<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8cdcdbe2-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322"><num value="322">§ 322.</num><heading> General powers</heading><subsection style="-uslm-lc:I11" class="indent0" id="id8cdcdbe3-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/a"><num value="a">(a)</num><content> The Secretary of Transportation may prescribe regulations to carry out the duties and powers of the Secretary. An officer of the Department of Transportation may prescribe regulations to carry out the duties and powers of the officer.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8cdcdbe4-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/b"><num value="b">(b)</num><content> The Secretary may delegate, and authorize successive delegations of, duties and powers of the Secretary to an officer or employee of the Department. An officer of the Department may delegate, and authorize successive delegations of, duties and powers of the officer to another officer or employee of the Department. However, the duties and powers specified in sections 103(c)(1),<ref class="footnoteRef" idref="fn002013">1</ref><note type="footnote" id="fn002013"><num>1</num> See References in Text note below.</note> 104(c)(1), and 106(g)(1) <ref class="footnoteRef" idref="fn002013">1</ref> of this title may not be delegated to an officer or employee outside the Administration concerned.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8cdcdbe5-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/c"><num value="c">(c)</num><chapeau> On a reimbursable basis when appropriate, the Secretary may, in carrying out aviation duties and powers—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbe6-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/c/1"><num value="1">(1)</num><content> use the available services, equipment, personnel, and facilities of other civilian or military departments, agencies, and instrumentalities of the United States Government, with their consent;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbe7-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/c/2"><num value="2">(2)</num><content> cooperate with those departments, agencies, and instrumentalities in establishing and using aviation services, equipment, and facilities of the Department; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbe8-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/c/3"><num value="3">(3)</num><content> confer and cooperate with, and use the services, records, and facilities of, State, territorial, municipal, and other agencies.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8cdcdbe9-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d"><num value="d">(d)</num><chapeau> The Secretary may make expenditures to carry out aviation duties and powers, including expenditures for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbea-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/1"><num value="1">(1)</num><content> rent and personal services;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbeb-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/2"><num value="2">(2)</num><content> travel expenses;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbec-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/3"><num value="3">(3)</num><content> office furniture, equipment, supplies, lawbooks, newspapers, periodicals, and reference books, including exchanges;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbed-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/4"><num value="4">(4)</num><content> printing and binding;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbee-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/5"><num value="5">(5)</num><content> membership in and cooperation with domestic or foreign organizations related to, or a part of, the civil aeronautics industry or the art of aeronautics;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbef-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/6"><num value="6">(6)</num><content> payment of allowances and other benefits to employees stationed in foreign countries to the same extent authorized for members of the Foreign Service of comparable grade;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbf0-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/7"><num value="7">(7)</num><content> investigations and studies about aeronautics; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbf1-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/d/8"><num value="8">(8)</num><content> acquiring, exchanging, operating, and maintaining passenger-carrying aircraft and automobiles and other property.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id8cdcdbf2-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/e"><num value="e">(e)</num><chapeau> The Secretary may negotiate, without advertising, the purchase of technical or special property related to air navigation when the Secretary decides that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8cdcdbf3-e004-11ef-b5ac-fd00791f7f55" identifier="/us/usc/t49/s322/e/1"><num value="1">(1)</num><content> making the property would require a substantial initial investment or an extended period of preparation; and</content>
