<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id90268c2a-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303"><num value="303">§ 303.</num><heading> Policy on lands, wildlife and waterfowl refuges, and historic sites</heading><subsection style="-uslm-lc:I11" class="indent0" id="id90268c2b-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/a"><num value="a">(a)</num><content> It is the policy of the United States Government that special effort should be made to preserve the natural beauty of the countryside and public park and recreation lands, wildlife and waterfowl refuges, and historic sites.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90268c2c-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/b"><num value="b">(b)</num><content> The Secretary of Transportation shall cooperate and consult with the Secretaries of the Interior, Housing and Urban Development, and Agriculture, and with the States, in developing transportation plans and programs that include measures to maintain or enhance the natural beauty of lands crossed by transportation activities or facilities.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90268c2d-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/c"><num value="c">(c)</num><heading> Approval of Programs and Projects.—</heading><chapeau>Subject to subsection (d), the Secretary may approve a transportation program or project (other than any project for a park road or parkway under section 204 <ref class="footnoteRef" idref="fn002006">1</ref><note type="footnote" id="fn002006"><num>1</num> See References in Text note below.</note> of title 23) requiring the use of publicly owned land of a public park, recreation area, or wildlife and waterfowl refuge of national, State, or local significance, or land of an historic site of national, State, or local significance (as determined by the Federal, State, or local officials having jurisdiction over the park, area, refuge, or site) only if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id90268c2e-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/c/1"><num value="1">(1)</num><content> there is no prudent and feasible alternative to using that land; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90268c2f-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/c/2"><num value="2">(2)</num><content> the program or project includes all possible planning to minimize harm to the park, recreation area, wildlife and waterfowl refuge, or historic site resulting from the use.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id90268c30-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d"><num value="d">(d)</num><heading> De Minimis Impacts.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id90268c31-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/1"><num value="1">(1)</num><heading> Requirements.—</heading><subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c32-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/1/A"><num value="A">(A)</num><heading> Requirements for historic sites.—</heading><content>The requirements of this section shall be considered to be satisfied with respect to an area described in paragraph (2) if the Secretary determines, in accordance with this subsection, that a transportation program or project will have a de minimis impact on the area.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c33-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/1/B"><num value="B">(B)</num><heading> Requirements for parks, recreation areas, and wildlife or waterfowl refuges.—</heading><content>The requirements of subsection (c)(1) shall be considered to be satisfied with respect to an area described in paragraph (3) if the Secretary determines, in accordance with this subsection, that a transportation program or project will have a de minimis impact on the area. The requirements of subsection (c)(2) with respect to an area described in paragraph (3) shall not include an alternatives analysis.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c34-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/1/C"><num value="C">(C)</num><heading> Criteria.—</heading><content>In making any determination under this subsection, the Secretary shall consider to be part of a transportation program or project any avoidance, minimization, mitigation, or enhancement measures that are required to be implemented as a condition of approval of the transportation program or project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90268c35-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/2"><num value="2">(2)</num><heading> Historic sites.—</heading><chapeau>With respect to historic sites, the Secretary may make a finding of de minimis impact only if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c36-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/2/A"><num value="A">(A)</num><chapeau> the Secretary has determined, in accordance with the consultation process required under section 106 of the National Historic Preservation Act (<ref href="/us/usc/t16/s470f">16 U.S.C. 470f</ref>), that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id90268c37-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/2/A/i"><num value="i">(i)</num><content> the transportation program or project will have no adverse effect on the historic site; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id90268c38-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/2/A/ii"><num value="ii">(ii)</num><content> there will be no historic properties affected by the transportation program or project;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c39-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/2/B"><num value="B">(B)</num><content> the finding of the Secretary has received written concurrence from the applicable State historic preservation officer or tribal historic preservation officer (and from the Advisory Council on Historic Preservation if the Council is participating in the consultation process); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c3a-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/2/C"><num value="C">(C)</num><content> the finding of the Secretary has been developed in consultation with parties consulting as part of the process referred to in subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id90268c3b-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/3"><num value="3">(3)</num><heading> Parks, recreation areas, and wildlife or waterfowl refuges.—</heading><chapeau>With respect to parks, recreation areas, or wildlife or waterfowl refuges, the Secretary may make a finding of de minimis impact only if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c3c-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/3/A"><num value="A">(A)</num><content> the Secretary has determined, after public notice and opportunity for public review and comment, that the transportation program or project will not adversely affect the activities, features, and attributes of the park, recreation area, or wildlife or waterfowl refuge eligible for protection under this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id90268c3d-3691-11e3-925d-b2b792679ef3" identifier="/us/usc/t49/s303/d/3/B"><num value="B">(B)</num><content> the finding of the Secretary has received concurrence from the officials with jurisdiction over the park, recreation area, or wildlife or waterfowl refuge.</content>
</subparagraph>
