<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id355b1329-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40123"><num value="40123">§ 40123.</num><heading> Protection of voluntarily submitted information</heading><subsection style="-uslm-lc:I11" class="indent0" id="id355b132a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40123/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Notwithstanding any other provision of law, neither the Administrator of the Federal Aviation Administration, nor any agency receiving information from the Administrator, shall disclose voluntarily-provided safety or security related information if the Administrator finds that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id355b132b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40123/a/1"><num value="1">(1)</num><content> the disclosure of the information would inhibit the voluntary provision of that type of information and that the receipt of that type of information aids in fulfilling the Administrator’s safety and security responsibilities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id355b132c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40123/a/2"><num value="2">(2)</num><content> withholding such information from disclosure would be consistent with the Administrator’s safety and security responsibilities.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id355b132d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s40123/b"><num value="b">(b)</num><heading> <inline class="small-caps">Regulations</inline>.—</heading><content>The Administrator shall issue regulations to carry out this section.</content>

L. 112–95, title III</ref>, § 344, <date date="2012-02-14">Feb. 14, 2012</date>, <ref href="/us/stat/126/81">126 Stat. 81</ref>, provided that:<quotedContent origin="/us/pl/112/95/tIII">
<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Voluntary Disclosure Reporting Program Defined</inline>.—</heading><content>In this section, the term ‘Voluntary Disclosure Reporting Program’ means the program established by the Federal Aviation Administration through Advisory Circular 00–58A, dated <date date="2006-09-08">September 8, 2006</date>, including any subsequent revisions thereto.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Verification</inline>.—</heading><chapeau>The Administrator of the Federal Aviation Administration shall modify the Voluntary Disclosure Reporting Program to require inspectors to—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> verify that air carriers are implementing comprehensive solutions to correct the underlying causes of the violations voluntarily disclosed by such air carriers; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> confirm, before approving a final report of a violation, that a violation with the same root causes, has not been previously discovered by an inspector or self-disclosed by the air carrier.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Supervisory Review of Voluntary Self-Disclosures</inline>.—</heading><content>The Administrator shall establish a process by which voluntary self-disclosures received from air carriers are reviewed and approved by a supervisor after the initial review by an inspector.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> Inspector General Study.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Inspector General of the Department of Transportation shall conduct a study of the Voluntary Disclosure Reporting Program.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Review</inline>.—</heading><chapeau>In conducting the study, the Inspector General shall examine, at a minimum, if the Administration—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> conducts comprehensive reviews of voluntary disclosure reports before closing a voluntary disclosure report under the provisions of the program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> evaluates the effectiveness of corrective actions taken by air carriers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> effectively prevents abuse of the voluntary disclosure reporting program through its secondary review of self-disclosures before they are accepted and closed by the Administration.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Report to congress</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act [<date date="2012-02-14">Feb. 14, 2012</date>], the Inspector General shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and Committee on Commerce, Science, and Transportation of the Senate a report on the results of the study conducted under this section.”</content>
