<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3539cf37-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701"><num value="31701">§ 31701.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3539cf38-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/1"><num value="1">(1)</num><chapeau> “commercial motor vehicle”, with respect to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3539cf39-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/1/A"><num value="A">(A)</num><content> the International Registration Plan, has the same meaning given the term “apportionable vehicle” under the Plan; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3539cf3a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/1/B"><num value="B">(B)</num><content> the International Fuel Tax Agreement, has the same meaning given the term “qualified motor vehicle” under the Agreement.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3539cf3b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/2"><num value="2">(2)</num><content> “fuel use tax” means a tax imposed on or measured by the consumption of fuel in a motor vehicle.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3539cf3c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/3"><num value="3">(3)</num><content> “International Fuel Tax Agreement” means the interstate agreement on collecting and distributing fuel use taxes paid by motor carriers, developed under the auspices of the National Governors’ Association.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3539cf3d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/4"><num value="4">(4)</num><content> “International Registration Plan” means the interstate agreement on apportioning vehicle registration fees paid by motor carriers, developed by the American Association of Motor Vehicle Administrators.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3539cf3e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/5"><num value="5">(5)</num><content> “Regional Fuel Tax Agreement” means the interstate agreement on collecting and distributing fuel use taxes paid by motor carriers in the States of Maine, Vermont, and New Hampshire.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id3539cf3f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s31701/6"><num value="6">(6)</num><content> “State” means the 48 contiguous States and the District of Columbia.</content>

C, title I</ref>, § 109, <date date="1998-10-21">Oct. 21, 1998</date>, <ref href="/us/stat/112/2681-586">112 Stat. 2681–586</ref>, provided that:<quotedContent origin="/us/pl/105/277/dC/tI">
<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Registration of Trailers</inline>.—</heading><chapeau>A State that requires annual registration of container chassis and the apportionment of fees for such registrations in accordance with the International Registration Plan (as defined under <ref href="/us/usc/t49/s31701">section 31701 of title 49</ref>, United States Code) shall not limit the operation, or require the registration, in the State of a container chassis (or impose fines or penalties on the operation of a container chassis for being operated in the State without a registration issued by the State) if such chassis—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> is registered under the laws of another State; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> is operating under a trip permit issued by the State.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Limitation on Registration of Trailers</inline>.—</heading><content>A State described in subsection (a) may not deny the use of trip permits for the operation in the State of a container chassis that is registered under the laws of another State.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Safety Regulation</inline>.—</heading><content>This section shall apply to registration requirements only and shall not affect the ability of the State to regulate for safety.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Penalties</inline>.—</heading><content>No State described in subsection (a), political subdivision of such a State, or person may impose or collect any fee, penalty, fine, or other form of damages which is based in whole or in part upon the nonpayment of a State registration fee (including related weight and licensing fees assessed as part of registration) attributable to a container chassis operated in the State (and registered in another State) before the date of enactment of this Act [<date date="1998-10-21">Oct. 21, 1998</date>], unless it is shown by the State, political subdivision, or person that such container chassis was not operated in the State under a trip permit issued by the State.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Container Chassis Defined</inline>.—</heading><content>In this section, the term ‘container chassis’ means a trailer, semi-trailer, or auxiliary axle used exclusively for the transportation of ocean shipping containers.”</content>
