<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1fb47c05-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329"><num value="329">§ 329.</num><heading> Transportation information</heading><subsection style="-uslm-lc:I11" class="indent0" id="id1fb47c06-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/a"><num value="a">(a)</num><content> The Secretary of Transportation may collect and collate transportation information the Secretary decides will contribute to the improvement of the transportation system of the United States. To the greatest practical extent, the Secretary shall use information available from departments, agencies, and instrumentalities of the United States Government and other sources. To the extent practical, the Secretary shall make available to other Government departments, agencies, and instrumentalities and to the public the information collected under this subsection.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1fb47c07-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/b"><num value="b">(b)</num><chapeau> The Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1fb47c08-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/b/1"><num value="1">(1)</num><content> collect and disseminate information on civil aeronautics (other than that collected and disseminated by the National Transportation Safety Board under chapter 11 of this title) including, at a minimum, information on (A) the origin and destination of passengers in interstate air transportation (as that term is used in part A of subtitle VII of this title), and (B) the number of passengers traveling by air between any two points in interstate air transportation; except that in no case shall the Secretary require an air carrier to provide information on the number of passengers or the amount of cargo on a specific flight if the flight and the flight number under which such flight operates are used solely for interstate air transportation and are not used for providing essential air transportation under subchapter II of chapter 417 of this title;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1fb47c09-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/b/2"><num value="2">(2)</num><content> study the possibilities of developing air commerce and the aeronautical industry; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1fb47c0a-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/b/3"><num value="3">(3)</num><content> exchange information on civil aeronautics with governments of foreign countries through appropriate departments, agencies, and instrumentalities of the Government.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1fb47c0b-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c"><num value="c">(c)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id1fb47c0c-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c/1"><num value="1">(1)</num><chapeau> On the written request of a person, a State, territory, or possession of the United States, or a political subdivision of a State, territory, or possession, the Secretary may—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id1fb47c0d-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c/1/A"><num value="A">(A)</num><content> make special statistical studies on foreign and domestic transportation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id1fb47c0e-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c/1/B"><num value="B">(B)</num><content> make special studies on other matters related to duties and powers of the Secretary;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id1fb4a31f-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c/1/C"><num value="C">(C)</num><content> prepare, from records of the Department of Transportation, special statistical compilations; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id1fb4a320-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c/1/D"><num value="D">(D)</num><content> provide transcripts of studies, tables, and other records of the Department.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id1fb4a321-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/c/2"><num value="2">(2)</num><content> The person or governmental authority requesting information under paragraph (1) of this subsection must pay the actual cost of preparing the information. Payments shall be deposited in the Treasury in an account that the Secretary shall administer. The Secretary may use amounts in the account for the ordinary expenses incidental to getting and providing the information.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1fb4a322-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/d"><num value="d">(d)</num><content> To assist in carrying out duties and powers under part A of subtitle VII of this title, the Secretary of Transportation shall maintain separate cooperative agreements with the Secretary of Defense and the Administrator of the National Aeronautics and Space Administration for the timely exchange of information on their programs, policies, and requirements directly related to carrying out that part.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id1fb4a323-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/e"><num value="e">(e)</num><heading> Incidents and Complaints Involving Passenger and Baggage Security Screening.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id1fb4a324-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">Publication of data</inline>.—</heading><content>The Secretary of Transportation shall publish data on incidents and complaints involving passenger and baggage security screening in a manner comparable to other consumer complaint and incident data.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1fb4a325-09f5-11e9-a4c5-af35bc4d9bff" identifier="/us/usc/t49/s329/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Monthly reports from secretary of homeland security</inline>.—</heading><content>To assist in the publication of data under paragraph (1), the Secretary of Transportation may request the Secretary of Homeland Security to periodically report on the number of complaints about security screening received by the Secretary of Homeland Security.</content>

L. 115–271, title VIII</ref>, § 8103, <date date="2018-10-24">Oct. 24, 2018</date>, <ref href="/us/stat/132/4104">132 Stat. 4104</ref>, provided that:<quotedContent origin="/us/pl/115/271/tVIII">
<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Subject to subsection (c), the Secretary of Transportation shall—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> not later than <date date="2019-03-31">March 31, 2019</date>, establish and make publicly available on its website a database of the drug and alcohol testing data reported by employers for each mode of transportation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> update the database annually.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Contents</inline>.—</heading><chapeau>The database under subsection (a) shall include, for each mode of transportation—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the total number of drug and alcohol tests by type of substance tested;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the drug and alcohol test results by type of substance tested;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the reason for the drug or alcohol test, such as pre-employment, random, post-accident, reasonable suspicion or cause, return-to-duty, or follow-up, by type of substance tested; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> the number of individuals who refused testing.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Commercially Sensitive Data</inline>.—</heading><content>The Department of Transportation shall not release any commercially sensitive data or personally identifiable data furnished by an employer under this section unless the data is aggregated or otherwise in a form that does not identify the employer providing the data.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Savings Clause</inline>.—</heading><content>Nothing in this section may be construed as limiting or otherwise affecting the requirements of the Secretary of Transportation to adhere to requirements applicable to confidential business information and sensitive security information, consistent with applicable law.”</content>
