<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id35482795-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111"><num value="33111">§ 33111.</num><heading> Verifications involving motor vehicle major parts</heading><subsection style="-uslm-lc:I11" class="indent0" id="id35482796-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/a"><num value="a">(a)</num><heading> <inline class="small-caps">General Requirements</inline>.—</heading><chapeau>A person engaged in the business of salvaging, dismantling, recycling, or repairing passenger motor vehicles may not knowingly sell in commerce or transfer or install a major part marked with an identification number without—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id35482797-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/a/1"><num value="1">(1)</num><content> first establishing, through a procedure the Attorney General by regulation prescribes in consultation with the Secretary of Transportation under <ref href="/us/usc/t49/s33109">section 33109 of this title</ref>, that the major part has not been reported as stolen; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35482798-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/a/2"><num value="2">(2)</num><chapeau> providing the purchaser or transferee with a verification—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id35482799-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/a/2/A"><num value="A">(A)</num><content> identifying the vehicle identification number (or derivative of that number) of that major part; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3548279a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/a/2/B"><num value="B">(B)</num><content> verifying that the major part has not been reported as stolen.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3548279b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/b"><num value="b">(b)</num><heading> <inline class="small-caps">Nonapplication</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id3548279c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/b/1"><num value="1">(1)</num><chapeau> Subsection (a) of this section does not apply to a person that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id3548279d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/b/1/A"><num value="A">(A)</num><content> is the manufacturer of the major part;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id3548279e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/b/1/B"><num value="B">(B)</num><content> has purchased the major part directly from the manufacturer; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id3548279f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/b/1/C"><num value="C">(C)</num><content> has received a verification from an insurance carrier under <ref href="/us/usc/t49/s33110">section 33110 of this title</ref> that the motor vehicle from which the major part is derived has not been reported as stolen, or that the carrier has not established whether that vehicle has been stolen.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id354827a0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/b/2"><num value="2">(2)</num><content> A person described under paragraph (1)(C) of this subsection that subsequently transfers or sells in commerce the motor vehicle or a major part of the vehicle shall provide the verification received from the carrier to the person to whom the vehicle or part is transferred or sold.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id354827a1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s33111/c"><num value="c">(c)</num><heading> <inline class="small-caps">Regulations</inline>.—</heading><content>The Attorney General shall prescribe regulations to carry out this section. The regulations shall include regulations prescribed in consultation with the Secretary that are necessary to ensure that a verification a person provides under subsection (a)(2) of this section is uniform, effective, and resistant to fraudulent use.</content>
