<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id333c74e8-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305"><num value="305">§ 305.</num><heading> Transportation investment standards and criteria</heading><subsection style="-uslm-lc:I11" class="indent0" id="id333c74e9-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a"><num value="a">(a)</num><chapeau> Subject to sections 301–304 <ref class="footnoteRef" idref="fn002008">1</ref><note type="footnote" id="fn002008"><num>1</num> See References in Text note below.</note> of this title, the Secretary of Transportation shall develop standards and criteria to formulate and economically evaluate all proposals for investing amounts of the United States Government in transportation facilities and equipment. Based on experience, the Secretary shall revise the standards and criteria. When approved by Congress, the Secretary shall prescribe standards and criteria developed or revised under this subsection. This subsection does not apply to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id333c74ea-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a/1"><num value="1">(1)</num><content> the acquisition of transportation facilities or equipment by a department, agency, or instrumentality of the Government to provide transportation for its use;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74eb-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a/2"><num value="2">(2)</num><content> an inter-oceanic canal located outside the 48 contiguous States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74ec-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a/3"><num value="3">(3)</num><content> defense features included at the direction of the Department of Defense in designing and constructing civil air, sea, or land transportation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74ed-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a/4"><num value="4">(4)</num><content> foreign assistance programs;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74ee-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a/5"><num value="5">(5)</num><content> water resources projects; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74ef-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/a/6"><num value="6">(6)</num><content> grant-in-aid programs authorized by law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id333c74f0-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b"><num value="b">(b)</num><chapeau> A department, agency, or instrumentality of the Government preparing a survey, plan, or report that includes a proposal about which the Secretary has prescribed standards and criteria under subsection (a) of this section shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id333c74f1-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/1"><num value="1">(1)</num><chapeau> prepare the survey, plan, or report under those standards and criteria and on the basis of information provided by the Secretary on the—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id333c74f2-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/1/A"><num value="A">(A)</num><content> projected growth of transportation needs and traffic in the affected area;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id333c74f3-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/1/B"><num value="B">(B)</num><content> the relative efficiency of various modes of transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id333c74f4-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/1/C"><num value="C">(C)</num><content> the available transportation services in the area; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id333c74f5-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/1/D"><num value="D">(D)</num><content> the general effect of the proposed investment on existing modes of transportation and on the regional and national economy;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74f6-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/2"><num value="2">(2)</num><chapeau> coordinate the survey, plan, or report—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id333c74f7-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/2/A"><num value="A">(A)</num><content> with the Secretary and include the views and comments of the Secretary; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id333c74f8-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/2/B"><num value="B">(B)</num><content> as appropriate, with other departments, agencies, and instrumentalities of the Government, States, and local governments, and include their views and comments; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id333c74f9-d303-11e4-8034-f3e3fd751ed4" identifier="/us/usc/t49/s305/b/3"><num value="3">(3)</num><content> send the survey, plan, or report to the President for disposition under law and procedure established by the President.</content>

<p style="-uslm-lc:I21" class="indent0">In subsection (a), before clause (1), the words “consistent with national transportation policies” after “develop standards and criteria” are omitted as unnecessary because of section 302 of the revised title.
