<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida4628270-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308"><num value="308">§ 308.</num><heading> Reports</heading><subsection style="-uslm-lc:I11" class="indent0" id="ida4628271-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/a"><num value="a">(a)</num><content> As soon as practicable after the end of each fiscal year, the Secretary of Transportation shall report to the President, for submission to Congress, on the activities of the Department of Transportation during the prior fiscal year.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida4628272-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/b"><num value="b">(b)</num><chapeau> The Secretary shall submit to Congress each year a report on the conditions of the public ports of the United States, including the—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida4628273-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/b/1"><num value="1">(1)</num><content> economic and technological development of the ports;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4628274-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/b/2"><num value="2">(2)</num><content> extent to which the ports contribute to the national welfare and security; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida4628275-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/b/3"><num value="3">(3)</num><content> factors that may impede the continued development of the ports.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="ida4628276-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/c"><num value="c">(c)</num><paragraph style="-uslm-lc:I11" class="indent0" id="ida4628277-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/c/1"><num value="1">(1)</num><content> The Secretary shall submit to Congress in March 1998, and in March of each even-numbered year thereafter, a report of estimates by the Secretary on the current performance and condition of public mass transportation systems with recommendations for necessary administrative or legislative changes.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida4628278-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s308/c/2"><num value="2">(2)</num><content> In reporting to Congress under this subsection, the Secretary shall prepare a complete assessment of public transportation facilities in the United States. The Secretary also shall assess future needs for those facilities and estimate future capital requirements and operation and maintenance requirements for one-year, 5-year, and 10-year periods at specified levels of service.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Requirement</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act [<date date="2021-11-15">Nov. 15, 2021</date>], and annually thereafter, the Secretary [of Transportation] shall submit to Congress a report on covered projects of the Department, which shall include, for each covered project—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> a brief description of the covered project, including—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the purpose of the covered project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> each location in which the covered project is carried out;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> the contract or award number of the covered project, if applicable;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> the year in which the covered project was initiated;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> the Federal share of the total cost of the covered project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> each primary contractor, subcontractor, grant recipient, and subgrantee recipient of the covered project;</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Notification</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act [<date date="2021-11-15">Nov. 15, 2021</date>], and not less frequently than biannually thereafter until the applicable covered rulemaking is complete, the Secretary [of Transportation] shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a written notification that includes, with respect to each covered rulemaking—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><chapeau> for a covered rulemaking with a statutory deadline for completion—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> an explanation of why the deadline was not met; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> an expected date of completion of the covered rulemaking; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> for a covered rulemaking without a statutory deadline for completion, an expected date of completion of the covered rulemaking.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Additional Contents</inline>.—</heading><chapeau>A notification under subsection (b) shall include, for each applicable covered rulemaking—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> an updated timeline;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> a list of factors causing delays in the completion of the covered rulemaking; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> any other details associated with the status of the covered rulemaking.”</content>
