<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id35540e11-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105"><num value="40105">§ 40105.</num><heading> International negotiations, agreements, and obligations</heading><subsection style="-uslm-lc:I11" class="indent0" id="id35540e12-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/a"><num value="a">(a)</num><heading> <inline class="small-caps">Advice and Consultation</inline>.—</heading><content>The Secretary of State shall advise the Administrator of the Federal Aviation Administration and the Secretaries of Transportation and Commerce, and consult with them as appropriate, about negotiations for an agreement with a government of a foreign country to establish or develop air navigation, including air routes and services. The Secretary of Transportation shall consult with the Secretary of State in carrying out this part to the extent this part is related to foreign air transportation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id35540e13-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/b"><num value="b">(b)</num><heading> <inline class="small-caps">Actions of Secretary and Administrator</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id35540e14-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/b/1"><num value="1">(1)</num><chapeau> In carrying out this part, the Secretary of Transportation and the Administrator—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id35540e15-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/b/1/A"><num value="A">(A)</num><content> shall act consistently with obligations of the United States Government under an international agreement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35540e16-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/b/1/B"><num value="B">(B)</num><content> shall consider applicable laws and requirements of a foreign country; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id35540e17-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/b/1/C"><num value="C">(C)</num><content> may not limit compliance by an air carrier with obligations or liabilities imposed by the government of a foreign country when the Secretary takes any action related to a certificate of public convenience and necessity issued under chapter 411 of this title.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id35540e18-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/b/2"><num value="2">(2)</num><content> This subsection does not apply to an agreement between an air carrier or an officer or representative of an air carrier and the government of a foreign country, if the Secretary of Transportation disapproves the agreement because it is not in the public interest. <ref href="/us/usc/t49/s40106/b/2">Section 40106(b)(2) of this title</ref> applies to this subsection.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id35540e19-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c"><num value="c">(c)</num><heading> <inline class="small-caps">Consultation on International Air Transportation Policy</inline>.—</heading><chapeau>In carrying out <ref href="/us/usc/t49/s40101/e">section 40101(e) of this title</ref>, the Secretaries of State and Transportation, to the maximum extent practicable, shall consult on broad policy goals and individual negotiations with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id35540e1a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/1"><num value="1">(1)</num><content> the Secretaries of Commerce and Defense;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e1b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/2"><num value="2">(2)</num><content> airport operators;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e1c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/3"><num value="3">(3)</num><content> scheduled air carriers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e1d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/4"><num value="4">(4)</num><content> charter air carriers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e1e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/5"><num value="5">(5)</num><content> airline labor;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e1f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/6"><num value="6">(6)</num><content> consumer interest groups;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e20-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/7"><num value="7">(7)</num><content> travel agents and tour organizers; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id35540e21-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/c/8"><num value="8">(8)</num><content> other groups, institutions, and governmental authorities affected by international aviation policy.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id35540e22-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40105/d"><num value="d">(d)</num><heading> <inline class="small-caps">Congressional Observers at International Aviation Negotiations</inline>.—</heading><content>The President shall grant to at least one representative of each House of Congress the privilege of attending international aviation negotiations as an observer if the privilege is requested in advance in writing.</content>
