<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3558c8ae-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118"><num value="40118">§ 40118.</num><heading> Government-financed air transportation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3558c8af-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a"><num value="a">(a)</num><heading> <inline class="small-caps">Transportation by Air Carriers Holding Certificates</inline>.—</heading><chapeau>A department, agency, or instrumentality of the United States Government shall take necessary steps to ensure that the transportation of passengers and property by air is provided by an air carrier holding a certificate under <ref href="/us/usc/t49/s41102">section 41102 of this title</ref> if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3558c8b0-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/1"><num value="1">(1)</num><chapeau> the department, agency, or instrumentality—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3558c8b1-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/1/A"><num value="A">(A)</num><content> obtains the transportation for itself or in carrying out an arrangement under which payment is made by the Government or payment is made from amounts provided for the use of the Government; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3558c8b2-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/1/B"><num value="B">(B)</num><content> provides the transportation to or for a foreign country or international or other organization without reimbursement;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3558c8b3-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/2"><num value="2">(2)</num><content> the transportation is authorized by the certificate or by regulation or exemption of the Secretary of Transportation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3558c8b4-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/3"><num value="3">(3)</num><chapeau> the air carrier is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id3558c8b5-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/3/A"><num value="A">(A)</num><content> available, if the transportation is between a place in the United States and a place outside the United States; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id3558c8b6-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/a/3/B"><num value="B">(B)</num><content> reasonably available, if the transportation is between 2 places outside the United States.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3558c8b7-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/b"><num value="b">(b)</num><heading> <inline class="small-caps">Transportation by Foreign Air Carriers</inline>.—</heading><chapeau>This section does not preclude the transportation of passengers and property by a foreign air carrier if the transportation is provided under a bilateral or multilateral air transportation agreement to which the Government and the government of a foreign country are parties if the agreement—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3558c8b8-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/b/1"><num value="1">(1)</num><content> is consistent with the goals for international aviation policy of <ref href="/us/usc/t49/s40101/e">section 40101(e) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3558c8b9-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/b/2"><num value="2">(2)</num><content> provides for the exchange of rights or benefits of similar magnitude.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3558c8ba-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/c"><num value="c">(c)</num><heading> <inline class="small-caps">Proof</inline>.—</heading><content>The Administrator of General Services shall prescribe regulations under which agencies may allow the expenditure of an appropriation for transportation in violation of this section only when satisfactory proof is presented showing the necessity for the transportation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3558c8bb-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/d"><num value="d">(d)</num><heading> <inline class="small-caps">Certain Transportation by Air Outside the United States</inline>.—</heading><content>Notwithstanding subsections (a) and (c) of this section, any amount appropriated to the Secretary of State or the Administrator of the Agency for International Development may be used to pay for the transportation of an officer or employee of the Department of State or one of those agencies, a dependent of the officer or employee, and accompanying baggage, by a foreign air carrier when the transportation is between 2 places outside the United States.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3558c8bc-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/e"><num value="e">(e)</num><heading> <inline class="small-caps">Relationship to Other Laws</inline>.—</heading><content>This section does not affect the application of the antidiscrimination provisions of this part.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3558c8bd-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/f"><num value="f">(f)</num><heading> <inline class="small-caps">Prohibition of Certification or Contract Clause</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id3558c8be-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40118/f/1"><num value="1">(1)</num><content> No certification by a contractor, and no contract clause, may be required in the case of a contract for the transportation of commercial items in order to implement a requirement in this section.</content>
