<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id3564b022-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511"><num value="41511">§ 41511.</num><heading> Special prices for foreign air transportation</heading><subsection style="-uslm-lc:I11" class="indent0" id="id3564b023-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a"><num value="a">(a)</num><heading> <inline class="small-caps">Free and Reduced Pricing</inline>.—</heading><chapeau>This chapter does not prohibit an air carrier or foreign air carrier, under terms the Secretary of Transportation prescribes, from issuing or interchanging tickets or passes for free or reduced-price foreign air transportation to or for the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3564b024-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/1"><num value="1">(1)</num><content> a director, officer, or employee of the carrier (including a retired director, officer, or employee who is receiving retirement benefits from an air carrier or foreign air carrier).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b025-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/2"><num value="2">(2)</num><content> a parent or the immediate family of such an officer or employee or the immediate family of such a director.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b026-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/3"><num value="3">(3)</num><content> a widow, widower, or minor child of an employee of the carrier who died as a direct result of a personal injury sustained when performing a duty in the service of the carrier.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b027-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/4"><num value="4">(4)</num><content> a witness or attorney attending a legal investigation in which the air carrier is interested.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b028-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/5"><num value="5">(5)</num><content> an individual injured in an aircraft accident and a physician or nurse attending the individual.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b029-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/6"><num value="6">(6)</num><content> a parent or the immediate family of an individual injured or killed in an aircraft accident when the transportation is related to the accident.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b02a-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/7"><num value="7">(7)</num><content> an individual or property to provide relief in a general epidemic, pestilence, or other emergency.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b02b-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/a/8"><num value="8">(8)</num><content> other individuals under other circumstances the Secretary prescribes by regulation.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id3564b02c-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/b"><num value="b">(b)</num><heading> <inline class="small-caps">Space-Available Basis</inline>.—</heading><chapeau>Under terms the Secretary prescribes, an air carrier or foreign air carrier may grant reduced-price foreign air transportation on a space-available basis to the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id3564b02d-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/b/1"><num value="1">(1)</num><content> a minister of religion.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b02e-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/b/2"><num value="2">(2)</num><content> an individual who is at least 60 years of age and no longer gainfully employed.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b02f-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/b/3"><num value="3">(3)</num><content> an individual who is at least 65 years of age.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id3564b030-ec39-11e5-b01e-e2270cb35279" identifier="/us/usc/t49/s41511/b/4"><num value="4">(4)</num><content> an individual who has severely impaired vision or hearing or another physical or mental handicap and an accompanying attendant needed by that individual.</content>

<p style="-uslm-lc:I21" class="indent0">In this section, the words “foreign air transportation” are substituted for “transportation” and “in the case of overseas or foreign air transportation” because 49 App.:1551(a)(4)(B) provides that 49 App.:1373 no longer applies to interstate or overseas air transportation and 49 App.:1376(a)–(e), restated in section 41901 of the revised title, governs rates for the transportation of mail by aircraft. See section 40102(a) of the revised title defining “air transportation” to mean interstate or foreign air transportation or the transportation of mail by aircraft. The word “conditions” is omitted as being included in “terms”.</p>
<p style="-uslm-lc:I21" class="indent0">In subsection (a)(7), the words “or other emergency” are substituted for “other calamitous visitation” for consistency.</p>
<p style="-uslm-lc:I21" class="indent0">In subsection (b)(2), the words “no longer gainfully employed” are substituted for “retired” and “For purposes of this subsection, the term ‘retired’ means no longer gainfully employed as defined by the Board” to eliminate unnecessary words.</p>
<p style="-uslm-lc:I21" class="indent0">In subsection (b)(4), the words “an individual who has severely impaired vision or hearing or another physical or mental handicap” are substituted for “handicapped person” and “For the purposes of this subsection, the term ‘handicapped person’ means any person who has severely impaired vision or hearing, and any other physically or mentally handicapped person, as defined by the Board” to eliminate unnecessary words.</p>
