<chapeau style="-uslm-lc:I11" class="indent0">The Secretary of Transportation may establish—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida5c82cc9-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s41701/1"><num value="1">(1)</num><content> reasonable classifications for air carriers when required because of the nature of the transportation provided by them; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida5c82cca-2a3f-11ef-a0d7-af5c201cbc6c" identifier="/us/usc/t49/s41701/2"><num value="2">(2)</num><content> reasonable requirements for each class when the Secretary decides those requirements are necessary in the public interest.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act [<date date="2024-05-16">May 16, 2024</date>], the Administrator [of the Federal Aviation Administration] shall issue guidance to part 121 air carriers relating to the expression of milk by crewmembers on an aircraft during noncritical phases of flight, consistent with the performance of the crewmember’s duties aboard the aircraft. The guidance shall be equally applicable to any lactating crewmember. In developing the guidance, the Administrator shall—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> consider multiple methods of expressing breast milk that could be used by crewmembers, including the use of wearable lactation technology; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><chapeau> ensure the guidance will not require an air carrier or foreign air carrier to incur significant expense, such as through—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> the addition of an extra crewmember in response to providing a break;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> removal or retrofitting of seats on the aircraft; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> modification or retrofitting of an aircraft.</content>
</subparagraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Crewmember</inline>.—</heading><content>The term ‘crewmember’ has the meaning given such term in section 1.1 of title 14, Code of Federal Regulations.</content>
