<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id355d8413-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102"><num value="41102">§ 41102.</num><heading> General, temporary, and charter air transportation certificates of air carriers</heading><subsection style="-uslm-lc:I11" class="indent0" id="id355d8414-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/a"><num value="a">(a)</num><heading> <inline class="small-caps">Issuance</inline>.—</heading><chapeau>The Secretary of Transportation may issue a certificate of public convenience and necessity to a citizen of the United States authorizing the citizen to provide any part of the following air transportation the citizen has applied for under <ref href="/us/usc/t49/s41108">section 41108 of this title</ref>:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id355d8415-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/a/1"><num value="1">(1)</num><content> air transportation as an air carrier.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id355d8416-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/a/2"><num value="2">(2)</num><content> temporary air transportation as an air carrier for a limited period.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id355d8417-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/a/3"><num value="3">(3)</num><content> charter air transportation as a charter air carrier.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id355d8418-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/b"><num value="b">(b)</num><heading> <inline class="small-caps">Findings Required for Issuance</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id355d8419-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/b/1"><num value="1">(1)</num><content> Before issuing a certificate under subsection (a) of this section, the Secretary must find that the citizen is fit, willing, and able to provide the transportation to be authorized by the certificate and to comply with this part and regulations of the Secretary.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id355d841a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/b/2"><num value="2">(2)</num><content> In addition to the findings under paragraph (1) of this subsection, the Secretary, before issuing a certificate under subsection (a) of this section for foreign air transportation, must find that the transportation is consistent with the public convenience and necessity.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id355d841b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/c"><num value="c">(c)</num><heading> <inline class="small-caps">Temporary Certificates</inline>.—</heading><chapeau>The Secretary may issue a certificate under subsection (a) of this section for interstate air transportation (except the transportation of passengers) or foreign air transportation for a temporary period of time (whether the application is for permanent or temporary authority) when the Secretary decides that a test period is desirable—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id355d841c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/c/1"><num value="1">(1)</num><content> to decide if the projected services, efficiencies, methods, and prices and the projected results will materialize and remain for a sustained period of time; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id355d841d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/c/2"><num value="2">(2)</num><content> to evaluate the new transportation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id355d841e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41102/d"><num value="d">(d)</num><heading> <inline class="small-caps">Foreign Air Transportation</inline>.—</heading><content>The Secretary shall submit each decision authorizing the provision of foreign air transportation to the President under <ref href="/us/usc/t49/s41307">section 41307 of this title</ref>.</content>

<p style="-uslm-lc:I21" class="indent0">In this section, the words “citizen of the United States” and “citizen” are substituted for “applicant” for clarity and consistency because only a citizen of the United States may be an “air carrier” as defined in section 40102(a) of the revised title, and only an air carrier may be a “charter air carrier” as defined in section 40102(a).
