<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id34660488-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304"><num value="304">§ 304.</num><heading> Application of categorical exclusions for multimodal projects</heading><subsection style="-uslm-lc:I11" class="indent0" id="id34660489-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/a"><num value="a">(a)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3466048a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Cooperating authority</inline>.—</heading><content>The term “cooperating authority” means a Department of Transportation operating administration or secretarial office that has expertise but is not the lead authority with respect to a proposed multimodal project.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3466048b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Lead authority</inline>.—</heading><content>The term “lead authority” means a Department of Transportation operating administration or secretarial office that has the lead responsibility for compliance with the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.) with respect to a proposed multimodal project.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3466048c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Multimodal project</inline>.—</heading><content>The term “multimodal project” has the meaning given the term in <ref href="/us/usc/t23/s139/a">section 139(a) of title 23</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3466048d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/b"><num value="b">(b)</num><heading> <inline class="small-caps">Exercise of Authorities</inline>.—</heading><content>The authorities granted in this section may be exercised for a multimodal project, class of projects, or program of projects that are carried out under this title or title 23.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3466048e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c"><num value="c">(c)</num><heading> <inline class="small-caps">Application of Categorical Exclusions for Multimodal Projects</inline>.—</heading><chapeau>In considering the environmental impacts of a proposed multimodal project, a lead authority may apply categorical exclusions designated under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.) in implementing regulations or procedures of a cooperating authority for a proposed multimodal project, subject to the conditions that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3466048f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/1"><num value="1">(1)</num><chapeau> the lead authority makes a determination, with the concurrence of the cooperating authority—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34660490-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/1/A"><num value="A">(A)</num><content> on the applicability of a categorical exclusion to a proposed multimodal project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34660491-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/1/B"><num value="B">(B)</num><content> that the project satisfies the conditions for a categorical exclusion under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref> et seq.) and this section;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34660492-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/2"><num value="2">(2)</num><content> the lead authority follows the implementing regulations of the cooperating authority or procedures under that Act; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id34660493-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/3"><num value="3">(3)</num><chapeau> the lead authority determines that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id34660494-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/3/A"><num value="A">(A)</num><content> the proposed multimodal project does not individually or cumulatively have a significant impact on the environment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id34660495-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/c/3/B"><num value="B">(B)</num><content> extraordinary circumstances do not exist that merit additional analysis and documentation in an environmental impact statement or environmental assessment required under that Act.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id34660496-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s304/d"><num value="d">(d)</num><heading> <inline class="small-caps">Cooperating Authority Expertise</inline>.—</heading><content>A cooperating authority shall provide expertise to the lead authority on aspects of the multimodal project in which the cooperating authority has expertise.</content>
