and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id39d7633d-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/a/2/B\"><num value=\"B\">(B)</num><chapeau> has determined that the components of the project that fall under the modal expertise of the lead authority—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id39d7633e-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/a/2/B/i\"><num value=\"i\">(i)</num><content> satisfy the conditions for a categorical exclusion under implementing regulations or procedures of the lead authority under the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id39d7633f-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/a/2/B/ii\"><num value=\"ii\">(ii)</num><content> do not require the preparation of an environmental assessment or environmental impact statement under that Act.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d76340-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/a/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Multimodal project</inline>.—</heading><content>The term “multimodal project” has the meaning given the term in <ref href=\"/us/usc/t23/s139/a\">section 139(a) of title 23</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id39d76341-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Exercise of Authorities</inline>.—</heading><content>The authorities granted in this section may be exercised for a multimodal project, class of projects, or program of projects that are carried out under this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id39d76342-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Application of Categorical Exclusions for Multimodal Projects</inline>.—</heading><chapeau>In considering the environmental impacts of a proposed multimodal project, a lead authority may apply a categorical exclusion designated under the implementing regulations or procedures of a cooperating authority for other components of the project, subject to the conditions that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d76343-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/1\"><num value=\"1\">(1)</num><content> the multimodal project is funded under 1 grant agreement administered by the lead authority;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d76344-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/2\"><num value=\"2\">(2)</num><content> the multimodal project has components that require the expertise of a cooperating authority to assess the environmental impacts of the components;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d76345-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/3\"><num value=\"3\">(3)</num><content> the component of the project to be covered by the categorical exclusion of the cooperating authority has independent utility;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d76346-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/4\"><num value=\"4\">(4)</num><chapeau> the cooperating authority, in consultation with the lead authority—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id39d76347-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/4/A\"><num value=\"A\">(A)</num><content> follows implementing regulations or procedures under the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id39d76348-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/4/B\"><num value=\"B\">(B)</num><content> determines that a categorical exclusion under that Act applies to the components; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d76349-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/5\"><num value=\"5\">(5)</num><chapeau> the lead authority has determined that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id39d7634a-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/5/A\"><num value=\"A\">(A)</num><content> the project, using the categorical exclusions of the lead authority and each applicable cooperating authority, does not individually or cumulatively have a significant impact on the environment; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id39d7634b-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/c/5/B\"><num value=\"B\">(B)</num><content> extraordinary circumstances do not exist that merit additional analysis and documentation in an environmental impact statement or environmental assessment required under the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id39d7634c-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/d\"><num value=\"d\">(d)</num><heading> Modal Cooperation.—</heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d7634d-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>A cooperating authority shall provide modal expertise to the lead authority on such aspects of the multimodal project in which the cooperating authority has expertise.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id39d7634e-3bf5-11e3-a342-84d17a7c85b8\" identifier=\"/us/usc/t49/s304/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Use of categorical exclusion</inline>.—</heading><content>In a case described in paragraph (1), the 1 or more categorical exclusions of a cooperating authority may be applied by the lead authority once the cooperating authority reviews the project on behalf of the lead authority and determines the project satisfies the conditions for a categorical exclusion under the implementing regulations or procedures of the cooperating authority under the National Environmental Policy Act of 1969 (<ref href=\"/us/usc/t42/s4321\">42 U.S.C. 4321</ref> et seq.) and this section.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id39d7634f-3bf5-11e3-a342-84d17a7c85b8\">(<ref href=\"/us/pl/97/449/s1/b\">Pub.
