<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idbe0d1c5c-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302"><num value="32302">§ 32302.</num><heading> Passenger motor vehicle information</heading><subsection style="-uslm-lc:I11" class="indent0" id="idbe0d1c5d-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/a"><num value="a">(a)</num><heading> <inline class="small-caps">Information Program</inline>.—</heading><chapeau>The Secretary of Transportation shall maintain a program for developing the following information on passenger motor vehicles:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idbe0d1c5e-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/a/1"><num value="1">(1)</num><content> damage susceptibility.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe0d1c5f-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/a/2"><num value="2">(2)</num><content> crashworthiness, crash avoidance, and any other areas the Secretary determines will improve the safety of passenger motor vehicles.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe0d1c60-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/a/3"><num value="3">(3)</num><content> the degree of difficulty of diagnosis and repair of damage to, or failure of, mechanical and electrical systems.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbe0d1c61-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/b"><num value="b">(b)</num><heading> <inline class="small-caps">Motor Vehicle Information</inline>.—</heading><content>To assist a consumer in buying a passenger motor vehicle, the Secretary shall provide to the public information developed under subsection (a) of this section. The information shall be in a simple and understandable form that allows comparison of the characteristics referred to in subsection (a)(1)–(3) of this section among the makes and models of passenger motor vehicles. The Secretary may require passenger motor vehicle dealers to distribute the information to prospective buyers. The Secretary, after providing an opportunity for public comment, shall study and report to Congress the most useful data, format, and method for providing simple and understandable damage susceptibility information to consumers.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbe0d1c62-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/c"><num value="c">(c)</num><heading> <inline class="small-caps">Crash Avoidance</inline>.—</heading><content>Not later than 1 year after the date of enactment of the Safety Through Informed Consumers Act of 2015, the Secretary shall promulgate a rule to ensure that crash avoidance information is indicated next to crashworthiness information on stickers placed on motor vehicles by their manufacturers.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idbe0d1c63-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/d"><num value="d">(d)</num><heading> Motor Vehicle Defect Reporting Information.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="idbe0d1c64-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">Rulemaking required</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of the Motor Vehicle and Highway Safety Improvement Act of 2012, the Secretary shall prescribe regulations that require passenger motor vehicle manufacturers—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idbe0d1c65-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/d/1/A"><num value="A">(A)</num><content> to affix, in the glove compartment or in another readily accessible location on the vehicle, a sticker, decal, or other device that provides, in simple and understandable language, information about how to submit a safety-related motor vehicle defect complaint to the National Highway Traffic Safety Administration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe0d1c66-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/d/1/B"><num value="B">(B)</num><content> to prominently print the information described in subparagraph (A) within the owner’s manual; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idbe0d1c67-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/d/1/C"><num value="C">(C)</num><content> to not place such information on the label required under section 3 of the Automobile Information Disclosure Act (<ref href="/us/usc/t15/s1232">15 U.S.C. 1232</ref>).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idbe0d1c68-446e-11e6-a06d-b85fa88fc7ef" identifier="/us/usc/t49/s32302/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Application</inline>.—</heading><content>The requirements under paragraph (1) shall apply to passenger motor vehicles manufactured in any model year beginning more than 1 year after the date on which a final rule is published under paragraph (1).</content>
