<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id88e00402-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101"><num value="31101">§ 31101.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id88e00403-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/1"><num value="1">(1)</num><chapeau> “commercial motor vehicle” means (except in section 31106) a self-propelled or towed vehicle used on the highways in commerce principally to transport passengers or cargo, if the vehicle—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id88e00404-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/1/A"><num value="A">(A)</num><content> has a gross vehicle weight rating or gross vehicle weight of at least 10,001 pounds, whichever is greater;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id88e00405-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/1/B"><num value="B">(B)</num><content> is designed to transport more than 10 passengers including the driver; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id88e00406-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/1/C"><num value="C">(C)</num><content> is used in transporting material found by the Secretary of Transportation to be hazardous under <ref href="/us/usc/t49/s5103">section 5103 of this title</ref> and transported in a quantity requiring placarding under regulations prescribed by the Secretary under section 5103.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88e00407-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/2"><num value="2">(2)</num><chapeau> “employee” means a driver of a commercial motor vehicle (including an independent contractor when personally operating a commercial motor vehicle), a mechanic, a freight handler, or an individual not an employer, who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id88e00408-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/2/A"><num value="A">(A)</num><content> directly affects commercial motor vehicle safety in the course of employment by a commercial motor carrier; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id88e00409-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/2/B"><num value="B">(B)</num><content> is not an employee of the United States Government, a State, or a political subdivision of a State acting in the course of employment.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88e0040a-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/3"><num value="3">(3)</num><chapeau> “employer”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id88e0040b-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/3/A"><num value="A">(A)</num><content> means a person engaged in a business affecting commerce that owns or leases a commercial motor vehicle in connection with that business, or assigns an employee to operate the vehicle in commerce; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id88e0040c-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/3/B"><num value="B">(B)</num><content> does not include the Government, a State, or a political subdivision of a State.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id88e0040d-a3d3-11e9-a7cd-8d0abbe94c89" identifier="/us/usc/t49/s31101/4"><num value="4">(4)</num><content> “State” means a State of the United States, the District of Columbia, Puerto Rico, the Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands.</content>
