policy of the United States Government that special effort should be made to preserve the natural beauty of the countryside and public park and recreation lands, wildlife and waterfowl refuges, and historic sites.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9a5-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/b\"><num value=\"b\">(b)</num><content> The Secretary of Transportation shall cooperate and consult with the Secretaries of the Interior, Housing and Urban Development, and Agriculture, and with the States, in developing transportation plans and programs that include measures to maintain or enhance the natural beauty of lands crossed by transportation activities or facilities.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9a6-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Approval of Programs and Projects</inline>.—</heading><chapeau>Subject to subsections (d) and (h), the Secretary may approve a transportation program or project (other than any project for a park road or parkway under section 204 <ref class=\"footnoteRef\" idref=\"fn002007\">1</ref><note type=\"footnote\" id=\"fn002007\"><num>1</num> See References in Text note below.</note> of title 23) requiring the use of publicly owned land of a public park, recreation area, or wildlife and waterfowl refuge of national, State, or local significance, or land of an historic site of national, State, or local significance (as determined by the Federal, State, or local officials having jurisdiction over the park, area, refuge, or site) only if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9a7-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/c/1\"><num value=\"1\">(1)</num><content> there is no prudent and feasible alternative to using that land; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9a8-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/c/2\"><num value=\"2\">(2)</num><content> the program or project includes all possible planning to minimize harm to the park, recreation area, wildlife and waterfowl refuge, or historic site resulting from the use.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9a9-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d\"><num value=\"d\">(d)</num><heading> De Minimis Impacts.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9aa-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/1\"><num value=\"1\">(1)</num><heading> Requirements.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9ab-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/1/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">Requirements for historic sites</inline>.—</heading><content>The requirements of this section shall be considered to be satisfied with respect to an area described in paragraph (2) if the Secretary determines, in accordance with this subsection, that a transportation program or project will have a de minimis impact on the area.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9ac-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/1/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Requirements for parks, recreation areas, and wildlife or waterfowl refuges</inline>.—</heading><content>The requirements of subsection (c)(1) shall be considered to be satisfied with respect to an area described in paragraph (3) if the Secretary determines, in accordance with this subsection, that a transportation program or project will have a de minimis impact on the area. The requirements of subsection (c)(2) with respect to an area described in paragraph (3) shall not include an alternatives analysis.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9ad-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/1/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Criteria</inline>.—</heading><content>In making any determination under this subsection, the Secretary shall consider to be part of a transportation program or project any avoidance, minimization, mitigation, or enhancement measures that are required to be implemented as a condition of approval of the transportation program or project.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9ae-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Historic sites</inline>.—</heading><chapeau>With respect to historic sites, the Secretary may make a finding of de minimis impact only if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9af-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/2/A\"><num value=\"A\">(A)</num><chapeau> the Secretary has determined, in accordance with the consultation process required under <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref>, United States Code,<ref class=\"footnoteRef\" idref=\"fn002008\">2</ref><note type=\"footnote\" id=\"fn002008\"><num>2</num> So in original. The words “, United States Code” probably should not appear.</note> that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9b0-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/2/A/i\"><num value=\"i\">(i)</num><content> the transportation program or project will have no adverse effect on the historic site; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9b1-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> there will be no historic properties affected by the transportation program or project;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9b2-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/2/B\"><num value=\"B\">(B)</num><content> the finding of the Secretary has received written concurrence from the applicable State historic preservation officer or tribal historic preservation officer (and from the Advisory Council on Historic Preservation if the Council is participating in the consultation process); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9b3-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/2/C\"><num value=\"C\">(C)</num><content> the finding of the Secretary has been developed in consultation with parties consulting as part of the process referred to in subparagraph (A).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9b4-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Parks, recreation areas, and wildlife or waterfowl refuges</inline>.—</heading><chapeau>With respect to parks, recreation areas, or wildlife or waterfowl refuges, the Secretary may make a finding of de minimis impact only if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9b5-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/3/A\"><num value=\"A\">(A)</num><content> the Secretary has determined, after public notice and opportunity for public review and comment, that the transportation program or project will not adversely affect the activities, features, and attributes of the park, recreation area, or wildlife or waterfowl refuge eligible for protection under this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9b6-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/d/3/B\"><num value=\"B\">(B)</num><content> the finding of the Secretary has received concurrence from the officials with jurisdiction over the park, recreation area, or wildlife or waterfowl refuge.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9b7-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e\"><num value=\"e\">(e)</num><heading> Satisfaction of Requirements for Certain Historic Sites.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9b8-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9b9-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/1/A\"><num value=\"A\">(A)</num><content> align, to the maximum extent practicable, the requirements of this section with the requirements of the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.) and <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref>, including implementing regulations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9ba-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/1/B\"><num value=\"B\">(B)</num><content> not later than 90 days after the date of enactment of this subsection, coordinate with the Secretary of the Interior and the Executive Director of the Advisory Council on Historic Preservation (referred to in this subsection as the “Council”) to establish procedures to satisfy the requirements described in subparagraph (A) (including regulations).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9bb-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2\"><num value=\"2\">(2)</num><heading> Avoidance alternative analysis.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9bc-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>If, in an analysis required under the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.), the Secretary determines that there is no feasible or prudent alternative to avoid use of a historic site, the Secretary may—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9bd-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A/i\"><num value=\"i\">(i)</num><content> include the determination of the Secretary in the analysis required under that Act;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9be-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A/ii\"><num value=\"ii\">(ii)</num><chapeau> provide a notice of the determination to—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id6541c9bf-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A/ii/I\"><num value=\"I\">(I)</num><content> each applicable State historic preservation officer and tribal historic preservation officer;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id6541c9c0-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A/ii/II\"><num value=\"II\">(II)</num><content> the Council, if the Council is participating in the consultation process under <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref>; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id6541c9c1-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A/ii/III\"><num value=\"III\">(III)</num><content> the Secretary of the Interior; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9c2-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/A/iii\"><num value=\"iii\">(iii)</num><content> request from the applicable preservation officer, the Council, and the Secretary of the Interior a concurrence that the determination is sufficient to satisfy subsection (c)(1).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9c3-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Concurrence</inline>.—</heading><content>If the applicable preservation officer, the Council, and the Secretary of the Interior each provide a concurrence requested under subparagraph (A)(iii), no further analysis under subsection (c)(1) shall be required.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9c4-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/C\"><num value=\"C\">(C)</num><heading> <inline class=\"small-caps\">Publication</inline>.—</heading><chapeau>A notice of a determination, together with each relevant concurrence to that determination, under subparagraph (A) shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9c5-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/C/i\"><num value=\"i\">(i)</num><content> be included in the record of decision or finding of no significant impact of the Secretary; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id6541c9c6-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/2/C/ii\"><num value=\"ii\">(ii)</num><content> be posted on an appropriate Federal website by not later than 3 days after the date of receipt by the Secretary of all concurrences requested under subparagraph (A)(iii).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9c7-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/3\"><num value=\"3\">(3)</num><heading> Aligning historical reviews.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9c8-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/3/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>If the Secretary, the applicable preservation officer, the Council, and the Secretary of the Interior concur that no feasible and prudent alternative exists as described in paragraph (2), the Secretary may provide to the applicable preservation officer, the Council, and the Secretary of the Interior notice of the intent of the Secretary to satisfy subsection (c)(2) through the consultation requirements of <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6541c9c9-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/e/3/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Satisfaction of conditions</inline>.—</heading><content>To satisfy subsection (c)(2), the applicable preservation officer, the Council, and the Secretary of the Interior shall concur in the treatment of the applicable historic site described in the memorandum of agreement or programmatic agreement developed under <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref>.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9ca-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/f\"><num value=\"f\">(f)</num><heading> References to Past Transportation Environmental Authorities.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9cb-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/f/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Section 4(f) requirements</inline>.—</heading><content>The requirements of this section are commonly referred to as section 4(f) requirements (see section 4(f) of the Department of Transportation Act (<ref href=\"/us/pl/89/670\">Public Law 89–670</ref>; <ref href=\"/us/stat/80/934\">80 Stat. 934</ref>) as in effect before the repeal of that section).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9cc-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/f/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Section 106 requirements</inline>.—</heading><content>The requirements of <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref> are commonly referred to as section 106 requirements (see section 106 of the National Historic Preservation Act of 1966 (<ref href=\"/us/pl/89/665\">Public Law 89–665</ref>; <ref href=\"/us/stat/80/917\">80 Stat. 917</ref>) as in effect before the repeal of that section).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9cd-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/g\"><num value=\"g\">(g)</num><heading> <inline class=\"small-caps\">Bridge Exemption From Consideration</inline>.—</heading><content>A common post-1945 concrete or steel bridge or culvert (as described in 77 Fed. Reg. 68790) that is exempt from individual review under <ref href=\"/us/usc/t54/s306108\">section 306108 of title 54</ref> shall be exempt from consideration under this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6541c9ce-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h\"><num value=\"h\">(h)</num><heading> Rail and Transit.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6541c9cf-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Improvements to, or the maintenance, rehabilitation, or operation of, railroad or rail transit lines or elements thereof that are in use or were historically used for the transportation of goods or passengers shall not be considered a use of a historic site under subsection (c), regardless of whether the railroad or rail transit line or element thereof is listed on, or eligible for listing on, the National Register of Historic Places.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id65443ad0-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2\"><num value=\"2\">(2)</num><heading> Exceptions.—</heading><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id65443ad1-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/A\"><num value=\"A\">(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Paragraph (1) shall not apply to—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id65443ad2-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/A/i\"><num value=\"i\">(i)</num><content> stations; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id65443ad3-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/A/ii\"><num value=\"ii\">(ii)</num><chapeau> bridges or tunnels located on—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id65443ad4-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/A/ii/I\"><num value=\"I\">(I)</num><content> railroad lines that have been abandoned; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id65443ad5-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/A/ii/II\"><num value=\"II\">(II)</num><content> transit lines that are not in use.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id65443ad6-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/B\"><num value=\"B\">(B)</num><heading> <inline class=\"small-caps\">Clarification with respect to certain bridges and tunnels</inline>.—</heading><chapeau>The bridges and tunnels referred to in subparagraph (A)(ii) do not include bridges or tunnels located on railroad or transit lines—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id65443ad7-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/B/i\"><num value=\"i\">(i)</num><content> over which service has been discontinued; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id65443ad8-d385-11e6-bc46-9b7fdee7024f\" identifier=\"/us/usc/t49/s303/h/2/B/ii\"><num value=\"ii\">(ii)</num><content> that have been railbanked or otherwise reserved for the transportation of goods or passengers.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id65443ad9-d385-11e6-bc46-9b7fdee7024f\">(<ref href=\"/us/pl/97/449\">Pub.
