L. 103–272, § 1(e), July 5, 1994, 108 Stat. 1078.)","seq_in_title":770,"parent_identifier":"/us/usc/t49/stVI/ptC/ch331","ancestors":[{"identifier":"/us/usc/t49","level":"title","num":"Title 49—","heading":"TRANSPORTATION","status":null,"is_section":false},{"identifier":"/us/usc/t49/stVI","level":"subtitle","num":"SUBTITLE VI—","heading":"MOTOR VEHICLE AND DRIVER PROGRAMS","status":null,"is_section":false},{"identifier":"/us/usc/t49/stVI/ptC","level":"part","num":"PART C—","heading":"INFORMATION, STANDARDS, AND REQUIREMENTS","status":null,"is_section":false},{"identifier":"/us/usc/t49/stVI/ptC/ch331","level":"chapter","num":"CHAPTER 331—","heading":"THEFT PREVENTION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id3545b6df-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103\"><num value=\"33103\">§ 33103.</num><heading> Theft prevention standard for other lines</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e0-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">General</inline>.—</heading><content>Not later than <date date=\"1994-10-25\">October 25, 1994</date>, the Secretary of Transportation shall prescribe a vehicle theft standard that conforms to the requirements of this chapter for covered major parts that manufacturers install in passenger motor vehicles (except light duty trucks) in not more than 50 percent of the lines not designated under <ref href=\"/us/usc/t49/s33104\">section 33104 of this title</ref> as high theft lines.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e1-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Extension of Application</inline>.—</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e2-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/b/1\"><num value=\"1\">(1)</num><chapeau> Not later than 3 years after the standard is prescribed under subsection (a) of this section and based on the finding of the Attorney General under subsection (c) of this section to apply the standard, the Secretary shall apply that standard to covered major parts and major replacement parts for covered parts that manufacturers install in the lines of passenger motor vehicles (except light duty trucks)—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6e3-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/b/1/A\"><num value=\"A\">(A)</num><content> not designated under <ref href=\"/us/usc/t49/s33104\">section 33104 of this title</ref> as high theft lines; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6e4-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/b/1/B\"><num value=\"B\">(B)</num><content> not covered by the standard prescribed under subsection (a) of this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e5-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/b/2\"><num value=\"2\">(2)</num><content> The Secretary shall include as part of the regulatory proceeding under this subsection the finding of, and the record developed by, the Attorney General under subsection (c) of this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e6-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Initial Review of Effectiveness</inline>.—</heading><content>Before the Secretary begins a regulatory proceeding under subsection (b) of this section, the Attorney General shall make a finding that the Secretary shall apply the standard prescribed under subsection (a) of this section unless the Attorney General finds, based on information collected and analyzed under section 33112 <ref class=\"footnoteRef\" idref=\"fn002122\">1</ref><note type=\"footnote\" id=\"fn002122\"><num>1</num> See References in Text note below.</note> of this title and other information the Attorney General develops after providing notice and an opportunity for a public hearing, that applying the standard prescribed in subsection (a) to the remaining lines of passenger motor vehicles (except light duty trucks) not covered by that standard would not substantially inhibit chop shop operations and motor vehicle thefts. The Attorney General also shall consider and include in the record additional costs, effectiveness, competition, and available alternative factors. The Attorney General shall submit to the Secretary the finding and record on which the finding is based.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e7-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Long Range Review of Effectiveness</inline>.—</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6e8-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/1\"><num value=\"1\">(1)</num><chapeau> Not later than <date date=\"1999-12-31\">December 31, 1999</date>, the Attorney General shall make separate findings, after notice and an opportunity for a public hearing, on the following:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6e9-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/1/A\"><num value=\"A\">(A)</num><content> whether the application of the standard under subsection (a) or (b) of this subsection, or both, have been effective in substantially inhibiting the operation of chop shops and motor vehicle theft.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6ea-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/1/B\"><num value=\"B\">(B)</num><content> whether the anti-theft devices for which the Secretary has granted exemptions under <ref href=\"/us/usc/t49/s33106\">section 33106 of this title</ref> are an effective substitute for parts marking in substantially inhibiting motor vehicle theft.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6eb-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6ec-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/A\"><num value=\"A\">(A)</num><chapeau> In making the finding under paragraph (1)(A) of this subsection, the Attorney General shall—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6ed-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/A/i\"><num value=\"i\">(i)</num><content> consider the additional cost, competition, and available alternatives;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6ee-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> base that finding on information collected and analyzed under section 33112 <sup>1</sup> of this title;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6ef-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/A/iii\"><num value=\"iii\">(iii)</num><content> consider the effectiveness, the extent of use, and the extent to which civil and criminal penalties under <ref href=\"/us/usc/t49/s33115/b\">section 33115(b) of this title</ref> and <ref href=\"/us/usc/t18/s2322\">section 2322 of title 18</ref> on chop shops have been effective in substantially inhibiting operation of chop shops and motor vehicle theft;</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6f0-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/A/iv\"><num value=\"iv\">(iv)</num><content> base that finding on the 3-year and 5-year reports issued by the Secretary under <ref href=\"/us/usc/t49/s33113\">section 33113 of this title</ref>; and</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6f1-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/A/v\"><num value=\"v\">(v)</num><content> base that finding on other information the Attorney General develops and includes in the public record.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6f2-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/2/B\"><num value=\"B\">(B)</num><content> The Attorney General shall submit a finding under paragraph (1)(A) of this subsection promptly to the Secretary. If the Attorney General finds that the application of the standard under subsection (a) or (b) of this section, or both, has not been effective, the Secretary shall issue, not later than 180 days after receiving that finding, an order terminating the standard the Attorney General found was ineffective. The termination is effective for the model year beginning after the order is issued.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6f3-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/d/3\"><num value=\"3\">(3)</num><content> In making a finding under paragraph (1)(B) of this subsection, the Secretary shall consider the additional cost, competition, and available alternatives. If the Attorney General finds that the anti-theft devices are an effective substitute, the Secretary shall continue to grant exemptions under <ref href=\"/us/usc/t49/s33106\">section 33106 of this title</ref> for the model years after model year 2000 at one of the following levels that the Attorney General decides: at the level authorized before <date date=\"1992-10-25\">October 25, 1992</date>, or at the level provided in <ref href=\"/us/usc/t49/s33106/b/2/C\">section 33106(b)(2)(C) of this title</ref> for model year 2000.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6f4-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Effective Date of Standard</inline>.—</heading><chapeau>A standard prescribed under this section takes effect at least 6 months after the date the standard is prescribed, except that the Secretary may prescribe an earlier effective date if the Secretary—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6f5-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/e/1\"><num value=\"1\">(1)</num><content> decides with good cause that the earlier date is in the public interest; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id3545b6f6-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/e/2\"><num value=\"2\">(2)</num><content> publishes the reasons for the decision.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id3545b6f7-ec39-11e5-b01e-e2270cb35279\" identifier=\"/us/usc/t49/s33103/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Notification of Congress</inline>.—</heading><content>The Secretary and the Attorney General shall inform the appropriate legislative committees of Congress with jurisdiction over this part and <ref href=\"/us/usc/t18/s2322\">section 2322 of title 18</ref> of actions taken or planned under this section.</content>\n</subsection>\n<sourceCredit id=\"id3545b6f8-ec39-11e5-b01e-e2270cb35279\">(<ref href=\"/us/pl/103/272\">Pub.
